Hi there first post on this forum so please bear with me.

 

I have been battling with Jacobs Bailiffs for a couple of months in reference of unpaid council tax from 2 years ago.

 

After finding out about the debt I did bury my head in the sand for a while but realize this needs to be dealt with and quick. I tried to ring Bolton Council where the debt originated from and was told in no uncertain terms nothing they could do as the debt was with Jacobs Bailiffs now and not themselves.

 

So I rang Jacobs on several occasion at the main office number continually told to ring the Bailiff in charge as they had no details of my account on their system only the Bailiff dealing with my case had this.

 

I was told that I was unable to set up a payment plan as they needed to full balance to settle to debt. The debt ids a little under £300. I really don't have that at all and have no means of getting it, I've even tried pay day loans etc but keep getting knocked back.

 

I was finally given to Friday 16th November to pay £50 with balance due December 6th. I was unable to pay them so no doubt will have a visit Monday morning.

 

I don't work but my wife does part-time. I have 2 small kids aged 8 & 10. I'm losing sleep every night over this. Just don't know where to turn too.

 

They said at the time of the arrangement if I didn't agree they would come and remove goods with a police escort. So I agreed to it to buy some more time but truth be told I knew at the time I wouldn't be able to pay

 

Please help!!!!!!!!!!!!!!!!

Hi, the guys will be along soon to help you but I can repeat what they tell others....they cant just come and remove your goods, cant get the police to help them, cant kidnap your pets! They have to gain access to your home to levy on your goods so dont let them in, keep your doors locked and windows shut, if you own a car make sure its either in the garage(locked of course) or parked well away from your home, if you have anything of value outside your home put it away in the garage. And dont worry these guys will give you good advise and help.

do not let bailiff into your property he has no right of entry and cannot break in call the police and kidnap the cat and dog

 

Bailiffs lie don't believe what they say

,you do not need to deal with the bailiff

you do not need to open the door to them

 

Please don't take out a payday loan there is thousands of people who are in the same boat and that will make matters worse

 

Start making payments DIRECT to council online or automated telephone service they cannot refuse payment if they do take there name and make a formal complaint

 

Pay the money in every week little and often if needed that way a payment history will stack up quickly

 

Deny bailiffs a levy and there is nothing they can do if you have a car you will have to hide it away for now

 

Lastly don't panic you are in the right place:-)

Has the bailiff had entry to your property? if so what goods on levy list them please

No the bailiff has made no levy

 

OK that's good keep it that way

there will be no police escort and no breaking in to your property and taking goods however any items of value in garden may be at risk car shed contents ect

 

given time bailiffs hand the case back to the council for further enforcement if they are unable to come to arrangements to fleece people with there made up fees

 

with no levy the maximum bailiff fees will be £42.50 which can be paid direct to the council

 

Payments direct to council

 

don't phone bailiff unless you can record the call

 

Bailiffs lie and have no special powers

So was meant to pay £50 on the 15th Nov with the balance of £238.69 to be paid on the 1st December.

 

Received a letter today 29/11/2012 dated 26/11/2012 that I have four days to pay the full amount of £288.69.

 

If I cant pay £50 how do they think I will pay near on £300.

 

The letter basically says I broke the agreement but they knew when it was set up this would of happened.

 

"If full payment is not received within four days, a bailiff will attend at your property for the purpose of collecting full payment or removing goods for sale at public action, which will incur additional costs"

 

Few queries here:

 

1. Can they do this as no Levy has been made on any goods???

 

2. No bailiff name is attached just told to ring the main office number to make payment.

 

3. As this is a Council Tax bill can I claim any special circumstances as I don't work and get a small amount of DLA, my wife only works part-time and we have 2 children of primary school age???

 

4. Tried to speak to the council to deal with them direct as im no longer in the borough which the bill originated from and they claimed could only go through the bailiff. Is this true??

