You dont need them to take notice. You just need proof that they recieved the letter/email telling them. Then you can demand that your bank block the DD from being processed or reset up.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Well i have already sent them an email saying that i have cancelled dd and that i want to pay by payment book- will this suffice

I will be keeping a close eye on my account in case they try to set it up again.

 

Il have the standing order details pmed to ya tomorrow im half asleep now. Too many sleepness nights worrying about this.

 

Again thanks a million it was easier having someone else in same boat.

. This thread has really helped as I have experienced the same thing over the past few days and had no idea where to turn to with it.

 

My experience as follows:

 

Capital took a payment which I authorised,

Lasker took the exact amount from my account moments later.

 

Thankfully HSBC were fantastic and the money was returned from Lasker almost immediately.

 

I then cancelled my DD with Capital and sent them a letter and email to explain I was cancelling my DD,

changing my bank details and reporting them as, due to extensive research, it was quite clear they had a link with Lasker which I could not prove and they would inevitably deny.

 

I went on to say that, nevertheless, this did not negate the fact I have a debt to pay and would be grateful if they would confirm, in writing,

the remaining outstanding balance and their account details as I would be setting up a standing order.

This was yesterday lunchtime.

 

This morning, I logged on to my account to find 6 transactions by Capital using my card details.

starting at £1 (obviously to check if my account was still valid) and ending in £385 - totalling £640!!!!

This is almost 10 times what I owe them!!!

I believe this was their response to my email.

 

I was furious which HSBC as they told me they'd ensure no further payments could be taken by either Capital or Lasker.

 

I have since decided to get rid of my current account entirely and will be setting up a completely new bank account.

 

Is there a single governing body who can be contacted about this?

 

I have no desire to contact either Capital or Lasker, the bank can only do so much..

 

I just want some advice on the next steps to take.

 

I dont want to have this debt but neither do I want to deal with conmen.

 

Any suggestions gratefully appreciated!

The Bank has to refund the 640, its the law.

 

You can report the whole thing to the Oft, although it would be better to make 3 complaints, 1 about the Bank, 1 about Capital and 1 about Lasker.

Reporting it to the police won't do much, the pdl can just claim it was the result of an individual mistake and promise to take disciplinary action against the employee involved (which will be telling their employees to avoid getting caught) and the hands of the legal system are tied until someone finds proof that it was deliberate and not a mistake.

In other words, incompetence is not a crime and innocent until proven guilty.

 

However, incompetence can affect the fitness to hold a credit license, so report them to oft, get complaints in with the Bank, Capital and Lasker, then send them on to the FOS, complain to Trading Standards, get the story to the press (watchdog and so on).

Omg this is awful u have to cancel ur card straight away as they will keep taking .. They will not respond to the email.

 

I emailed them on the 5th and not heard a thing.

 

It was lasker that took from my account and as i had never had dealings with lasker i was refunded by bank but as they are debiting using capital who you provided details to you may have a but of a fight on your hands.

 

But u r entitled to have ur money back

This is terrible.

 

My take on it though was that it was Lasker who have debited the amounts and not capital? (I know it is capital essentially) but have they used Lasker to debit them?

 

Surely if we all make complaints then there is proof that this was not a mistake but that they are deliberately using the name of another company to sypher funds from our bank accounts. Surely this is a police matter? Its theft no matter what way its dressed up.

EVERYONE here must contact OFT and make a really strong complaint. OFT cannot deal with individuals but do have the power to take action against companies like this if there are ENOUGH COMPLAINTS.

Thank you for all the feedback! I meant to mention my initial reason for posting was to let you know both Capital and Lasker are equally corrupt, which is evident in my experience with both companies. I wanted to warn everyone that it is not just Lasker taking payments without permission!!

 

HSBC have actually been really good, have officially apologised, changed all my account details and I have now got every penny back! Not too bad in under 24 hours. I've written complaints to Capital and Lasker though I have a feeling these will go straight in the bin. Oft have also been contacted but I agree that the only way for this to be noticed is for a strong group complaint to be logged. Please let me know what info you'd like.. Or what you'd like me to do.

Im defnitely gonna go forward with this as its disgraceful behaviour. Im still awaiting my new debit card and its a pain.

 

ERG have you got yours yet?

 

Nope haven't received my card yet had pin days ago but still no card ?????? Will phone them tomorrow if it hasn't come cause they said 7 - 10 days and its been 9 days today

this company has not received any money from me,

but i have had a day of dealing with them recording conversations and so forth.

 

My first phone call was pretty straight forward trying to find out who the company was that i was phoning and why.

 

Yet i got greeted on the telephone by a James Edwards, saying "Are you going to pay this debt or not you northern c*nt"

Which as you can imagine i took offence and

 

im taking it upon myself to get this company shut down

 

and any future trading from anyone who owns these companies to have some sort of ban.

 

Thugs, Legalized Thiefs,

 

whatever you want to call them it has to be stopped.

 

My first port of call has been watch dog, fingers crossed there's a report on there.

Well today I discovered that £330 had been taken from my account. On investigation it transpired that it was by a paydayloan company from whom Id had a loan from 3 years ago. Somehow they had got hold of my card details for my current bank (not the same as the one when I took it out) and cleared the account. Ive never given them my debit card details so how can this be legal? I reported to the bank as fraud / unauthorised transaction but they phoned back to say they had contacted the company in question who provided them with all the evidence they need to prove I owed the money so doesnt matter that I hadnt given them my details they had the right to take it and therefore they will not be refunding it! I am gobsmacked that this is actually ok??

We have been telling people to put a letter into their bank instructing them not to make any payments under any circumstances to these companie

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
