Hi everyone,

this is my first post and I need some urgent help please.

 

Earlier this year I was contacted by Newlyn about an unpaid council tax bill dating back to 2005.

 

I asked them in writing to produce proof that I owed this money (£400), which they haven't done.

I don't believe I do owe it hence me asking for their proof.

 

Recently a bailiff has visited twice leaving letters.

 

Last night I returned home very late to find a notice to remove goods for auction to the tune of £668.00.

There was a hand written note on it asking me to call the bailiff urgently as the council haven't heard from me to discuss the debt.

This notice wasn't dated or timed and wasn't in an envelope so a friend of mine (cat sitting) has now seen it and I'm deeply embarrassed.

 

I no longer live in the area where this 'debt' relates to.

 

The removal notice quotes a liability order, but the first contact to chase the debt has happened 7 years after the liability order was lodged.

 

This morning, the bailiff called at 08.10.

I was just leaving for work so I ignored it.

After 10 mis (thinking he had given up) I left for work,

 

he had hidden nearby and I ended up sprinting for my car because as soon as he saw me he started running at me shouting my name.

Again I'm deeply embarrassed as I live on a farm and all activity can be seen and heard by neighbouring occupants.

 

I understand my rights with regards to not letting him have access to the house, but my big worry is my car.

I need it to get to work and I have no-where to hide it.

 

As the bailiff has now seen it he would probably spot it if I left it nearby anyway.

I am now terrified to go home.

I am on medication for depression as it is and this has really shaken me up and left me feeling really iill.

 

Is there anything I can do today to stop this bailiff whilst discussions are ongoing with the council concerned?

 

I'm suspecting that as I'm a woman living alone they'll see me as a bit of an easy target.

I've been told to not even communicate with the bailiff so I'm confused as to what steps I should take now.

a 7 year old council tax bill will be a low priority even if you did owe it

as for the bailiffs you do not need to speak to them or phone them

 

contact your local MP and make a formal complaint to council

it does not matter what the bailiffs see or don't see

 

it is a low priority debt if it was owed , priority debts include CURRENT years council tax ,rent/mortgage payments gas,electric

 

so yes it is classed as low priority

bailiffs eventually do give up been there

 

make complaints to council and MP

Have you contacted the council where this debt accrued from?

If not then I would do this asap.

You need to find out if this debt is from a property that you resided in.

 

Councils are desperate to get money owed to them. It seems that they are now just giving a name and using the bailiff to trace the debtor. Your best bet at this stage is t contact the council. You need to request that they hold off on the bailiff until this matter has been thoroughly investigated.

if you can pay you should be paying the council

direct via your internet banking site

never ever pay a bailiff.

 

you need to do these two things:

 

start by sending this to the bailiff co. it can done by e-mail also send it to the council this will tell us when the fees were added

From:

bailiff House

Ref: Account No: 123456

Dear Sir

With reference to the above account, Can you please provide me with a breakdown of the charges.

This includes:

a - the time & date of any Bailiff action that incurred a Fee.

b - the reason for the fee.

c - the name(s) of the Bailiff(s) that attended on each occasion a Fee was charged.

d - the name(s) of the Court(s) the Bailiff(s) was/were certificated at.

e - the date of the Certification.

This is not a Subject access request under the Data Protection Act S7 1998 so does not incur a fee of £10. You are obliged to provide this information.

I require this information within 14 days.

Yours faithfully

 

 

Also always advisable to ask the Council.

1 - how many Liability Orders they have against you

2 - the dates they were obtained

3 - the addresses they were for

4 - the period of time each covers

5 - how much each one was for

6 - how much is still outstanding

7 - the dates they were passed on for enforcement

 

...........

 

sadly once an LO has been taken out, CTAX debts are not SB'd, but as advised back CTAX debts are NOT a priority bill.

I had already asked the bailiff via email back in February to provide proof that I owed the debt plus a breakdown of their charges.

They haven't provided it.

 

I understand what is being said about it being low priority,

but if they've shoved a Removal Notice through the door,

surely they'll just clamp or remove my car if they can't get into the house?

