      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I actually find it quite hard to believe that this part of the defence wasn't struck out too, because as you've correctly stated my claim actually started the date I first made contact with the bank, which was infact 28 days prior to the date of filing my claim through the courts.

This is just a joke. Some people are being charged £3/400 pounds in a month in charges. By using the system like this, they are saving themselves hundreds of pounds. Im sure I read on another thread somewhere that this was successfully argued with the court. Wish I could remember who it was.

Well this is the moment I've been waiting for, got home from work to find I'd missed a special delivery.

 

Rushed to P.O., and yes, cheque for full amount (bar the AQ fee:( )

 

Letter read as follows:-

 

Dear Sir

 

Our client: National Westminster Bank plc

Claim No: 6QZ68737

 

We refer to the above matter and to your letter dated q3th November 2006.

 

Although our client maintains its position as stated in our letter of 8th November 2006, and is confident that it will be successful at a final hearing, its legal fees will certainly outweigh the value of the claim, and, as such, our client must take a commercial approach to such claims.

 

Accordingly, without any admission of liability, our client is prepared to settle this matter in full to prevent incurring any further legal fees. We enclose a cheque in the sum of £4,282.36. As previously stated, acceptance by you of this goodwill payment will be in full and final settlement of your claim against our client and strictly on the basis that you write to the County Court withdrawing your claim.

 

We would ask that you now write to the Court and discontinue proceedings in this matter. We have attached two copies of the Notice of Discontinuance, and we should be grateful if you would complete the copies, forwarding one to the Court and the duplicate to us.

 

We await receipt of the completed Notice of Discontinuance.

my letter of offer said that if I accepted the banks first offer I was not to tell ANYONE about it, especially not you lot! Must have been the The Consumer Action Group sticker they did not like! The offer was a joke anyway. I'm a bit miffed as Deller1 got offered more and can still talk to you! - Did Deller1 not use the stickers?

Really well done Deller. And it'll be cleared in time for Christmas too!

 

When they sent me a cheque they said it was on condition I told no-one about it or the background to my claim. When I sent the cheque back (because they hadn't undertaken to remove my default) I said I was a member of CAG and had already discussed aspects on the forum.

 

Mind you, I haven't heard from them since, except to see they've updated the default with the CRAs. :(

And yes you should claim for the AQ fee but I would let this cheque clear first and write to them in the new year. 100 quid is 100 quid!

Congrats matey, It just goes to show no matter what they throw at us we wont back down, and then they pay..... well im only about 2 weeks behind you, however as u read from my thread the tatics are getting a little stronger, they closed my account ths morning, i got paid and they called me to come and get it so they could just mt account... I sent them a complaint along with the oft and to cobbetts and cc'd the courts about all the intimadation. so now unless every single term is met they will have to go to court, maybe i could get full disclosure lol..

 

anyway fella have an excellent xmas. and have a drink for me
