    • So technically you could push it via the courts with the clause in the AST (I remember seeing something about this recently)  However if one has left the country - It might make it hard to recover it all from the others.    How would you look to bring action against all parties involved? Do you know where all of them currently are?  You can service to last known address but as you know they have moved on - It could be held against you by a judge if it goes all the way.    I think you need to consult a solicitor on this one - Its a complex claim against multiple people rather than a simple Creditor vs Debtor claim we see here. 
    • Initially, the property was let to four foreign students, but they are no longer on student visas. During midterm, two of them moved out, and two new friends of theirs moved in, one of whom is the lead tenant's British girlfriend. The lead tenant got married to a her and became a dependent who is now one of the tenants in the AST agreement. The third tenant found a work permit visa, and the fourth left the country a few months ago.     • I'm sorry Mystic I did miss it. My wife went into hospital around that time so while I read your WS I missed the Excel case and never had the time to respond to your WS. Fortunately Dave has done pretty much what I would have done though I would have added the point I made on post 117 . It's partly to embarrass UKPC in the hope that they withdraw the case and if they don't perhaps the Judge might query their truthful declaration. And I would still use the fact that being broken down is not parking as well as creating a frustration of contract. The Judge in Jopson v Homeguard spells out quite clearly what parking is and is not. He didn't use car breakdown as one of his examples but had he done so it would have been appropriate. It's just another argument to disincline UKPC from continuing. I know it's a bit of a hassle to alter your WS again but if it changes UKPC from pursuing you , it would be worthwhile.
    • You need to title your exhibits - EXHIBIT 1, EXHIBIT 2, etc. - and add them to the end of the WS. You can use the attached as EXHIBIT 3, you just need the one page, not the whole CoP.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've had six accounts with HSBC since first banking with them nearly 20 years ago now.

 

What I would like to know is do I have to send off 6 SAR's thus costing me £60, or can I just send off one with all the account numbers in it? I've read the SAR and it does say to hand over ALL information on me. Well all info would be all accounts...Yes...No?

NO one SAR covers all accounts state you require ALL data relating to ALL accounts held with HSBC at any time, give as much detail as possibe all previous addresses if any.

Based on my experience, I would advise the following.

1. Sign the request.

2. Be prepared to chase it.

3. Don't expect them to comply within the 40 days for so many accounts. Mine took 104...

4. Don't expect anything older than 6 years. I am assuming they think that statute of limitations applies to data.

5. Expect a letter from their insurance division requesting a separate SAR for insurance docs (they claim this is required because it is a separate legal entity).

The main account I used I have all statements dating back to 1999. These statements don't make a huge amount of sense when trying to work out when and where loans came in and out. I've already I had one PPI claim sucess on this account dating back to 2002. Trouble being after one year I increased it thus changing the original contrct with the loan. I did this serveral times over the years (increased the loan) so I now have to chase each individual increment.

Sent off the SAR for 6 accounts. got a reply within two days returning my cheque and telling me it is now a free service and all the requested paperwork will be along shortly .....Happy days!!!

I would be very wary of any free SAR.

The problem is that you are then at the mercy of what they choose to send.

I had this recently with Barclaycard.

They returned the PO.

But it was sent back to them after the SAR arrived and was found to be missing most of what was originally asked for.

They later complied in full.

This will need to be carefully watched inexperienced users could be led in to a false sense of security by the offer of a fee free SAR.

Ok I will keep you all updated.

 

Biggest problem being, I wouldn't know if they had held anything back???

 

I have statements showing PPI payments going out but not all of them. It shows money going in and out but not in any detail or where from and too. If that makes sense. I want all the paperwork so as I can work it all out.

My advice would be to write to their data controller, return the £10 stat fee and demand that they fully answer your request immediately and you are reporting their conduct to the ICO.

Unfortunately a Data Controller can insist on specific info as I learned in 2006 with a Citi SAR.

They deemed it to be an open ended non specific application.

They also supported it by including the relevant sections from the DPA.

More and more creditors are routinely demanding more specific requirements and stricter ID for SARs, not sure what hasprompted this action.

I've now recieved a letter from HSBC. All it has in it is a list of bank charges. Which I claimed back years ago. No statements or loan agreements!!!

 

So you were all correct in your assumptions about being wary. I'm guessing I will have to write another letter requesting full disclosure??

 

Now I'm really not very good at writing offical letters. Could someone help me out here with a template or something?

The creditor is not obliged to supply agreements with a SAR, they are covered by sections 77/78 of CCA 1974.

 

There is a non compliance letter in the CAG library.

Update:

I've rung HSBC's complaints department. I was told that there was a mistake and that my SAR went through to the wrong department and that as it was their fault they are going to wavering the £10 fee and send me all the info I requested in the first place. Also whilst I was on the phone she asked me why I wanted all this information so I told her about my PPI claims. She said that she could see from the information she had infront of her that I had three more PPI claims????? I wasnt even aware of these. Anyway. She said she could start the claim there and then. So all the other PPI information I was looking for was sitting there in front of her all the time.

This is second time I've had to resort to the compalints dept and both times they have told me to go directly to them as the claims dept is snowed under. Also both times they have bent over backwards to help me.