 

It says they want to take things to auction so my car is the no. 1 target, isn't it?

 

I could get a cabs to and from the station and leave my car there, but that will cost a fortune...

Hi all,

I made a payment arrangement with Newlyn a few months ago,

and on one occasion their website wouldn't accept my payment.

 

I tried several times and kept getting an error message.

 

The next day I called Newlyn.

 

I explained that there might be a fault with their online payment system and asked if I could pay over the phone.

 

I got the usual rude response from them and they refused to accept they might be at fault

- they just reminded me that I had now broken the payent arrangement (as I was late paying due to the problems) and would now have to pay in full.

 

I tried to discuss it with them, but they just repeated their script so I gave up.

 

I tried to pay again and it still didn't work, but then tried another card which was sucessful.

I've continued to pay - on time - using the card that works.

 

I texted the bailiff to explain it was a fault on their website, but he doesn't care either.

Newlyn now regularly call me (I don't answer) and are texting me with removal notices.

 

Can anyone help with the best response I can send them to get them to understand the fault was theirs and to stop harrassing me? .. and are they allowed to text me with removal notices?

If the online system is screwing up take screendumps and save the images by pressing CTRL and PrtScrn then pasting even into paint, and saving the image. as proof. What was the debt for, so best advice can be given?

If it were me & providing they do NOT have any levy on your goods I would stop paying them & pay the Council instead via online banking, Council Website or automated phone. Have you had a breakdown of the Fees they have charged you?

Ok will do it another way!

 

If the bailiffs have NEVER been into your house or have a levy YOU have the upper hand

 

By having arrangements with the bailiffs they set payments high if you default or a day late they will add on van attendance fees

You have defaulted in there eyes now

 

you do not have to deal with the bailiffs there are other ways

I don't believe they have a levy - they would have to post a list through my door, wouldn't they? They've made several visits to my house, I do have a breakdown of charges and I think (unusually) they have charged me correctly. So how would you suggest I go about changing to paying the council?

 

Sorry if I'm being a bit slow IHB!

The Newlyn bailiff I dealt with was actually quite reasonable (after a rude start) and after I sent him my list of outgoings he agreed a low repayment of £20 p/m.So, to confirm , they haven't been inside my house but have attended several times and as mentioned to Plodderton I don't think they've levied as I don't have a list.

Thats good

Do not let bailiffs have a levy if you have a car move it away

 

there is no right of entry and they cannot force entry

 

you can pay council direct using correct reference number

 

I would write to council and bailiffs to let them know as the bailiffs web site would not take payment

and they did not help on the phone you will now be making all payments direct to the council

 

Do it weekly if you can a history of payments will stack up

stop paying the bailiffs

 

and pay the council DIRECTLY by YOUR internet banking site

 

they cannot refuse it that way.

Ok thanks, but surely Newlyns will just keep harrassing me by text and visits? I can hear them now saying, 'you have made a payment agreement with us', etc etc.

 

The most the bailiffs can charge will be £24.50 first visit fee and £18.00 second visit fee providing they have no levy

They will call but they can do nothing they will soon move on to the next victim

 

They will be charging you more than you think card payments ect they all add up

They do.. it's an extra £1.00 each payment.

 

So are you suggesting I pay Newlyns seperately their charges, and then just tell them and the council I'll continue the £20 p/m payments on line to the council direct?

YES

 

Pay the lot to the council i expect the bailiffs have taken there bite already

 

you need to get a breakdown of account from bailiffs there figure will be different to the council!

I'm paying the bailiff because the council wouldn't take the debt back. I called them when it first started and they said they couldn't help and that I had to deal with the bailiff. That's why I'm unsure about trying to pay the council directly again. They worry of Newlyn's bailiff turning up is ruining my life a bit now, so I'm nervous about stirring things up if I stop paying them...

That is the normal response from the council you do not have to deal or speak to the bailiff

 

there is really nothing the bailiff can do without a levy he cannot send you to prison break in or anything

 

When he turns up if it is raining just wave to him through the window if need be:razz:
