My husband took out a loan with lbl nine regions ltd (now hermes) for £1000 nearly 18 months ago, to date we have paid back £2299.04 of the £2922.66 total to pay inc interest.

He lost his job a couple of months ago and although we have tried to keep up with the weekly repayments it just hasnt been possible and have missed quite a few payments over the last few weeks, they have refused lower payments and have now demanded we pay them £623.62 and have threatened to come take the car if we dont. So i turned to the internet for advice which led me to finding you guys as we really dont want to lose the car.


In response to their demand i wrote to them requesting copies of the credit agreement, bill of sale & statement of account as i cannot find my originals. I then recieved a settlement letter followed a few days later by a copy of the credit agreement and a statement of account but no bill of sale have waited 2 weeks and still no bill of sale but another letter allowing us a further 7 days to settle the account before repossession. which is up on 17/10/12


Are there any template letters i can send hermes again requesting copy of bill of sale or do they not need to supply me with a copy?


I believe that if a creditor fails to comply with my request for a copy of credit agreement they are unable to enforce an agreement until they comply, is this true and does this also apply for bill of sale?


I have also been told by a friend that they cannot reposses the vehicle as i owe less than 1/3 or something like that have you heard of this and does this apply to bill of sale loans also or just standard car finance?

Hermes have now sent me a copy of the bill of sale, but there is no court stamp on it anywhere, im unsure if it has not been registered or if they have sent me an unstamped copy on purpose.


does anyone know how i find out if my bill of sale is registered?

Have spoken to royal courts of justice this morning to find out how I can get a copy of the registered bill of sale, I now have an address of where I send my request but its going to cost £40 as I don't have the ref number. So planning to write to Hermes again asking for copy of the stamped registered bill of sale or at least the ref number so I can obtain a copy from the court myself. If it is indeed registered.

wrote to hermes again and they have now sent me a copy of the stamped bill of sale. its stamped 4 days after signed agreement and looks genuine.


Im unsure what to do next, really do not want to lose the car but cannot keep up the installments they are asking for of £55 a week when we are only on jsa at the minute. The original loan was for £1000, we have paid so far £2299.04 and the most recent statement shows we still owe £1031.62, £408 of that is charges for calls & letters. we are not in a position to offer a lump sum.


Is there anything i can to make this debt unsecured so i can then make small repayments without worry of losing the car?

just been going through the paperwork i have again and have noticed something strange, they sent me a copy of the bill of sale without a high court stamp, i then requested a copy with stamp which they sent, but looking at them both now, my husbands signatures are different on each and the details of the witness vary, on one it says staff on the other it sales staff. My husband doesnt remember signing 2 different bill of sales.

hopefully this works as its the first photo i have uploaded here.

if it works its a picture of 2 bill of sale documents sent to me by hermes/log book loans about a week apart, the one on the left was sent to us without a high court stamp and the one on the right is the one they sent along with the high court stamp.

they sent us an income & expenditure form out of the blue along with a letter stating they would like to help us, we filed it out and sent it back and they have wrote back accepting our reduced offer of £5 a week which we are so happy with and looks like my partner will be back in work in new year so will be top of our list of things to pay off! wont be making this mistake again!!
