sorry to bug again.. but i sent my letters to camden house west in Birmingham - but the letter returned is some PO box address in Coventry

 

Best to keep sending to same address? or go with the PO box?

thanks ims - i sent both previous letters there too - :)

 

the postal order was printed with HFC bank on it so i cant see anyone else being able to cash it in?

i am on the ICO site - would it be better to complain via mail? or doesnt it really matter?

 

Id have to photocopy the letters anyway as i dont have a scanner lol

Incidentally, another thing you can do is tell them that you are now tired of their delaying tactics and continued failure to frustrate the provisions of the DPA will result in legal action to force compliance together with damages at the court's discretion.

 

what does the red sentence mean? Im not following

 

any other way of wording this?

Ooops sorry

 

It is meant to read "continued efforts to frustrate the provisions of the DPA"

 

What I mean is that it appears they are making every effort to get out of their obligations under the Data Protection Act and you can force compliance through the courts if necessary

also they say they will only do upto 6 years? would this be correct or does SAR cover ALL time elapsed with the company?

It covers all data they hold on you but HFC are on of the mob who may well have destroyed data over six years old.

 

Having said that, I may have been lucky in that O got everything back to 1988/89 when I did a SAR last year.

 

I suspect the PPI Judicial Review has something to do with banks dumping stuff though.

 

The other side of the coin is that we do know that some banks do have old data despite their protestations that they don't and this is evidenced by some threads on here where, when pushed or threatened with court, the miraculously come up with older data.

 

It can be a game of cat and mouse sometimes.

its 39 days now from the day they would have received my SAR.

 

I have had ANOTHER letter today from them

 

we refer to your "recent" request - it is being handled within my dept and will receive a full response within the NEXT FORTY DAYS.

 

they have ONE DAY not another 40!!!

 

What now? this is getting on my XiXx

When did they receive it? I assume you sent it recorded and tracked it.

 

If their 40 days are up from the date when you know they got it then lodge a complaint with the ICO and write to the lender and demand that they provide the data within 7 days.

i already contacted ICO when they wrote back denying payment. In fact ICO requested ALL correspondence back and forth - so they know everything and i printed out the sig from royal mail site etc.

 

They have had the SAME sar letter and postal order twice.

 

tracked both letters

 

was delivered from our BIRMINGHAM Delivery Office on 30/07/12 .
