The last paragraph.

 

'Combined Parking Solutions Limited, run by Mike Perkins have recently had their access to obtain registered keepers details electronically from the DVLA temporarily suspended. To be able to obtain registered keepers details via electronic means from the DVLA it's a requirement for a Private Parking Company to be a member of the BPA and registered under the BPA's "Approved Operator Scheme". Mike Perkins had been elected as a Board Member of BPA's Approved Operator Scheme days before the suspension'

Can I just clarify a number of matters.

 

1) The suspension is from accessing data that means both via the EDI and using manual paper applications.

 

2) The DVLA have or are in the process of implementing a new measure of "No access to data in respect of any events occurring during suspension period" - I would be astonished if they allow CPS to submit retrospective applications.

 

3) It has been highlighted elsewhere that there is nothing to stop CPS manually ticketing vehicles and collecting the revenue from the 40% who pay on receipt of such a ticket. Well I believe that there is. If they manually ticket during the period of their suspension with tickets and signage that warns that if payment is not made then the RK details will be requested from the DVLA then that would be a 'misrepresentation of authority'. Therefore, in my opinion, they could only manually ticket during the suspension period where both the tickets and the signage do not include the DVLA RK threat.

Keeper liability wiil make no diference whatsoever as this is only a very small part of a much bigger picture. remember registered owners have been ignoring these companies for years.

 

 

I actually meant that sign. Does it become "legal"when the new law comes into force in October.

Sorry, I haven't seen the particular sign in question. What I do know is that there are questions being asked about various signage up and down the entire country. I also know that one major player in this field is already suggesting Keeper/owner liabilty in Scotland despite the fact that RK responsibilty will not exist outside England and Wales.

Money tap turned off by firm’s misleading car-park signs

 

[15 Sept 2012] Get ready to congratulate parking company boss Mike Perkins for being elected to the British Parking Association (BPA) ‘approved operator scheme’ board, which supervises the activities of private parking companies and awards ‘sanction points’ against companies in what the BPA claims is its strict disciplinary regime. Perkins is the operations and strategy manager of Combined Parking Solutions – always good to have industry people policing industry people.

 

So it’s time to have a look at his company's website, where the illiterate and badly punctuated rubbish that infests parking-company signs is on display for all to see. It quotes Perkins as saying:

 

‘It was an honour in being voted onto the AOS member board, I hope that I can bring my knowledge and share my experiences with the industry as we move into this new and exciting time of parking enforcement, Combined Parking Solutions has always faced the challenges it faced head on.’

 

He goes on: ‘The Become recognised as the leading authority on parking enforcement on private land and in unregulated car parks, working to raise standards of performance for the good of operators and motorists alike.’

 

What? Who knows what this rhubarb means?

 

Less than happy news of Perkins’ company now reaches me, taking the gloss off his elevation to chief BPA milk monitor. Combined Parking Solutions’ car-park signs have been deemed so misleading that even the dopey civil servants at the Driver and Vehicle Licensing Agency (DVLA) have decided to ban them. The DVLA has just suspended the firm’s access to motorists’ names and addresses, cutting its income from parking-charge penalties to virtually zero overnight and meaning drivers can safely ignore the non-fines that the company imposes for supposedly breaking car-park rules.

 

Funny, though, that there’s nothing about this in the ‘latest news’ section of the company’s website. Funny also that it wasn’t the BPA or the DVLA that blew the whistle, but campaigners against dodgy parking practices.

 

Makes you wonder whether the BPA’s annual audit of private car-park signs, done by external auditors and trumpeted as another triumph of industry self-regulation, is really up to much.

 

But we know the answer to that. It’s all so ably supervised by the board on which Perkins now sits, one of whose members – Simon Renshaw-Smith of Excel Parking Services – managed to ride out the tide of austerity by paying himself a £679,000 salary last year.

This is an extremely interesting post and in particular, the news that Michael Perkins has been voted onto the British Parking Associations AOS Board.

 

I have no doubt that such a role is a very important one indeed and I would assume that the good people at the BPA would have done a "few checks" to ensure that their candidate could indeed bring "knowledge & experience" to the BPA.

 

With the forthcoming Freedoms Bill all private parking companies would of course need to ENSURE that they have properly registered with the Information Commissioners Office to ensure that they abide by the Data Protection Act.

 

Combined Parking Solutions is the trading name of Combined Solutions (UK) Ltd. Although the company is registered with the ICO they are NOT registered for CCTV equipment. Maybe they do not have CCTV equipment....but if they do.....then they should have ensured that their ICO registration covered this.

 

Their ICO registration ( number Z 2120345) only covers: Staff Admin, Advertising Marketing and PR and Accounts & Records. It DOES NOT provide for processing highly confidential DVLA information ( or for managing CCTV images).

 

Another "little area of concern" is that on 22nd May 2012 Combined Solutions (UK) Ltd were the subject of a public advertisement in the London Gazette for FAILING to file a return with Companies House!!!

 

This serious offence was only rectified a few weeks later.

 

PS: Mike Perkins resigned as a Director of his company on 18th April 2010. On the same day.. Mrs Alexandra Perkins was appointed to replace him. I wonder why????