Any payments direct to the council they can NOT refuse payment formal complaint to council get the name of the person that you spoke to

 

Have you spoken to the bailiffs in the past to make arrangements to pay what i expect has happened is they do in fact have a levy on a car

 

probably not your car of neighbors just a car that was parked in the street(bailiffs a bit:der:

 

Standard trick with bailiffs make out that you have broken arrangements then charge you a van fee

Mr bailiff has no power of entry can not force entry

deny bailiffs a levy and little they can do

 

tuck car away for now/park it a good walk away from house or garage it

They can have a levy on as many cars as they like as I dont have a car :-D

ok keep them out do not let them in deny them a levy and there is little they can do

 

you need to contact the council and find out the correct balance of what is owing will be different to bailiffs figure

 

no law states you have to deal with bailiffs

 

Paying council is best way forwards online using correct reference numbers

 

payments made every week will stack up a payment history and will look good showing you are willing to pay and not refusing

To be honest I did bury my head in the sand but am ow finally trying to resolve this with weekly payments albeit only started with one. I have sent of to the council for information on the Liability Order they have and dates and figures, I have also emailed Jacobs for a breakdown of fees, when attended etc etc.

you are doing good

If and when the bailiff returns you can ignore the door if need be

don't believe a word the bailiff will come out with have you arrested i have a warrant

 

wit no levy he can do not a lot

Bailiff fees with no levy will be £24.50 and £18.00 first and second visit fees

 

That can be paid to the council as well not that i ever have, nothing has come of it...........yet!!!

jacobs are so fond of levying and clamping cars that they are wide open to Formal Complaints to council, citing the LGO report and castigating of Blaby Council and Rossendales for levying third party goods

Standard scare letter a van can come you dont have to answer the door they will be wasting there time no levy no power of entry

they on to a looser

Wouldn't worry too much about upsetting them. They are pretty thick skinned and they dont' want to be your friend anyway.

They onlt want the money, and will lie and cheat in order to get what is due plus whatever extras they can make up to add on as well. Kee4p them out and hide any cars, start to pay an amount you can afford direct to council, but allow £42.50 extra on the total for the two legit visit fees. Keep them out and deny them a levy, and that is all they can charge, no matter how many times they call

With regards to paying debt direct to the council, It works!

 

I have a CT arrears but pay every month present CT plus extra to cover arrears, vis a pay point card.

 

The council know Im doing this and are happy with the arragement. I

 

told them I would not deal with the ballifs as I think they are nasty little people who want to scare people.

I also pointed out to them that having taken legal advice (from CAG) I know I dont have to speak to the balif.

 

Although the council say they cannot take the debt back from the ballif.

He does knock on the door periodically and I tell him thanks for the visit but he is wasting his time.

I will not pay for his costs to come to my door and I am paying direct to the council,

 

Ive even shown him receipt, he then pretends to phone council as I keep pointing out his figures are wrong as the debt has gone down.

 

My point is that theses guys at CAG know their stuff,

if you listen to them and take their advice you will find a much happier way of dealing with your debts and peice of mind.

 

I actually enjoy the baliffs visits now as he knows Im laughing at him.

 

come to think of it ive not seen him for a while!

I do not want to appear to be critical but have you WRITTEN to Jacobs or have all dealings been by way of telephone calls?

 

Also, unlike most other people on here, you are VERY FORTUNATE. As you do not have a car, the fees that can be charged are CAPPED at just £42.50.

 

The ONLY way in which the fees can be increased is if you make the HUGE MISTAKE of ever allowing a bailiff entry into your property. DO NOT DO THIS UNDER ANY CIRCUMSTANCES !!

 

Almost always.... the people that have the most problems with bailiffs are those who make payments arrangements by contacting a bailiff ON HIS DAMNED MOBILE PHONE.

 

It is always the case that a Letter should be sent !!!

Hi thanks for the advice. I emailed jacobs last week ask about the bailiff, where certified etc etc. Received a letter today with all details they have only added the 2 visit fees only.

 

However something has seemed to come to light. They have listed a certain someone as the visiting bailiff and the bailiff was dealing with my case. Now doing some checks on the certified bailiffs register at Justice.gov website HE IS NOT LSITED AT ALL LET ALONE WITH JACOBS BAILIFFS

 

Where do I go from here???

 

The claim is he was certified at Liverpool county court and certificate runs out Oct 26 2013
