Hiya All,

 

First of all it has been a few years now since I was on here all worried and thanks to the advice I got life is a lot better with no nasty letters or debt hanging over me.

 

A friend of mine living in the same street was stating how worried she has got over a cateloge bill from Littlewoods for over £10,000. She also has other debts with Studio and Provident totaling debt of near £17,000 this includes an overdraft on her bank account and she is basically at the moment robbing peter to pay paul nasty letters phone calls etc. I explained about this website and said I would post her story and see what advice people would suggest.

 

One of the options I suggested to her as a council tennant is bankruptcy which she is willing to do but I said I would explore other options on here, She does not recall ever signing any credit agreement with the catelogues but has done so with Provident, Will she be able to simply write to the catelogues and request a signed copy of this? This however does not solve the problem of the overdraft with her bank, She no longer banks with them but uses a post office account instead.

Your friend might be best contacting one of the free DMPs. Payplan or CCCS are both free and help people with debt over 5k.

 

They will discuss the best options. Bankruptcy might be that option, I don't know circumstances, but I'd certainly seek advice first before considering such a decision.

She could certainly make a CCA request to the catalogue companies and provident, the ''catalogue'' companies ''agreements are often just the application/ first order coupon from a newspaper or magazine their acceptance of the order and the customers acceptance of the goods sets up an account.

Hiya guys, Many thanks for the reply. She came down today and went through the debts she has which I was amazed totalled nearly £28,000.00 which shocked her also, Anyway we telephone the national debt helpline and went through her situation and in all honesty they were recommending Bankruptcy to her given the fact she has no real assests and will never really truely pay this debt off under any plan. The majority of the debt are catelogues which she knows she has never signed anything to establish a line of credit however with provident she does remember having to sign a form when she started. I have told her we will write to all her creditors informing them of her intention to make herself bankrupt and she will no longer be making any payments to them while she saves the money towards the fee.
