Hi guys, MMF just called my work phone number (Security Department in an MOD building) with a pre-recorded message saying "We are looking to speak to a Mr. Yukiko regarding an outstanding account; please contact us back to prevent a home or workplace visit".

 

Is this legal? My manager has just rang them and given it to them hammer and tongs, and he's backing me all the way. There's no way they should have this number as when it's called from, it is witheld.

Interesting. Keep us updated as to what Fos said etc. Nice to have an understanding boss for sure

 

FOS are raising complaint to them by letter and e-mail and have asked me to keep an eye on my e-mail inbox for further communication.

 

Am I right in thinking I've just cost MMF £500.00?

Right, I'm having major issues getting through to these people. I've sent two e-mails as below;

 

To whom it may concern,

 

Despite all requests for you to send me proof of any debt before continuing contact, you have not complied.

 

I have therefore lodged complaint to the FOS and the OFT along with the MOD (Who's phone you've been ringing). My manager has also written a statement which has been signed and placed in safekeeping confirming that your pre-recorded message disclosed information to defame and embarass the alleged debtor.

 

In addition, complaint has also been made to the above regarding your call centre operative that took the phone call as she had identified my personal details to somebody other than me without checking that the person on the phone was in fact the correct person. The reference number was not given on the phone call and details regarding my personal business were disclosed.

 

I now ask that you cease and desist contact by telephone as your operatives can clearly not be trusted with personal data and I also ask that this complaint also be passed to your data controller for consideration.

 

Let me reiterate, there will be NO contact by telephone and further contact by telephone to my work place WILL result in court action as you are holding up an EMERGENCY line at the [important MOD building]

Your actions as a company are far from the professional standards set to you and judging by the amount of complaints made to the FOS/OFT regarding your practice, I do feel sorry for your underqualified employees who's jobs are potentially on the line from your consistant rule breaking.

The original debt was agreed by Mr. Lender at £395 and we were all for a repayment plan, so I don't quite know what is going on. But MMF are ignoring all requests to prove that this debt exists. I've got all the e-mails saved so it's blatent that they're ignoring them.

Got a response from the OFT... Generic one stating that they'll look into MMF for me if enough people moan about them.

 

They've got a CCL which I can post up the number here for too...

Honestly, they're a bunch of losers.

 

I strongly urge anyone else who's having issues to report them to everyone that'll listen.

 

I'm guessing it wont be long before OFT/FOS HAVE to take action seeing as quite a few have complained already.

I also defaulted on a wage day advance loan of £150.00 and got a email from them that Motormile finance now own the debt, within 1 day of the email, a voice and text message was left on my employers phone. Is this allowed?

Hello all, I posted here few weeks back as motormile keep calling my employers phone and leaving messages about me owing money (£150 to WDA), i have emailed them on many occassions requesting not to phone my employers number and contact me directly which they have been ignoring, i have asked to arrange a payment plan for me but they do not respond. My employer told me that a message was left on the answer phone for me saying something about 3 convictions and a warrant? Why don't they contact me directly instead of my employer, i'm grateful that my boss has been understanding as my hours have been reduced at work so they understand the situation but have requested that i contact MMf and ask to remove their number which i have asked but they do not listen. This is just so embarrasing and causing me a great deal of stress and they keep doing it after me repeatedly telling them not to. I don't know what to do as they should not be allowed to do this. Any help or advice would be appreciated. Thank you.

You need to get your boss to make a formal complaint. Also inform the OFT and OFCOM. Also the ICO.

 

You also need to make a full complaint to Motormile, but address it to their CEO or Data Controller.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

 

I have verbally requested that these stop, but I am still receiving calls and I now require all further communication from your company to be made in writing only. It is my legal right to communicate in writing under Article 8 of the European Convention on Human Rights and prevents any misunderstanding.

I withdraw my consent (under s.10 of the DPA) for you to process my personal data with respect to my personal or work telephone numbers registered with you or stored on your systems/records.

 

The processing and use of these numbers is causing significant distress.

 

I am also of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

 

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you may be liable to a substantial fine and/or other sanctions as they see fit. Be advised that any further telephone calls from your company may be recorded and used in evidence and I expect this harassment to cease immediately.

 

Any and all further correspondence must be in writing only.

You must add a clause in that letter that deals with the telephone calls at work. Especially as the content of the calls are a blatant disregard for the DPA 1998 which is a criminal act.

The Administration of Justice Act 1970 S.40 makes it a Criminal Offence for a creditor or a creditor's agent (often a debt collection agency) to make demands (for money), which are aimed at causing 'alarm, distress or humiliation, because of their frequency or publicity or manner'.

 

if you feel you are subject to Debt Collection Harassment then this too could be classed as a criminal offence. Harassment can be verbal or in writing and would include making repeated calls to your workplace or in anti social hours. The Protection from Harassment Act 1997 makes it a Criminal Offence for any person to pursue a course of action "which they know, or ought to know, amounts to harassment of another person".

Jay,That phone message is so out of order that it must be reported to the OFT Dedt Collection Team, it would be fanatastic if the answerphone recording was avaiable as well.

 

I suggest sending the following letter by recorded delivery.

Formal Complaint.

 

Dear Mr. Sands,

 

Motor Mile Finance Ltd; has over the past few weeks wage a campaingn of telephone harassment against me, as you will be able to check from your records I have e-mailed the company many times requesting that this harassment should stop and that I wish to deal with this matter in writting only.

 

I have also requested that an affordable repayment plan be set up for me to clear this debt but my requests have been ignored and the harassment has continued

 

The most serious matter is a message left by an operative of MMF on my employers answerphone on xx xx xxxx, which mentoined ''convictions and a warrant'' needless to say this has caused condireable embarassment to me an has endangered my employment as I am already working reduced hours.

 

I am sure I do not have to spell out the breaches of the OFT Guidance on Debt Collection 2003/2012, which in my opinoion are very serious,and having researched the conduct of MMF Ltd it appears that many complaints such as this are being made.

 

I would suggest that given MMFs appalling conduct and telephone harassment that it should seriously consider a financial redress of at least the amount of the outstanding debt.

 

I would expect Motor Mile Finance to make a speedy and appropriate response to my complaint.
