Parking on a single yellow but no sign whatsoever on the street

Writing on behalf of my family member. - I apologize for future inconvenience if this is so a simple question.

 

Location: Lutton Place, Edinburgh

Date of Issue: 11th October 2012

 

Bit of a background: On 10th October, We had difficulty finding a space to park on South clerk street after an evening night out. Round about 10pm. We had a user permit but there was no space whatsoever, this led us to go onto Lutton place to find a space and parked there and left. Obviously now we noticed it was a single yellow line! The exact same spot where the white bmw is parked. [picture]

 

On the 11th October, our car got towed away by the Edinburgh council. The reason was parking on a single yellow line.

The problem is. At lutton place at Edinburgh there was no sign whatsoever mentioning what time can you park - what are the restricted hours.

However there are pay and display signs dotted around and also resident permit holders only for the parking bays. As you can see in the picture. There are 2 cars currently parked at the single yellow line with both disabled badges. I do know they have the right to park there for a period of time. The red and White car.

My argument stands that is there any reason that we could appeal against this charge. The main reason being that it doesn't mention when are the restricted hours?

The total amount we had to pay was £180 including the removal release fee etc.

 

the quote from an letter from the council: "The car was parked for 6hours and 42minutes and therefore it was considered to be parked as opposed to being utilized for loading/unloading. This meant that the vehicle may have caused an inconvenience to other motorists wishing to carry out loading operations at this particular location "

 

I apologize for the bad pictures. If you do see a sign far away, it is a pay and display or a residents permit sign. I have checked each and every one of them. If there are definite grounds of appeal. I will go back and take proper photographs.

Are you saying the car was towed between 4am and 5am on the 11th ?

 

 

I understand the restricted times are from 8.30 am to 6.30 pm, Monday to Saturday in the

central zones, and from 8.30 am to 5.30 pm Monday

to Friday in the peripheral and extended zones.

central zones, and from 8.30 am to 5.30 pm Monday

Technically, it would work out between 4am-5am but I will get an official response tomorrow if that's okay.

My sister will be returning back to the flat in Edinburgh to check the other documents such as the parking ticket to confirm these times.

Hello all,

Sorry for the delay.

The parking ticket states the time was "08:42:42 to 08:48:02 on 11/10/12

it states " 01 parked in a restricted street during prescribed hours"

The ticket itself is £30

Removal fee : £150

paid on 12/10/12 12:53

 

Any opinions?

Unless you can prove there is no sigh displaying the restrictions, wouldn't think there's much you can do.

There are definitely no signs showing the restricted hours. I'm pretty confident on that. The problem is. We had written an appeal regarding the signs but attached no photos. It did get rejected. Shall I scan the letter and send it to you via PM?

Hi craig, to be honest I'm not too clued up about Parking Restrictions ect, I'll be out and about this weekend and I'll try have a scetch at Lutton Place, I've been done stacks of times in Edinburgh over the years, also appealed against a few Tickets and got a result.

 

Hopefully some of the Parking bods will have some input in this thread.

Can see any yellow time signs on google maps. You really need photos of where you were parked covering thw whole stretch of the line and the buildings behind with no time signs. The Warden should have photos of any timeplate sign relating to the line you was parked on. If they dont have one you have a good reason to appeal.

Single Yellow is a restriction determined by an accompanying sign or it could be a CPZ (Controlled Parking Zone). If thats the case all entrances to the zone require sign showing the restrictioed times.

Hi, I just went on google maps and it does have sign at the start of lutton place (either end) saying: controlled zone and no loading etc.

Sorry, my error. Should have started "Can't"

 

There may also be signs a number of streets away surrounding the zone.

 

Just been looking again on google and the zone is signed as far down as Salsbury Street

Is there a plate anywhere on the section of yellow line that may apply- ie round the corner? the line must be uninterrupted otherwise it isnt the same controlled part. If not then your penalty has been unlawfully issued and you should write to the parking section of the council pointing this out and demand you money back. If they do not pay up then use the parking appeals service. If there is uninterrupted single yellow line from a plate round the corner then the times specified on that plate are the restricted times. Any parking spots, sections of double yellow etc mean that the line is not continuous and the restrictions dont apply.

sorry, missed the wording about the CPZ plates at BOTH ends of the road. My advice is therefore incorrect
