      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Oh I know this one,the b....rs sleep all day then middle of the night start attacking the wallpaper if you don't get up and let them out,early morning telly isn't enough to stop me from falling back asleep then I get up feeling awful. OH somehow never seems to hear them :lol: Early night for me I did a bit today.

I hope the mogs are as tired as me you'll get some peace.

My problem is I have a big big boycat who is housebound following a serious accident last year,,he is blind in one eye and a bit brain damaged,,so when he wakes up he wants attention,,normally my son is still awake but he's away,,and me other boy Winston is as bad,,he wants Mummycuddles..the girls are fine...Me OH blew me hoover up today too,,so not been a happy day in Lilliland lol

The cats sound lovely what a shame about the accident,I think toms are more affectionate I have only got one left now and two queens who mostly don't bother but the tom needs quite a lot of attention he went like that after his brother died in mysterious circumstances last year.Men and hoovers what is it,we had a fall of soot last year and my OH cleaned it up but forgot to put the filter in the cleaner,he was still out there hoovering away when I came in and shreaked the place down all I could see was a big black cloud coming out of the kitchen which I had just finished painting,he was in the middle of it all as black as the hobs.What's wrong he says- he didn't get any tea that night.

Lilliland doesn't sound that bad :lol: I hope there's something on telly tonight I'll nod off and himself can tell me all about it tomorrow.

Hey Ro,,I don't know whats happened to janey and girly,,,Richard has not got a pc at the moment,,,I will keep popping in every day...you and I can keep the home fires burning :)

Busy day today,,went grocery shopping :( I swear I'm getting more and more invisible,,some stupid woman kept reversing her large arse into me in every aisle,,Grrrrrr then to add insult to injury,,the daft mare nearly reversed into our car !!!!!!!!!!!!!!!!!!!!!

My rebate from BG came today,,I got an extra £50,,not £25...hope it's not an error cos I used it to pay the phone bill !!! My OH is still decorating,,,I have banned him from touching my new hoover when it arrives after his attack on the old one...

Hi Lilli,

good news about the extra cash from BG and you'll have to have eyes in your rear end to guard the new vac.Large bottomed ladies eh I usually get sandwiched by them at the checkout -claustrophobic. I expect Janie and Girly are busy gardening maybe I'm not sure about Richard in his last message to me he said no one was listening to him any more so he may not come back,which does not matter if he has support elsewhere.I hope it all looks great when your done decorating.I might dig a paintbrush out myself next week.

Ro,,I'm surprised Richard felt like that :( but as you say,,he may have support elsewhere which may be more beneficial than my inane ramblings :)...It's my sons bedroom we are decorating,have to have it finished next Wed...We have just got a message from him telling me his g/f has been promoted to Manager at her job,,all while she is in Corfu!! So pleased for her as they are both hard workers,,he is Head Chef at his job .. I wonder if Janey and Girly work? Maybe thats why they are MIA? I'm going to lie down now,,I have a headache brewing,

Hi, everyone!

 

Sorry I've not been around; I don't work (well, bits of me do still!) but my laptop is playing silly b*ggers - it keeps lagging, losing connection & generally being a heap of junk. I get so frustrated I can only stay on for a few minutes at a time!

 

Pleased you got your refund and extra compensation - good result, Lilli! Sorry to have laughed, Ro, but I thought your vacuum cleaner misshap was hilarious...!!!!!!!

 

I hope Richard is OK - I know he's having computer issues, but maybe also he's decided this thread has run its' course? Anyway, he knows where we are!

It will be 6 years up next month since my repossession, first charge company (GMAC) have been pains this year as their new administration company are very aggressive, however one phone call was rather amusing, young lad asked if I could make a token payment, I asked him 'What with? I am unemployed and have no income so this is a low priority alleged debt." He said "We will progress it to court..." I said "No problem, see you there." that was five months ago!

 

Since then I've had letters from three different legal teams all handing it back - and now it has gone to the FOS as they are not budging, they are claiming I owe £5,750 and gave a paltry £475 refund which had no backup documentation and it is this that has caused it to go to the FOS, I actually made it they owed me about £3,000+

 

Also they did NOT repossess me, the second charge company did and they too are in administration, nothing was paid off of that. I feel I have a very strong case as both sides are in administration, both sides screwed up and both sides owe me money and won't pay until I clear any 'alleged sums due'.

