      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My claim is against RBS from 1995 to 1998, the hearing date is Dec 1st, time allocated 2 hours, standard defence recieved, both sides have sent AQs off, the banks solicitors(cobbetts) stated they were applying to strike out the claim, i don't know if the application was made or the judge has turned it down, has i've heard nothing from court, keep an eye on my thread for updates.

Just got here since you gave me the link, Livelylad. Yes, this is really good stuff, and has a lot of info for me to take out. I'm just doing 6 years back for now, but hope to go for the older stuff later. The longer I leave it, the more it will be worth !!

 

I'll be watching closely, and if I can chip in with any help, I will.

Do you think it will keep you out of fast-track ?

 

This is a tough one, if i do then cost are more than likely not going to be awarded if i lose. However if it goes fast track they will have to disclose a breakdown of their charges. This is a potential winning point i think.

Actually, as reluctant as I am to say so, I think he's got a point - like we said right from the get-go of this campaign, no matter what we think of the bank employees dealing with our requests, they're only following their respective company's policy/policies. They shouldn't be the target of foul/abusive/derogatory comments for simply doing their job. Let's face it, one way or the other, the case is going to be finalised isn't it?

 

This goes to prove that they are all watching this site.

 

This is true - so when they're faced with the insurmountable evidence that we have, why on earth do they waste everyone's time (including the courts' time!) trying to fob us off? :rolleyes::rolleyes:

I agree the comments should be muted sometimes but then again their actions are very annoying.

 

They will come unstuck when the OFT publishes its report next year! They should just settle all the claims now!!!:D

You have had 11 months of us, we have had years of indenture. ;-)

You know BL, he probably does, as do the rest of the Banking Industry - hell, I'll be as guilty of talking about my customers around the coffee machine in my previous roles :D Let me be clear here, I'm not defending the banks & their ilk - but the big difference is that we don't get to see or hear what they say about us around the water coolers in their gilded palaces, whereas everything we write on this website can be seen by anyone (even if they have to go to the trouble of registering).

As you say, Michael, Tommy DID have to register. You don't sign up to "Hardcore Monthly" expecting to read about broken bricks (well, I didn't anyway). And if you do, then whose fault is it anyway ?

 

Cancel the subscription, Tommy, if you don't like what you read. Otherwise, try behaving like an adult, and suggest your employers do likewise.

 

Yes, this is a public forum, so we must behave reasonably. Considering the flavour and theme of the CAG rally next month, I don't think having a bit of a public laugh in order to make the banks feel just a little bit uncomfortable is a breach of anybody's rights. Doing so here is much less public. I think if Tommy doesn't like it here, then he should write himself a Sod-Off letter. Consider this mine, anyway, to you Tommy. Oh, and here's my gesture of goodwill. too ! :p
