    • They have defended the claim by saying that the job was of unsatisfactory standard and they had to call another carpenter to remedy. My husband has text messages about them losing the keys a second time and also an email. What do they hope to achieve??? Most importantly,  as far as I have seen online, now I need to wait for paperwork from the court, correct?
    • The Notice to Hirer does not comply with the protection of Freedoms Act 2012 Schedule  4 . This is before I ask if Europarks have sent you a copy of the PCN they sent to Arval along with a copy of the hire agreement et. if they haven't done that either you are totally in the clear and have nothing to worry about and nothing to pay. The PCN they have sent you is supposed to be paid by you according to the Act within 21 days. The chucklebuts have stated 28 days which is the time that motorists have to pay. Such a basic and simple thing . The Act came out in 2012 and still they cannot get it right which is very good news for you. Sadly there is no point in telling them- they won't accept it because they lose their chance to make any money out of you. they are hoping that by writing to you demanding money plus sending in their  unregulated debt collectors and sixth rate solicitors that you might be so frightened as to pay them money so that you can sleep at night. Don't be surprised if some of their letters are done in coloured crayons-that's the sort of  level of people you will be dealing with. Makes great bedding for the rabbits though. Euro tend not to be that litigious but while you can safely ignore the debt collectors just keep an eye out for a possible Letter of Claim. They are pretty rare but musn't be ignored. Let us know so that you can send a suitably snotty letter to them showing that you are not afraid of them and are happy to go to Court as you like winning.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hey all

 

Without wanting to go into a long and embarrassing tale of how I got to where I am, i have managed to fight my way back from the brink and get rid of nearly all of my 10+ payday loans (3 more are being cleared this week alone!)

 

But there is one not playing ball at all, and surprise surprise its Toothfairy.

 

After a LOT of digging I finally found the way to contact them via email here is the email I sent, their reply and my reply.

 

Any advice on where to go from here would be much appreciated, I am expecting them to come back and reject my offer so any tips would be great.... Do you think iv made an acceptable offer?

I would make an offer of a full and final settlement of £176 (original loan amount, plus interest, a fair amount for charges, less £24 already paid) paid over 3 instalments.

 

1st payment of £58.67 would be 1st November 2012 (as I have already been paid all money has been allocated until next pay day).

 

Kindly confirm that this is acceptable?

well, i would have only offered 12 pound for an initial default fee, plus the 1 month interest and the original loan minus any payment already made.

 

But can't really go back on what you offered.

Most likely they will ignore your offer or reject it, with any other creditor i would suggest to keep negotiating until an agreement is reached, but with these guys i would just start paying them what you offered even if they say no, then once its paid off you can then just point and laugh at their demands.

 

Also if you havent done so make sure they cant empty your bank account, cancel cpa at the bank, report card as lost / stolen and fire off a complaint to the OFT about the unfair charges and threats.

I even managed to negotiate minicredit (another notorious pdl) down from £1200 to £280 but toothfairy are really difficult. Its taken me over 10 emails just to get this reply out of them.

 

Has anyone had any success with toothfairy at all? I can't find any resolved outcomes on here

Well done on you for sorting the other ones out, toothfairy tend to just play ignorant but there being investigated at the min due to their unfair behaviour. As nao said just pay what you owe because theyll never agree to your offer and their unfair charges cant be jusifed anyways

I can see this is going to be a long slog. I am going to do what Nao suggests and pay off what I think is owed in 3 installments.

Tell them that you dispute any debt above the amount of £176 and should they want more they will have to take you to Court where you will defend by every legal mean deemed necessary.

Then just make a list of all payments already made and all planned future payments and when and how you will pay them.

 

No need for fancy legal terms and references, they know exactly well what they did wrong and keeping it at a 3rd grade reading level should help keeping it understandable for the likes of Toothfairy:razz:

So from going from no contact speedcredit/toothfairy have really ramped it up this morning

 

Had this lovely email. Definitely going to have to pay hardball with them. I am more than willing to pay back what I borrowed, plus the interest for the 28 days and a fair charge but on a £100 loan £1460 is not acceptable.

 

I think everytime they send me something I am going to reply with my offer. Perhaps I can annoy them enough into accepting my offer.

I am also confused as it says I have to pay by 17:00 today, but then further down the letter it says I have 4 days to pay??

 

I have replied to them again with my original email, lets see what happens.

 

I also have confirmation in email form that the original loan was for £100 and for a period of 14 - 28 days. Listing the debt as £844 is totally made up.

random inconsistent demands is the toothfairy way, for me they knocked off 150 recently, mind you thats for a debt settled more than a year ago where they want over 3600 for hehe, not like they would get a penny.

I have just had a standard reply back telling me they do not accept my offer of £152

 

Funny as I did not offer £152, I offered £176

 

Iv replied with some more detail, hopefully a human being will read this and actually get back to me

Itll be like banging your head against a door with them, even if someone reads it ull get an standard rejected email, but regardless off what they say just pay what you can afford and only pay what you owe

Ok. I have grave concerns over that email. It says they're accepting your offer of £176 in 3 installments.

 

I don't want to rain on your parade but... It does not state that this £176 clears your balance as a full and final settlement. There's nothing stopping them from accepting the £176 as a part payment towards that utterly stupid and extorted figure they claim you owe.

 

I'm trying to locate a recent thread where it was advised NOT to accept until it was confirmed that this is a full and final settlement offer. I know it's like "pulling teeth" playing email pingpong with them (see what I did there? Lol) but you need that confirmation.

 

Keep it polite with them, just email thanking them for their recent correspondence and request confirmation that your offer of £176 in installments will be considered a full and final settlement on the account and that they will not pursue you in the future for any of the additional (ridiculous amount) that they claim you owe! Also seek confirmation that they will not sell on nor assign any of that fictitious remaining amount to any other party.

 

Once you get that confirmation, I'll join you for a glass of virtual bubbly :D
