help. my girlfriend has had to reduce her hours to 20 to help with myself and a 1 yr old baby so we applied for esa income related. no problem since june they have been paying us £111 a week plus our council tax went down to £49. we could live off that just about for bills and food. my esa was turned down at a tribunal and i reapplied from the 24th august and the week after we got a rebate of £100 back for council tax. now esa are saying we have been overpaid and i will not be recieving any esa and the council tax have got it wrong aswell. we have gone from just about managing to being totally scared for my family. what the hell is happening. am i missing something.

What is the reason that ESA have given for the overpayment?

My advice is based on my opinion, my experience and my education. I do not profess to be an expert in any given field. If requested, I will provide a link where possible to relevant legislation or guidance, so that advice provided can be confirmed and I do encourage others to follow those links for their own peace of mind. Sometimes my advice is not what people necesserily want to hear, but I will advise on facts as I know them - although it may not be what a person wants to hear it helps to know where you stand. Advice on the internet should never be a substitute for advice from your own legal professional with full knowledge of your individual case.
