I have received pcn's from 'P4Parking'.

I'm new here, I like the info available great work guys!

 

I have somewhat of an issue.

I have received PCN's from 'P4Parking'.

 

The weather proof covering is labelled "Parking Infringement Notice" but the actual ticket says "Parking Charge Notice".

 

These tickets were issued on a private housing estate.

 

I wish to appeal them, but I'm wondering if I actually need to?

 

1 ticket has the mistake of NOT mentioning the actual price of the ticket, stating:

"...A parking charge of £ is now due."

 

This ticket in the next sentence goes on to list the discounted amount of £65, however according to Section 66, subsection 3(b) of the Road Traffic Act 1991

"A penalty charge notice must state- the amount of the penalty charge which is payable;"

 

So I was considering appealing on those grounds, although I'm not entirely sure the RTA covers privately issued PCN's?

 

The second ticket, lists my VRN, make of vehicle but the model number is that of a model other than my car.

The vehicle CLEARLY had the model number on the back.

 

The tickets were issued two days apart and are made out for the same contravention code 12 - Expired permit on display.

 

The interesting thing about this is, the ticket without the price has the right car details, the ticket with the price has the wrong model no. information.

 

 

I'd like to know where I stand, your advice would be much appreciated.

It is not a penalty charge and it has nothing to do with the Road Traffic Act.

 

It is merely an invoice attched to your car by a company that may or may not have the authority from the land owner to collect money for parking where you did, in a private car park.

 

As such, you dont have to pay.

 

Private housing estate s throw up their own confusions with regard to ownership of the land

so there is less chance of it being a lawfully prescribed invoice.

 

The advice on these forums is always the same. IGNORE.

as such there are no 'laws'

 

its private property

 

they are speculative invoices.

The law of contract with the landowner only, not the PPC.
