Hi ,

 

Has anyone tried this if so any succsess?

 

my wife has been missold ppi by lloyds which they have addmitted and paid back.

 

my wifes current account was overdrawn all the time her wages went in each month

but did not clear the balance so the account was constantly overdrawn.

 

lloyds then paid their loans & credit cards out of this account.(including the missold ppi)

therfore charging interest on the missold ppi via the overdraft,

 

i have made a complaint using fOS and recived a letter today from lloyds saying that they are looking into it.

 

her account is currently with Moorcroft who have put collections on hold

FOS have written to them saying action taken is likley to be adjourned pending the outcome of the complaint.

 

just wondering if anyone had any thoughts on my chances of making this stick .

Hi ,

 

I was wondering if anyone could give some advice on a problem I am having with Lloyds.

 

I put a claim into Lloyds for miss-sold PPI on behalf of my wife, they admitted and paid out

however they did not pay out on a credit card that she holds

I pointed this out they admitted the miss-selling of this as well and sent a cheque for £3800 which have not cashed.

 

When I checked the amount on the FOS spread sheet on here

it should have been more like £10k,

plus my wife’s bank account was always overdrawn and they have charged more in interest on the ppi payments which they miss-sold than she owes on the overdraft.

 

As I said my wife’s account is overdrawn (£4700) , Lloyds passed this on to Moorcroft

I wrote to them saying the whole amount is disputed as the whole amount is interest on miss-sold ppi and that it was subject to an ombudsman complaint,

they went away and Ihave heard nothing from Lloyds or Moorcroft for months.

 

Getting nowhere with the PPI

I got a solicitor to send a letter formally rejecting the offer of payment and outlining the amount due.

 

We have had no response to the letter from Lloyds,

however a few days after it was sent they have change debt collectors to Apex who are now trying to collect the money owed on the overdraft .

 

How would you go about dealing with Apex?

 

Any help or advice would be gratefully recived.

You say that Lloyds have admitted the misselling. Have they done so in so many words?

What is the basis of the misselling?

 

If there is clear misselling - and especially if they have admitted it - as you say they have done then I wouldn't bother to deal with Apex or anyone else. I would simply send a 14 day LBA and then sue.

 

I certainly think that you need to set down exactly what they do owe you - including cost of overdraft etc. Also, have they damaged your credit file as a result of this? If they have then you should get compensation for this as well.

They sold my wife PPi even though they were aware she had a prexsting medical condition as they have paid out on a policy that she held with them.

 

They have admitted mis selling in writing

 

it is just the amount of compensation which is wrong ,

 

they appear to be using Apex to try and force us to accept their offer.

certainly unless the debt have been sold, ignore the DCA's

 

if they have been sold, all well and good, as they wont be able to offset!

Looks like Lloyds are trying to go Japanese by saving face and just make the whole problem disappear by handing it off to Apex.

Can you use the Data Protection Act and a SAR to get confirmation that the account is closed and the debt transferred?

We had a letter today saying Apex were going to apply for a county court judgment,a charging order or a attatchment to earnings.

 

i rang them asked them if they would please issue so i could counter the bloke on the other end said Apex did not do that ,

 

they said that they wanted to get my wife into a payment plan

 

i told them they were getting nothing their client was getting nothing

send it back to Lloyds and get them to give back the money they stole.

 

having fun with this even though Lloyds are rufusing to respond to my solicitors letter

please post up the refusal letter..

 

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all figures and dates. {DO NOT USE A BIRO OR PEN OR USE SEE THRU TAPE OR LABELS]

DO NOT USE ANY PDF EDITOR TO BLANK STUFF, THAT CAN BE REMOVED

DO IT IN PAINT.EXE or any photo editing program

convert existing PC files to PDF [office has an installable print to PDF option]

..

goto one of the many free online pdf converter websites [http://docupub.com/pdfconvert/]

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

i'e Default notice dd-mm-yyyy

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

have you ever SAR'd lloyds to get the full picture and all the statements

 

if the OD is all ppi+int

and as they've paid out on it already

should be easy.

sorry to jump into your thread but wondered if someone can help me.... LLOYDS TSB refused my ppi claim but i rec letter after 9 mths from ombudsman to say they have upheld claim and they have given lloyds til 14.2.13 to accept/decline what they have said. ombudsman has advised lloyds to refund me all ppi plus 8%. what will/should happen now? thanks

I have done dsar with Lloyds so i have the proof that they have underpaid.

 

i have to admit the working out of the interest for the currrent account got me a bit baffeld,

i used the card calculator and only added the interest and the 8%(not the PPi itself) to come to the conclusion

that the whole amount was interest charged on misold PPi (the account has not been in credit in the last 10 years).

 

i have had further claims paid by Lloyds already, these PPi payments came out of the same account

they did not pay back the interest charged on this money but i am hopfull that i will be able to get it this time

we cashed the cheque last time so i should imagine we are stuffed on that one.

Hi sorry its taken so long to come back.

 

we tried to upload the statements but could not remove the personal information so decided to let the solicitor deal with it after spending a lot of money trying to get lloyds to come to an agreement the money finally ran out .

i started to chase lloyds myself and yesterday received an offer of £8900 this as far as i can see is the correct amount minus a claim we made against the policy.

 

however this does not compensate for the fact that they took the payments from an overdrawn account and charged interest on the monies .

given that we are desperate for money and have considerable mortgage arrears do you think we should accept or try to get compensation for the interest charged.

 

any help or advice would as always be gratefully received

call and ask them about it.
