    • As i don't have any mitigating circumstances other than trying to save pennies, will they fine me to the maximum? What is the maximum fine they will impose? I honestly don't know how many times i use it.  I will get a criminal record which means i can't find another job? Will they prosecute my partner?   
    • Yes. They won't inform your employer but you may need to. You need to check what it says iin your employment contract. I don't think it usually causes huge problems for most people. HB
    • Good afternoon. I've read a few threads briefly regarding a dmp with stepchange and was 95% complete with setting one up when I noticed the advice of letting things default instead and/or managing a dmp yourself. My current situation is the following £470 owed to Jacamo. Has not defaulted. Currently on a £10 payment plan with them for 12 months. Not sure what to do here £2700 owed to Vanquis - Credit Card. Has not defaulted and I have not missed payments. I am unemployed and even making a £200 payment from my benefit means £80 odd gets eaten thanks to interest. Guessing I let this default and then set up a payment plan after? £2500 owed to Lowell who bought from Very and passed on to Overdales after I ignored them. Last payment to Lowell was 30th November 2022. Plan here was to fight them in small claims court if it ever gets that far, assuming the worst. Any advice is very much appreciated, thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have been using wonga for the past year and never had a problem repaying my loan back but now my partner is loosing his job I can't meet my repayment date and very worried what to do I can't afford for them to take the money out of my account - should I report my card lost and get a new one will this be enough to stop them I bank with Halifax.

 

Do I contact them now or wait until end of month

 

I owe 1325 which I would be paying at end of month - how do I set up a repayment plan I can pay back 100.00 per month

contact them now before they start adding interest.Yes cancel your card say its lost I did .Then I only made payments to them via FPI -FAST PAYMENT OPTION

Send them a income and out come expenditure form .I did mine via NATIONAL DEBT HELPLINE you could even phone the NDH http://www.nationaldebtline.co.uk/england_wales/

who can advise better than me.I got all my info from the other treads on here .

My offer of repayment is £*** per month. I have sent you all required information

I feel i must remind you of your obligations under OFT guidance on debt collection in regards to this debt Please reply within 24 hours.

 

.If you can get a letter from Halifax showing what payments you have already made to them scan that into your email.This shows that until your change of circumstances you paid regularly.

I just called them and told them had lost my card .If your on line banking with Halifax just search your statements and copy paste the payments that you did make .

BUT DO NOT WORRY.If your worried about anything call NATIONAL DEBT HELPLINE .They helped my daughter get out of a major fix that was making her ill.Good Luck

Before you think of contacting them, you MUST secure your money and bank account. PDL's including wonga are well known for automatically taking money the second they get a hint that you might default.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

thanks I will do i cant move my money to any other account or open a new one so how do i secure it ive reported my card lost so waiting for a new one - do i tell me bank not to allow any money to them?

You need to write a letter with specific wording, and take it to your branch before close of business at the latest the day before the payment is due to happen.

 

So if the payment is due on a friday, then the letter must be taken to the bank, photocopied, stamped and signed by thursday close at the latest.

 

If you need help, let us know. Also tell us the name of the bank, as some banks think they are above the law.

do i have to tell my bank about the problems im having with them - i have my overdraft which i pay each month but use and I cant afford to loose that so dont want to worry my bank

Nope. It is no concern of the bank what happens with your money. If you instruct them to stop specific payments and mechanics to a creditor, under UK law they MUST comply, unless the transaction was initiated by a court authority.

 

You also shouldnt just write that you want a payment stopped. There are a few other things to instruct them about to. If you need help, let us know.

ok so story so far - i cancelled my card with my bank and also asked them to cancel the automatic payments which they did - the loan was due to be paid yesterday and I sent emails as soon as it was due however i am yet to receive a reply

 

I did receive a phone call yesterday which i answered and was an automated service so hung up and received a text today to say it was still unpaid and to log into my account and make a payment etc

 

how long do they have to reply - i have sent to the below email address and still nothing
