      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

Well I am also trying to crack the Egg and only for about £270.00, however things have now turned rather nasty...

 

Up until my LBA I hadn't heard a peep from Eggy and then on the final day of the deadline a letter drops through the door from the yolky ones. Now, with all this OFT £12.00 stuff Egg are getting crafty and trying to palm me off with reduced payments and the difference between this charge and that charge blah blah blah etc etc, as are some of the other CC people.

 

But this is where it gets real stinky.

 

My Egg account is closed and fully paid off and guess where they want to send their oh so generous 'final offer' of £44.00 to? Yep, a closed account! Can you believe it? You can imagine that I was not best pleased!

 

After wading through all their bullet-pointed excuses as to why they wouldn't be paying me my £270.00 I simply wrote back saying ok, see you in court. Filled my MCOL immedietaly after reading their letter and now we wait, they have until Oct 24th to reply to my claim. Of all the banks and CC people I have gone after so far, Egg are by far the worst: Rude, arrogant and sailing close to the edge of all reason and fairness. They are gonna come a cropper... and soon.

Well I gave Egg an extra 7 days after the expiry of the original deadline of the DPA SAR to show up with my statements. Well, they didn't deliver so now I am the 'Particulars Of Claim' stage and am more then happy to take these arrogant, arrogant people to court for a second time... (I managed to get the info I needed for charges from the Egg site but wanted statements for completness).

 

My blood still boils when I think of the cheek they had in refunding a measly £44 in charges (total amount should be £270.00) to my closed account.... I simply can't figure out how they thought they'd ever get away with it. Which they won't. I am simply not gonna let this bunch think they can ride roughshod over me (or you for that matter). They have to be stopped and brought down to earth with a really big bump. Egg, you will crack...

Well, the Egg saga rumbles on... Just delivered my AQ to the court today so now we must wait for a hearing date... It better not clash with my tonsilectomy!

 

Also, Egg never did supply my full SAR details... I had to call them and hassle them for my statements which they then sent out. But, when my wife's Egg SAR came back it weighed a ton and must have cost about a dozen trees as there was so much paper. Me, I just got statements... So I have filed out an N1 to request disclosure and took it to the court who said it's the wrong form. They gave me a green claim form called 'CPR part 8' and said it'll cost £150 to file... Anyone else had this?

One of the Moderators should be able to help but I thought CPR Part 8 Proceedings were for action where litigation is not already issued? Can anyone help with thoughts about what will happen to cc & loan balances if EGG go under as we all suspect they might?

Well, Egg have appointed new solictors to sort this mess out and guess what? They are offereing full settlement! Fingers crossed I'll have payment in the next few weeks! Will keep you posted!
