PPI - do I have a case due to not living at insured address?

Hi all!

 

I havent been on here for ages, so I do hope if some of the old crew are still on that all of your issues are sorted or at least going your way :-)

 

Now I am not sure if this is a shot in the dark or I have a claim.

 

In 2008 I called a company I wont name for some advice on getting a policy to pay out if I was too ill to work or got made redundant.

 

The company advised on two seperate policies and these were set up.

 

I was out of work a while back so had reduced them both down, then when back in work for some reason I increased one but not the other.

 

Things are looking iffy at work so thought I best check how I stand and increase the redundancy one.

 

The lady advised me on my options.

 

For some reason, when this was all set up, the financial adviser put the address of the house my mortgage is on,

which was being done up and not habitable,

in fact i have never lived in it,

even though he knew I was living back at home and this should have been my correspondance address.

 

I happened to say to the woman,

I should really change the correspondance address, to which she then said, yes because if you no longer live there you are not covered!

 

I then explained to which she, her colleauge I spoke to next, and supervisor all confirmed.

.. in this case you have never been covered! and even said...this looks like a mis-sold policy!

 

So guys, does this sound correct, and if so what do I do next?

looks like to me the whole insurance policy needs was mis-sold, not just the PPI!

ooops,

have I mis-posted this?!

 

do you still call this ppi?

 

i suppose it is really as although no loan or anything was involved its still an insurance to protect me, confusing myself now, lol

was this an insurance policy for you to live at the 'wrongly addressed' house, that you didn't live at?

 

so you had an insurance policy for you to do something but never did it?

if so the whole policy is mis-sold not just the PPI element because of the 'wrong' address?

 

sri i might be getting the wrong end of the stick.

 

or was it a sep PPI policy taken out to pay out on an existing insurance incase of 'illness etc'

Sorry probably me, this was an insurance policy, so if I was too ill to work it paid my mortgage.

 

The company said today, you have to be living at the address you have the mortgage and policy on, the bloke who sold it to me knew i wasnt living in it as was undergoing major renovation, but i recall him saying there was a reason the paperwork should be sent there, probably to make it happen and get his sale?

 

Any more information needed please ask :)

I worked out I have paid them £836, if I won would you just get amount back?

scan it up

 

 

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

'

BUT......

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all figures and dates. {DO NOT USE A BIRO OR PEN]

convert existing PC files to PDF [office has an installable print to PDF option]

..

goto one of the many free online pdf converter websites [http://docupub.com/pdfconvert/]

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

i'e Default notice dd-mm-yyyy

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

Hi guys!

 

Ok I have found the following so please let me know which I need to scan :-

 

Statement of fact

Certificate of cover

Couple of general letters saying how much

 

Then one bit that has concerned me, it is unsigned but it says yes to questions :-

 

Are you named on the mortgage agreement for the residentail property which is your main home - Yes

 

Are you paying or about to pay a mortgage agrment for a residential property which is permantly occupied by you and your immediate family as your home - Yes

 

It then has a D/D agreement at the back which is all blank, I shall go and look but I seem to recall seeing another request for D/D details as it didnt collect the first one a month later, so hopefully that just was a payment agreement I signed :/

 

I am sure he said someone about why it should be at that address, I just hope I havent signed away anything to stop me being able to claim due to me not reading it properly!

i would simply write a letter stating:

 

following our telephone conversation today.

 

it has become apparent that your salesman mis-sold me this : [xyz] insurance policy

 

"The company said today, you have to be living at the address you have the mortgagelink3.gif and policy on,"

 

i wish now to reclaim the whole policy payments

plus 8% interest under section 69 .

on each payment from its date till settlement

 

..................

I was sold this by a broker, or financial adviser company, so far I havent spoken to them.

 

But yesterday it was the actual company I have the policy with.

 

So its the person who advised me then I need to write to?

 

Keep it short and simple then yes?

i'd save money and send it 2nd class with proof of postage from the PO counter

Thanks dx, the irony, I have today been told I am probably being made redundant :evil:

 

So am I best saying :-

 

I have never lived in the house and the salesman was aware

 

or

 

I have never lived in the house and the salesman was aware but said it needed to be at that address for some reason

great thank you, by the way that spreadsheet says single premium policies?

 

I shall try and do now and get posted then let you know the outcomes, pretty annoying when you think I could have actually claimed on it now!

 

Probably no point in mentioning I am being made redundant?

correct if they didn't charge you interest

then all you can do is claim s69 court 8%

 

on EACH payment from it date

to the date of your claim

I called the company who suppy the policy tonight and cancelled the policy, when I explained why they actually said if I wrote to them there is a chance they could refund me some of the money.

 

This seemed nice of them, bearing in mind the words...chance...and...some, lol

 

I guess I am better as planned to write my case and spreadsheet to the advisory company who set the policy up?

 

Not sure how good my interest and number of days elapsed is adding up though :/

Final draft of letter before I send it off, sound ok?

 

Dear sir/madam,

Following on from a conversationwith xxx it has become apparent that your salesman mis-sold mexxx mortgage protection policy.

The company said you have to be livingat the address you have the mortgage and policy on for it to be valid. I have never livedat this address, the salesman knew this at the time I took it out but followinghis recommendations I was advised to use that address anyway...or remove the anyway word?

I wish now to reclaim the wholepolicy payments plus 8% interest under section 69 of the County Courts Act 1984on each payment from its date till settlement.

Enclosed are details of thesepayments.
