      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Bong, my partner and I are just about to submit the pre 14 LBA letter and the Nationwide have sent us DPA info dating back to Feb 2000 which is clearly more than 6 years.

 

At first I thought this was a ploy to snare us into claiming beyond the statute of limitations and therefore enable Nationwide to ask for the claim to be thrown out (if indeed it reaches court).

 

From your experience, do you think it is ok to go for over 6 years if we have this info and it has been supplied as part of the DPA request?

 

Trimming our claim down to 6 years will not materially affect the amount by much so if you think claiming for the full period is a bit risky then we can always drop the extra months so that we come back to within 6 years.

 

What course would you advise.

Nothing really to update AQ's are in and been with the judge for what seems ages!!! still waiting to hear - have spoken to Cobbets and they do intend to defend so really do expect to go to court on this one unless the Judge decides differently

Was the contact with cobblers over the phone ? They will always tell you that

they will defend all these actions . Thats what the banks are paying them to do.

Don`t be to despondant . Nat- west take everyone up to the wire. Also i am sure the

courts are all getting bogged down with all these bank -charge cases. Just try and be patient . Good luck and following this thread with great interest .

Nothing other than we are in court 14th may - did recieve a letter saying they were applying to have it struck out but courts never got anything so as far as the court and I are concerned 14th May is the date.

Good to here you are still hanging in there. With my own case for which half is older than 6 years. I have been waiting 8 weeks since the court received my AQ.I think we have to play the long game. Letter to strike out your claim. What was this all about ?

OMG

 

Court hearing today - arrived at court to be presented with a letter from the court clerk to say they have settled in full.

 

Spoke to solicitors who confirm cheque was sent on Friday and will now be sending a further cheque for the daily interest and AQ fee - all that bloody work on photocopying lol

 

SO 6+ YEARS DOES WORK:D

I'm thinking of taking on NatWest for an old business debt of my oh's. All charges would be between 1988 - 95. You've given me the inspiration to get started.

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

Mine is going to be a biggy - only found statements from No. 256-589 and they total approx. £12,000 with interest, so if successful on this one statements 0-256 will follow closely behind!! (If I can find them in the loft) (sure I will!!)

I've just found some old statements totalling a few hundred, dating back to '95, and am considering going for compound interest aswell. What do you think ? So far NW have coughed up for my current a/c, business a/c, cc's, & even a settlement on mortgage redemption fee, so about time they paid some of the old stuff aswell. How did you start ? Was it a standard initial & then LBA approach or did you mention the statute of limitations when you wrote ?

Part of my claim was pre-limetations. They were quite adamantly against me. Do you have any old letters where you hve complained against any charges.I did and that seemed to make them stutter. I did everything the normal way no changes to letters or anything - didnt mention the limitations act until got to court stage and obviously used them in my POC's but thats it really - as you can see it went to the wire with us even appearing in court (but not them lol) so all I can tell you to do is the same as you have done on your other claims - I didnt claim compound just the normal 8% as when I stated it was uncharted territory but happy with the result and to be honest they were statements I had totally forgot about so was a big bonus in my eyes.