 

Jobwise the info on my credit file screws me for another 6 years but I have now set up my own company doing what I like best, and hopefully things will continue to move on.

 

Financially I am in a reasonable position, no credit card debts (never had any anyway) and apart from a large outstanding electiricty bill I am surviving.

Yay Janie..great to know ypu are ok hunbun xx My laptop keeled over and passed out permanently last month but as I have a BIG birthday in November me kiddo splashed out on a new one for me :)...(notice how I said 'spend the money on me debts?) lol.

I'm never going to have a lot of money..I'm predisposed to having too much month left at the end of the money,,especially as my OH gets the grand total of 58.45 a week to be my carer!! But I'm damned if I will let anyone owe me money,,it's the principle,,even if it's £5,,it's mine and noones getting it lol

Found out today that I won't be facing any medicals etc when benefits change over,,I think my medical history speaks for itself and they decided not to waste their time lol

Anyone who asks me for money gets the same answer,,if you can find any buttons on my shirt,,ypu can have them..I've got debts (nothing major now) but me rents up to date (paying arrears) and CTax too,,I seem to be in the minority cos my council are really good :)

Yay!! I knew Richard hadn't bailed on us !!.......So,,,I got my new hoover today (got a refurb one off ebay) OH plugged it in and success :madgrin: works like a dream,,£200 Vax for £40,,I know recons can be a risk but this one is fine,,hasn't been used,,no sign of it anyway Yay!! The Himself promptly ran over the flex,,stripping a bit down to the wire:-x I was a very very angry bunny,,,stupid eejit !!!

So,,whilst he is in the kennel I am luxuriating on my bed cos I have backache,,and thinking of ways to make him suffer :!:

Hi everyone,

I am so relieved that you are ok Richard-don't do that again :-) Lilli was sure you'd be back,I'm a bit of a pessimist.I lost two hard drives last month never had it happen before so I'm nurse- maiding this one,it's the oldest so gently does it.I'm glad the day of the soot story gave you a laugh Janie,if you had seen my OH you would have cracked a rib,very funny -the clean up wasn't though. SG your story is interesting,you appear to have seen off more companies than the recession, a service to humanity IMO.There you go Richard tough ladies and lets all spare a thought for Mr Lilli-I dread to think what will happen to him. Lovely to see all your posts......the only way is up

Thank you, Lewte, I'm fine at the moment! You're right - depression is an awful illness. But that's what it IS - an illness. And even if it can't be cured, with the right medication and support it can be controlled..........please don't let yourself be defined by it; it's not who you are, it's something you have! I'm not brave; I just reached a place where it was either sink or swim - luckily I swam, but I couldn't have done it without the right support. Any time you need a boost, we'll be here xx

 

 

So pleased to hear from Richard again - I know you PC issues (snap!) but it doesn't stop any of us worrying!

 

Glad you're both OK, Ro & Lilli. Will post tomorrow if the laptop will let me!!!

Nice to hear from all you guys. It's nice to see new people joining in discussion. I think we all draw strength from each other. Depression is awful and it almost never leaves me alone. Always waiting to grab my attention. With debt every thing is magnified. It appears there is no way out. Girls here have supported me so now i share my feelings more openly here. I am a wreck in real life to be honest.

I haven't got an OH (that was partly why I got repossessed, greedy ex from OH making life miserable for both!)

 

I do have a new toy and yes, it does take batteries (digital camera...)

 

My ex left me bruised.battered and broke,,,,in every sense. But no way was he going to break my spirit...I've been down in the gutter looking up at the stars......Now I'm still broke,but not broken. Although Mr Lilli is determined I'm gonna end up behind bars for battery,,I swear he is deliberately trying my patience over the decorating but there was light relief today when he fell over the big cat,and stubbed his toe HARD on the door frame :lol:......he didn't find it:lol: but I did,,I was:whoo:,,then :violin: and I also realised today that I have already been assessed for benefits,,clearly my medical history sent them runnin for the valium and they haven't bothered me since,,I'm officially a write off :(
