Hi,

 

I have posted before about my problems with payday loans and I still don't feel like I'm getting anywhere! Each one of the payday companies i owe money to, knows that I am on Jobseekers Allowance and only get £56.25 a week. I have even faxed proof of this to a couple of the companies who have asked for it. I keep trying to come up with a repayment plan for each one but they're all coming back with £100, £80 a month which clearly I can't afford!

 

Speedcredit started off at £100, I said I couldnt afford it, they lowered it to £80 which I again said I couldnt afford, they then lowered it to £50 and said thats as far as they will go. How can I possibly afford to pay that when I have other things to pay off and that is a weeks money for me!

My question is can I say anything to them to make them lower it even more? I really can't afford to pay that when I don't work!

If you are on JSA they should accept £1 a month token payment and freeze all interest and charges.

 

These are low priority loans and they are trying it on.

 

If you do have problems with them contact the OFT/Trading Standards and explain you are on JSA and the companies are ignoring the debt collecting guidelines.

Write to all of them with proof of your JSA.

 

Tell them you will pay them x amount (what you can afford) and you want written confirmation they have frozen interest and charges.

 

If they dont do this complain to the FOS, hit them where it hurts, in their profits.

I agree with the above, got to keep at them to show that you cant afford to pay it at this time. if they continue you will have to take things further, chance are they will try and slap a CCJ on you. make sure you you keep copies and take names of every one you deal with.

They cannot 'just slap a CCJ on you', they need to send you the paperwork, and a defence can be written up very easily, you MUST defend as their particulars of claim would be enough to get the case questioned.

 

It would be wrong to state that they would 'easily get' the CCJ, it would only happen if you don't defend, and defending does not cost you much at all, just some time getting the facts together.
