      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi soapaddict, i too have just had a call from credit style. i took out my finance agreement with BH in 2005 to buy a £55k mercedes benz. I paid religiously until i got divorced and agreed a lower monthly figure. I paid £700 for quite a few months and then lost my job too! I agreed last october to pay £387.12 every month and have a letter from them to confirm this. I sent the tear off slip back but now they're saying that they never received this and that they have sent 3 more copies of which i have ignored!! I should have paid the £387.12 by the end of august but didnt pay it until 13th september so BH have now passed my account to credit style. BH are refusing to talk to me and have said that if i dont pay the final amount of £7900 then they will take me to court to repossess my car! Credit style have said that because i have failed 3 times to stick to the agreement, they will have to take over my account. When i took out the initial loan, i did agree to pay the £12,900 balloon payment at the end of the 5 years. Because i got divorced i couldnt pay this so they did agree to re-finance that. As i said, i then lost my job and needed to reduce the payments further of which they agreed but now they're saying because i didnt pay the 2nd agreed amount of £700 to pay off my balloon payment and have not received my signed slip back, they can tell the courts that i am in default of that agreement. They have said that they have tried to call me on numerous occasions since august but that i havent replied to them. I truly have not received one call of them, no text message and no letter ssying im in default or that credit style is now looking after my account! Credit style got my account on the 13th september and managed to get hold of me that evening!!! I have now sent a recorded delivery letter to BH this morning saying that I will not deal with Credit Style and i will continue to pay the agreed amount of £387.12 regardless of what credit style says i have to do. I have never missed an agreed payment, i may have been late on a couple of occasdions but have always paid double the following month to keep the balance correct. So I initially took out a loan for £55,000 and only have £7,900 left to pay yet they are demanding that in one go or at £700 per month for the next year or they are going to take me to court!!! I am waiting to see if they actually respond to my letter so i will keep the forum and you up to date. if anyone has any other advie though, i would very much appreciate it.

Hi. Yes keep us posted & I will do the same. I have sent a letter to Credit Style telling them to transfer my account back to

Black Horse (a lady at Black Horse told me to send the letter to them) so just waiting to see what happens now.

 

I am also going to write to Black Horse as I have tried to communicate with them over the phone but they have failed to reply to me so far. I think everything needs to be written and recorded post from now on. Good Luck. x

Just letting the forum know that I have just received another call from credit style even though I told them on Tuesday that I would not deal with them. They have said to me today that BH have refused to take back the agreement and if I dont pay, they will get a court order to repossess my car.

 

I dont know what to do anymore, I hope someone can give me some advice
