      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This is roughly what I expected to receive

 

ppi payments paid £3967

8% interest £1677

Total £5644

Minus ppi claim payments made £2851

Total £2793

Minus outstanding balance on loan £1900

Amount of cash left over to me £893

 

you dont owe £1926.06

 

£1522.23 is the [yet to be paid PPI+INT on the PPI]

 

so you only owe £403.53

I need to get my head round this :???:.

 

So, what I thought was the balance of the loan (£1926.06) is actually mainly ppi and I have still been paying for this even though I was told the ppi had been cancelled

( which I thought was because of the reduced payments).

 

No wonder you said they make it difficult for the likes of me to understand.

just because the PPI was 'cancelled'

 

doesn't mean yoouu are not still paying for it

 

i bet by cancelled, they mean that YOU were no longerallowed to claim on it

 

it certainly has not been removed from the loan total nor the PCM figure you pay...theres the clue

 

if there was no longer any PPI, you PCM would have gone down!

I claimed on it June 2009 -June 2010 ( which I have not included on the spreadsheet), so when a couple of months ago I was told it had been cancelled, like I said before, I presumed it was because of the reduced payments.

It does actually say 'refund to customer after account settled £2447.61'. I wish they would hurry up and pay it so that I know, because in my head I don't know how much to spend :).

So you think its worth me sending an SAR to them as there's possibly more to come from a previous loan?

:whoo:Oh happy days, but I won't celebrate until its in the bank account. Then I will send off the SAR. I also noticed they hadn't actually put the two figures in the boxes on the sheet.

Thank you for your help with this, as I got it completely wrong :oops:.

Any news on this Shazza50? I put in a claim 10 days ago and am yet to receive a response.

Here's me hoping they'd come back to me as quickly as Shazza50 (nearly 6 weeks from complaint to settlement figure).

 

If I got there at least then great.

 

My case is:

 

Was gainfully employed when taking out the 6K loan.With sick pay and redundancy pay off guaranteed depending on time served.

PPI and interest bumped it up to 9k (beggers). PPI was compulsory I was told, for the completion of the application.

Was made redundant 6 months later but I had a job to go to so left with a hefty cheque of 6 months salary and started new job 2 weeks later.No lapse in payments in that time

Paid a chunk of loan off and other debts and brought the balance to a manageable repayment amount with redundancy pay off.

2 years later I was made redundant again but no cheque this time to see me through and pay off my debts.

Couldnt pay and tried to claim on PPI and they said eh.....NO

Went into DMP and paid off debt over the next 4 years but.. Wrote to them asking them to cancel the PPI.. No response

Anyhoo, DMP paid off the debt (and what was left of it at the time was PPI and interest only by my guess) in 2008 and HFC sent me a letter to acknowledge satisfaction of the debt (took a few hundred off when I was near the finish line)

 

Case or not?

Print our of payments to account from last SAR (2006) with account number. No agreement but contracts of employment etc

Any news on this Shazza50? I put in a claim 10 days ago and am yet to receive a response.

 

No money in my account as yet, but it was only last Tues when I sent the acceptance letter to them. Once that is in the bank I will send an SAR to see what else they have, but not holding my breath as it was before 2005. I had it pretty easy as I had a copy of the agreement and a statement of payments from 2005 - 2011. Good luck with yours.

Still waiting :roll:, but HFC have tried contacting me today. I don't think it will have anything to do with my payment though, more to do with none payment on the account. I figured that as they had done the maths, which included settling the account, that I would cancel the Standing Order for future payments. Maybe I shouldn't have been so hasty, but there again, maybe they should be a bit quicker at giving me my money back :)
