I recieved a letter from Mckenzie hall a few weeks ago regarding a supposed debt with HSBC.

 

I wrote back to them asking for proof the debt belonged to me (as I felt it wasn't mine).

 

They have now written back with 2 years worth of bank statements.

 

The first statement shows an amount of £5000 being credited to the account and the last statement is a little weird as to me it says that the account was closed with £0 owing (see attached).

 

They are claiming I owe around £2000.

 

What I do not get is why they have sent a load of bank statements insted of some kind of signed credit aggrement,

surley that would be the proof I wanted rather then random bank statements.

 

The credit on the statement doesn't even show where the money came from just says CR £5000.

 

Whats the next step I should take? The debt is 5 years old and this is the first I have heard about it in this time.

They say a loan from RBS, which I think HSBC is part off, but they are not very clear. Thats the confusing things with the bank statements, surlry a credit agreement would make more sense. All the statements show is a long closed account being credited by £5000. There isn't even any repayments for the loan coming from that account.

so they are loan statements not bank statements.

They are bank statements, they show cash withdrawls, direct debits and such like.. Having looked through them more closely I have found that in fact the loan was for £2350 which they credit the account in Oct 06. This is buried on page 30 of 50..

I helped someone a few years back with the same hsbc and muckhall.

If i remember correctly, hsbc tried passing a loan off as an overdraft. Something to do with managed loan. They would set up an account an put it in minus for the loan amount and you are supposed to put in your loan payments to reduce the minus figure. Cant remember the whole thing as it was a few years ago but dodgy to say the least.

What would people advise as my next step? They have given me 7 days to pay in full, before they take EXTREME ACTION (which may or not be a Steven Seagal film). What are they likely to do next, I haven't even said its my debt yet.

as its not your debt nor & they have no legal powers anyway...stuff all!

they only come AFTER they've won a CCJ

 

and after you fail to pay it.

Check for any CCJ's against you at the Registry Trust.

 

If you made a proper request for documentation then sending as load of old statements is not conclusive prrof at all. MHall - who have parted company with their founder by the way so expect them to change their name quite soon - will know this and won't take the extreme action of launching a legal action knowing they will be savaged by even the most liberal of judges if they enter a courtroom with this dross.

Have now got a letter from meritforce (same company) saying they are coming to vist, they have not told me when so there is a no way I can get a cake in for there vist. Do I write to them and tell them they still have sorted out if this debt is mine or ignore them?
