      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi..

 

Just over 3 weeks ago my husband received his sleep test results back from his cardio consultant,

 

turns out he is suffering from mild sleep apnea :-(..

 

on the letter from consultant it stated he was to advise DVLA which he did that day and they told him best way forward is to surrender his driving licence which he has now done .

 

My hubby is getting high rate care/ mobility and he has a motability car which he can no longer drive until his sleep apnea is under control which could take months ,

 

rather than have a car sat outside being paid for but getting no use

 

i called motability who informed me because my husband was stopped from driving for 6 months 4 years ago

and had returned the car he had on motability at that time we would have to pay a fee of £250.00 to end this present contract with no ifs or buts.

 

.if this is the case how can this be right ?

 

told he cannot drive through consultant and dvla .

..where does the 250 go ?

and is there any advise somebody can give has theres noway possible we can afford to pay out that sort of money .

 

..i tried explaining to motability it wasnt through choice but they didnt seem interested or want to listern until we pay the £250 PLEASE HELP OR ADVISE ME

Had a look at motability website and found this:

Its the motability car handbook. On pages 20/21 it says about handing the car back early. It goes on about needing a valid reason and that they would require a cancelation fee to cover their costs.

Hiya .

Thankyou for your replies i have also read that too that there has to be a good reason for wanting to cancel and return the car which i think having no licence and not being able to drive by order of dvla and consultant is a good enough reason,it also states a charge of upto £250.00 ,trying to work out why they ask husband for the 250 aswell when it could be less????

 

ah well looks like theres noway round it will just not have to pay bills for a month instead and give motability 250 quid :-(

on page 21 :

I think that may suggest that they wouldnt expect to have the £250 up front. Probably a good idea to ring and explain by paying it one go means hardship and wont be able to pay bills. I would also write to them asking how the figure of £250 is arrived at.

I have already done all of this ,

 

told them there is nobody able to help us pay the 250 ,

 

they said until that is paid in full the car remains with us and we have to continue to have money stopped to pay for it

 

,told them also i wanted to know where this £250 comes from

 

they did actually state it was standard for cancelling agreements ,

we dont even want to return the car incase hubby is given the go ahead to drive again

 

we dont know whats happening yet could be 6 months or more and

 

we just dont see the point of having a car sat doing nothing and been payed for when we could perhaps do something more with the money thats paying for the car.

 

..oh by the way we have 1 year left on our agreement then we could have a new car through mobility if we wished to do so.

I have an idea,,

I don;t know if it applies to contracts ending early so check it.

 

..I handed my car back at the end of my contract last year and 2 days later got a cheque from Motability for handing it back in good condition.

 

As I said,,I don't know if it will apply to your case but it's worth enquiring.

 

And it was for £250 funnily enough.

did your husband speak to somebody from dvla medical services or just a normal operator

when i was diagnosed with medium level sleep apnea 5 years ago i spoke to dvla medical services and they sent me a form to fill out and send back ,with information about my condition ,consultant etc.they then informed me a few weeks later that i was ok to carry on driving

the same thing happened 2 years ago when i had a pacemaker fitted to cure an arrythmia problem

i cannot understand why they would want your husband to surrender his licence for mild sleep apnea, they might have just meant temporarily

i urge you to get your husband to get back in touch with them and speak to dvla medical section

my husband suffers from sleep apoea when he was accessed the lady who did it said it was the worse case she had seen in the 10 years of her doing this job. He was given his cpap machine and told to inform the dvla that he had a machine . They sent him a form he filled it in and sent it back. He was never told to stop driving which I thought would have happened at the time as he is a hgv driver. The medical section at the dvla told him as long as he used his machine at night then he was able to drive with no problems. I would check with the hospital again they are probably saying do not drive until you feel confident enough that the cpap is doing it's job

The contract your hubby signed when he picked up the car,states if you end early then you still have to pay until the end of contract,no matter what,oh,,unless the person dies, its a huge rip off i understand your situation,its good when they offer the scheme cant do enough for you,but watch them show the true colors if your circumstances change,all i can advise after 10 years on the scheme is find a friend to drive ,or fake your hubbys death lol.sorry seems they just want the money,till your due to hand back,then they just sell it on and keep that money also, i have just been told after all the cars i have had 5 to date that i cannot be put on the insurance due to 3 points i got for no L plates on a motorbike i had last year,but my nominated driver also has 3 points but he is ok to be on the cover note, so i have a car that i cant use unless i arrange my friend to drive me which is hard to do as he works almost 45 hrs a week,the mind boggles at the rules im not handing it back to still be paying for 3 yrs,i would rather see it rot, hope you get a result, good luck...

The way I see i is that returning the car 4 yrs ago was ok but they are going to charge this time because you are doing it a 2nd time and your husband surrendered his licence he was not told he had to give it up
