I get less breaks than my colleagues

I work 10 hour shifts for a major employer. Currently I get 2x 30 minute breaks and 1 x15 breaks. I know that this is statutorily compliant. However, colleagues of mine in the same team, working the exact same hours, on the same shift pattern get 2x 15 minute breaks and 1x 1hr break, or 2x15 minutes or 2x 30 mi uses. In other words, I get 15 minutes less than colleagues doing the same job, on the same contractual terms.

 

Where do I stand on this? Can I insist that I get the same breaks?

 

On an additional matter, my contract of employment states that I am employed to work 36 hours per week; the hours are calculated weekly, not on an average over the month, and I am paid weekly. The days I work change week to week, but my shift pattern is four days at work, three days off. However, a couple of times now the shift pattern has worked out with me working 45 hours one week, and 27 the week after. The 45 hour week is exhausting and the 27 hour week causes me problems for my budgeting. Can I insist that my employer honors my 36 hours?

 

Any advice would be very appreciated.

Have you asked anyone why you colleagues get more breaks than you? and have you asked if you hours can be more uniform? Unless you have asked the questions and got unsatisfactory answers from your employer i am not sure what advice would be best for you.

I haven't had any response yet on the hours.

 

As for the breaks, I'm told that I must have a break every 2 3/4 hours for my type of work. Because they've split my lunch break into 2 30 minute breaks, this apparently suffices. Which is b/s since, I never asked them to do that with my lunch break, and there are colleagues who have their lunch break split into 2 30 minute breaks, and still get the additional 15 minutes. In other words, no satisfactory explanation has been forthcoming as to why I'm getting less, except that, and I quote: "Yes it looks unfair, but that's the way it is. We can't change it."
