      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No I havent had the pleasure of visits from DCA. I am just really staring down the road of fighting back.

I have been paying DCA for years. Left my husband 12 years ago, long story so wont bore you but had a lot of debt, knocked myself outself paying as much as i could for the next couple of years and had a massive relaspe of bipolar, ended up in hospital and not worked since. I started paying DCA then and been paying every month since and owe more now than i did then. It was while i was looking on this site just over 3 weeks ago that i started to confort the debts and really started to learn that i did have rights and so i have started the fight back to see what i really owe and what is legal. I CCA the DCA time is up for them to send me the info. Next step is letter in dispute then i guess i really dont know what will happen. I depend on the advice and support on here to help me through. I know that there is a template letter for no visit. I know i will panic if i did get a visit and would likely call the police. I know that the code of pratice states that DCA have to deal in a sensitive way to people with ill health, although from what i have been reading i doubt some of them know what sensitive is. Yes I am afraid and equally empowered to fight back as even though i was ill at the time I know i did not rack up the debt and any debt i did have i have more than paid for. I am feeling the fear and doing it anyway. Remember Richard there is nothing to fear but fear itself.

It will be 6 years on the 10th of this month that I was repossessed, and both companies in administration - no money has been paid to either and requests for documentation has been like pulling a winkle out of a shell without a pin....

 

It has now gone to the FSA and hopefully they will see how lax both lots were before and after the event.

 

Hope everyone else is bearing up, I still find it bad that this alleged shortfall information stays on our credit rating for 12 years, when there is sometimes little liability for it to be there. It should be removed after six years.

I'm sorry you haven't always found kindness but it's something we share,I too have bawled my head off when someone has been nice to me but if you are not used to kindness it can be overwhelming.:faint:There's nowt wrong with us.

glad you are back and in great form,gee I wish you'd given the advice about the wrinkles earlier.:frown: I don't know what's happened to the others... Richard's still having a few probs with his machine by the look of it........ my posts have been a bit short as I've been wading through tons of paper from the SAR I didn't get much from it so I've advised Mr Ro to do a Reggie Perrin :lol: I should have cleared all the paper away by the end of the week and I MAY be back to normal.

I really hope the FSA sorts it for you,it's frustrating when you have to keep chasing after everything I can just about remember when life wasn't a constant round of letter writing etc.etc.etc.I think I'll be kicking up the daisies by the time my OH is sorted.

Laptop probs (piece of junk!) and gall bladder probs! I'm getting back to normal now, as is the laptop, so all's well (or at least getting there!) Hope you're well, Richard, and everyone else on the thread. Sorry at the moment I don't have much time; I'm trying to get a lot sorted around the house and garden. My mother's cats are ill, too, so I've been taking them to vet every other day!

 

Hopefully, everyone is OK - I have been thinking of you all!

Hello All

I had op today, should have been later in the month heard last friday it was to be today instead, keyhole surgey, went in early this morning and was first down just after 9 and home by 4, friend upstairs just gone and been such a big help as was just sore when i got home now walking like a bend over old woman. Distracting myself on the internet and full of painkillers. Glad its over now of to bed. thinking of you all and hopefully back to "normal" soon, been a frantic few days.

I can realt to insomnia sillygirl1, have it big time. Despite the all the meds and op yesterday up at 3.00am feeling better still sore though, i shall be taking it very easy for next few days. Doing more reasearch on this site in my ongoing battle with DCA waiting every day for one of their nice letters.

What are you knitting sg? I went phase knitting few years back, till my knuckles starting to be painful on my right hand and couldnt do it anymore. Knitted more scarfs than i care to remember for a chartiy. Fun while it lasted. Trying my hand at some jew making, had great idea of making chirstmas presents but dont think it will be this Christmas, rather slow!

Starblackie, I have insomnia today, had about four hours sleep earlier and have been up for about five hours now. Washing nearly finished in the machine.

 

I am knitting blanket squares to use up odds and ends of yarn, they are being made into a blanket for charity by one of the ladies in a knitting group I belong to.

I get things done in the middle of the night to, when most people are sleeping, can feel lonely though. Kinnited blankets are lovely, colourful and like comfort blankets, sure it will appericated by the lucky person who recieves it and you get the satisfaction of doing something nice and thoughtful for another. If only everyone were thoughtful what a different world it will be. Try and take things easy sg as you been up half the night, it can make you feel quite **** when you havent had enough sleep.

Morning Lillibelle

Ive got my two on each side of me on the sofa, lovely and cosy. One of mine looked at me so funny last night she likes to sit on the arm of the sofa and loves to climb all over me, especially when im on the laptop, shes an attention seeker. Last night i just couldnt have her climbing over me because of the op yesterday not to mention pain. The look she gave me, she was not impressed, gave her lots of kisses to make up. Im of to try and get a couple of hours, medication plus sleppings pills yesterday and only got just over 3 hours sleep, its i agree a swine and a bummer. Take care and give your cats an hello from my two
