    • Hi   With a SAR all you have to do is ask for 'ALL DATA' (this way it does not matter what format they hold that data whether it be digital, email, telephone calls (recorded), written etc).   They then have 30 Days to comply once they have acknowledged your SAR Request (that is unless they require ID Verification) which the 30 Days time limit does not start until they have verified your ID if requested)   Also can I add in DHL response in post#36 I hate it when any Company/Business etc. has the nerve to use the get out clause of 'Human Error'.    This is not the case as it was 'Maladministration' by DHL' not 'Human Error' as stated to you, irrespective of who/which employee of DHL made the 'Human Error' the buck stops with DHL as who/which employee made that error was Employed by DHL.

[if mcol is not working return after the w/end or the next day if week time] .  register as an individual  note the long gateway number given  then log in .  select respond to a claim and select the start AOS box. .  then using the details required from the claimform .  defend all  leave jurisdiction unticked   goto the defence filing section  file the following:     1 The Claimant's claim was issued on (insert date).  2 The Defendant contends that the Claimant's claim so issued is a claim in contract and is statute barred pursuant to the provisions of section 5 of the limitation act 1980.  . If, which is denied, the claimant contends that the Defendant is in breach of the alleged contract, in excess of 6 years have elapsed since the date on which any cause of action for breach accrued for the benefit of the Claimant. .  3 The Claimant's claim to be entitled to payment of £[insert figure from their POC]  or any other sum, or relief of any kind is denied. .. ..ends..   dx          
    • I passed on the article and link to friend. Between us we will now try get the required info to the correct location so that they (whoever in the Govt) can sort out what he is owed.     • numerous erudio/drydens claimform threads here already - use our search top right.   your appears to be statute barred as you've never heard of erudio so would not have deferred since your last direct deferment to SLC in 2013    if you wish to bother to even send CCA/CPR that's upto you but the bottom line is to erudio you've ignored everything to date yoy might also ignore a claimform.   but ofcourse you are not!!   if the above is true   pop up on the MCOL website detailed on the claimform.     • Well I would want my £50 back also but hey ho if your satisfied its been resolved.....there was no way you could ever be liable anyway as your contract was with TC not RC.   Thread title updated.   Andy

HI

 

i have a first plus loan which was taken out just under 5 years ago.

 

i visited their site to claim back my ppi

 

the loan was FOR about £13k and they added the ppi loan of about 2500k.

 

i was paying aroud £168 amonth back.

 

they have now said that that i was misssold and are offering the following :

 

a refund of £1680 + *% interest

 

also the will take 250k ppi + intrest of the loan

 

my payments will be to around 140 a month

 

its this correct or should i get the whole of the ppi money and my payments stay the same?

 

the £1680 is the 140 - 168 =28*12 =336*5

 

any help would be grateful and hope this make sense as i went through their site and not the FOS or any ppi comapny

Have you got the agreement or all of the figures from it?

yes i have the got the agreement and i not sure what you mean by the record the repayments you have made

 

i have the orinal documentation and know i have paid the 168 pounds each month

Sorry...a typo.

 

I meant a record of all the payments you have made? (but you have answered that now)

 

Have a read of No.1 in my signature below and use the spreadsheet at the end to work out how much you should be getting back.

 

Standard procedure is that you will get back the premiums actually paid plus the interest the bank charged you on the,. In addition you will get 8% interest on each of the payments running from the date of payment to the date the claim is settled.

 

If a loan is still live then the loan is adjusted so that future repayments are reduced to remove the PPI element from them.

Hi so what they offerd me sounds right or do i get the intrest on the ppi back as well or should i go to the fso. the loan is still running so

If it were me I would check their offer...never trust a bank.

ok i i have worked out that £27 a month of what i was paying was for ppi

 

so working with your formula it shoulld be (27*12)* 5 as it was over 5 years + 8%

 

dos this sound right

Please either post up the agreement or alternatively the figures from the agreement i.e. Amount of Cash Loan, Amount of PPI Loan and the Monthly repayment.

scan the required letters/agreements/sheets

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or ir you have PDF as an installed printer drive use that

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.
