Your insurance requirement is unlawful and is contrary to section 57 of the Consumer Rights Act, and also section 72 of the same statute. I would also refer you to the outcomes in PENCHEV v P2G (225MC852) and SMIRNOVS v P2G (27MC729).  My deadline for action - 1 May 2024 - still stands, and if P2G wish to avoid the addition of court costs and interest to my claim, you may wish to respond positively before that date.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hiya all :-)

On the 5th of this month I ordered an ipod and head phone set online paid in full straight away..

 

It was advertised on the tv.

 

.BUT on the 10th I received a box and in that box was some one elses computer ink and details

 

..I was NOT happy and took the box containing the ink back to pcworld ..

 

They then said nothing like this has ever happened before and

 

I was spoke to someone on the phone who said they would need to investigate what had happened .

 

.Since then I have called them and been into pcworld and emailed also only to be met with the same old "we are still investigating"

yet they have ADMITTED it was THEIR fault

 

..and that a mix up had happened yet I still havent received any goods

 

..I have not spoken to the same person more than once and get met with the same .

 

..I feel well and truly fobbed off .

 

.On Wednesday this week i was told I MIGHT get a delivery yet the day after told nooo we are still investigating BUT they KNOW what has gone wrong .

 

... So last night that being the 21st I had had enough! so I asked for a refund and was told NOPE sorry I CANNOT refund you your money

as "we are STILL investigating !!

 

I just do not know what else to do??

 

any ideas please !!

The only thing to do is to send them a 7 day LBA - setting out what has happened, what you want and giving them 7 days to provide you with the refund or you will sue.

 

The sue.

Don't hang around. Don't discuss or accept promises - just do it.

It is very easy, cheap, risk free - and when you win - or more likely when they settle you will get all of your claim fee back.

Add £50 for the inconvenience and you will get that too. Don't accept vouchers.

 

If you aren't prepared to do this, then don't make threat but settle in for a long frustrating wait.

It has been a pain to say the least !

 

my phone bill is going to be through the roof what with being left of hold !

(prob with others complaining as I have !)

 

My brother found my rights where if sent the wrong item Im fully!! entitled to a refund

 

I emailed that to them but they havent replied and when if they do I just get the same sort of stuff ..

 

I have never sued but would If it came to it!

 

If nothing happens tomorrow I know I have done all I can .

 

.I know this though that I will NEVER buy online from pcworld ever again !!

 

I just want my money back..

..what is a 7 day LBA ? ..

.I never get past the first call .

.It is beyond a joke !!

 

I have told them my rights but it all gets ignored .

Bit more extreme but this worked for me against a certain well known mobile phone chain, if you are feeling brave.

 

 

 

I ordered a replacement external aerial for an Ericsson phone from their website.

 

Part arrived, it was for the wrong phone.

 

I rang their Internet 'customer service' and told the guy that I had been sent the wrong part and that it was thus advertised incorrectly on their site.

 

His response was "What do you want me to do about it?"

 

I asked if I could be sent the correct part, again I got "What do you want me to do about it?"

 

So I headed directly down to their local branch and asked to speak to the Manager.

 

They were reluctant to go and get him so I raised my voice so all of the customers in the shop could hear me and started to recount the incident and emphasised the call centre bloke's words, the Manager was there like a shot, I got a refund for the part, a profuse apology and he did all he could to try and track the correct part.

 

 

I work within a software technical support environment and inwardly sigh when customers tell me they have had dealings with pcworld.

Hiya I did go into pcworld but was just told it was their online pcworld ??and got no where!! ..I think If ever I do have another issue I will do as you did and get a little louder to get myself heard In person :) on the phone and via email you can just be told the right words and get no where !! to everyone out there do not let big companys intimidate you !! if you are wronged fight for your rights .. :)

Indeed, as someone else mentioned though, a chargeback or threat of one is also a good weapon.

 

I bought a custom built PC and monitor on an RBS issued Mastercard

 

The PC arrived and the system builder indicated I should report any transit damage within 24 hours.

 

Plugged the LCD monitor in and it was completely dead.

 

Rang the company and told them I could obviously not test the system without a monitor so asked for a refund on the monitor and I would go and purchase one, they booked a courier for the following Thursday

 

Selected one in the local PC World (I am a tech support professional so know what I'm looking for), got it home and hooked it up, system was fine and exactly as ordered.

 

Courier came on the Thursday and uplifted the dead monitor, I waited a month for the refund onto my card, nothing.

 

Rang the company who confirmed they had the dead monitor in their warehouse, put through to accounts and told another 7 days.

 

Waited and still no refund, phoned again back through to accounts and asked where the 178 quid for the monitor was, told "Our accounts department has far more important things to deal with than your refund"

 

Oh really I thought so rang RBS and told them, they put me through to a department that deals with chargebacks who told me to simply send through all the documentation regarding the purchase and they would handle it.

 

Phoned the accounts department back and told them they had 5 working days to refund the card otherwise I'd turn the matter over to the card company to deal with.

 

On the third working day I check the online account for the card and there's a refund.

It is disgusting how once companys have your money.. the fight you have to go through to get It back...I wonder how many people if any have given up on trying to get their cash back as in now way do companys make it easy at all!! they just have no clue do they !! Im glad you also got your refund :)

I never buy anything online using anything other than a credit card as companies don't tend to want to pee off the credit card companies and it means you are not out of pocket if something does not turn up or something goes wrong.
