Enough is enough - lets fight back against ndr/marshall hoares/toothfairy/paycheck credit intimidation

It is agreed that the Original poster should be requesting a confirmed acceptance of the repayment plan and not a computer generated missive that can be denied at a later date.

The OFT has stated 'it is a basic principle that creditors cannot refuse to

accept payments from a debtor. If we receive evidence of a creditor

operating a deliberate policy of refusing to accept debtor created

repayments plans to the point where it is causing more detriment we may view

this as an unfair business practice'

Back on topic.

 

This site is called "The ConsumerAction Group". My personal opinion is that if we don't take any Action to bring this company's unscrupulous business practices to light in a public and meaningful way then they will continue to hide behind their relative anonymity and maze of websites and continue to entrap unknowing people.

 

I am all for making a stand !!!

 

 

 

The trouble as I see it on many areas a person takes action to try and get things started to sort out and other peeps in many cases sit back expecting it all done for them, that is why really need one area for all to participate as a group not always as an individual.

We have a Campaign section on CAG - if anyone has ideas then post in there and we can see what can be done. We have a CAG newsletter which reaches over £300,000 members which includes members of the media who often take up stories of interest.

 

For that to happen we do require well written and focussed threads - sadly some threads that could be of interest are so heavily edited because of bad language and comments that border on the libellous they are not fully supported.

 

The OFT cannot act for an individual - they do however collate all complaints and then act when it is in the public interest.

 

Stella Creasey MP has had a campaign against PDL companies for somewhile - people could write to her with their experiences.

On some forums a newsletter has a paragraph on a particular subject inviting debate for possible group action but at times people may read it but not participate, so the said subject is not actioned due to lack of interest. is the meaning.

Ah righto, understood.

 

Sadly, yes there needs to be interest in order to move forward in any campaign. I find the level of signatures required for government campaigns is too high.

I've been giving the it some thought and on how to go about bringing them to their knees and one possible angle I think is the following:

 

Among their charges are ones for passing the debt around between lender (tf, speedcredit), dca (ndr) and the fake bailiff company (mh), however evidence that is readily available clearly shows that the debt is in fact never passed on (which is kind of obvious given they are all one and the same company), but they don't even act as separate departments or something, for example TF will claim to have passed the debt to a dca called NDR and NDR slaps on a fee for accepting the file, yet after that it is actually still TF who chases you for the money, in other words, they are charging a fee that is not only imaginary high but also for a "service" that evidently never happened.

 

Shouldn't charging a fee (regardless of amount) for something that never happened qualify as fraud?

Marshall Hoare Bailiffs – Fraud Department

The above company are now sending out email and letters suggesting a fraud has been committed.

Of course this is just another vile tactic to intimidate.

However the good news is that fact they are insinuating Fraud could be enough to get the police interested.

I would therefore recommend that if anyone gets threatening correspondence to make a complaint to the police as well as all the regulation bodies.

You can also write to:

gary.chapple@northerndebtrecovery.com (As we all know NDR & Marshall Hoare are one and the same)

If you threatened police involvement chances are they will accept a payment plan of one months interest plus original loan and stop hounding you.

Accusing people of crimes? they just can't stop themselves sinking even lower.

 

They just keep pushing their luck, but one day the government will wake up and all the threats these companies send out will come back to haunt them as evidence in a Court.

I know it astonishing really!!

 

Bad enough they can even use the word Bailiff in the company name which in itself breaks the OFT guideline:

 

 

 

· "Make misleading representations as to the action it might take or might be taking to recover a debt"

Then on top of this add the word FRAUD to insinuate wrong doing. The sad thing is they are already making fortunes and making vulnerable peoples life a misery and no court appearance and slap will redress this..

Can anyone help me out with my understanding.

 

As per this article MCO Capital Ltd (Parent Company of Paycheck Credit) were closed down by the OFT

So how on earth do Paycheck Credit continue to operate and make loans via their website, you will note at the bottom of the website home page it clearly states: MCO Capital Ltd. PO BOX 6024 Warwick CV34

I find this astonishing, we also know that NDR/Toothfairy/Marshall Hoares are all fronted by the same people.

 

So how on earth can the OFT allow this to happen???

 

It would be appreciated if anyone can shed some light on this apparent injustice??

Yep. Plus, thats why it is so important that people issue complaints with the OFT. The threats, lies and everything else this group of companies does should mean they are unable to trade. It's good to see the OFT asking for witness statements though when you mention NDR and MHB,


Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

If anyone is being intimidated or harassed by this company into paying immoral interest and charges please do not.

 

This company continues to be investigated by the regulating bodies and is very closely linked to MCO Capital whom recently had their license revoked.

 

In fact all accounts formerly held by Pay Check Credit are now being pursued by Marshall Hoare Bailiffs.

 

DO NOT LET THE WORD BALIFF FOOL YOU, THEY ARE NOT BAILIFFS, HAVE NO COURT POWER

 

My best advice if you are being bullied into paying ridiculous amounts is to simply:

 

• Offer then only original loan plus one months interest and stick to your gums.

• Insist on all correspondence being in writing, retain all such correspondence, and copy in the OFT/FOS in any email replied.

• They make it difficult by as far as I know having no working email address.

• The way around this is to send mail FAO MARSHALL HOARES to:

 

RecoveryManagement@NorthernDebtRecovery.com

oliver.larholt@toothfairyfinance.com

 

*NOTE NDR/TOOTHFAIRY/SPEEDCREDIT/PAY CHECK CREDIT/MARSHALL HOARES are all one and the same run by the same people. Your mail will be forwarded and you will get a reply.

 

DO NOT WORRY THEY WILL NOT TAKE YOU TO COURT AS THEY HAVE BROKEN JUST ABOUT EVERY OFT REGULATION/GUIDANCE THERE ARE.

 

It amazes me they can even still trade but there you go.

UPDATE

 

Again thanks to everyone that has contributed to this thread.

 

As most of you will know finally MCO Capital had their licence revoked and companies such Pay Check Credit are no longer trading.

 

Finally it seems the OFT are getting close to shutting down NDR & Marshall Hoares.

 

I myself have made a witness statement and provided a portfolio of evidence against their sinister and threatening practices.

 

The tragic thing of course is that many people up and down the country do not know the legislation of their rights and continue to be threatened and intimidated into paying ridiculous amounts of interest.

 

I therefore again urge anyone being harassed to contact the OFT and offer any similar evidence.

 

Try and provide evidence of NDR & MARSHALL HOARES BAILIFFS threatening you at the same time.

 

Even though we know these companies are one and the same it is unlawful for both to hound you simultaneously for the same debt.

 

Marshall Hoares even have added ‘Anti-Fraud’ to their title in some correspondence.

 

This accusational tone may make their action a criminal act.

 

Anyway even though progress is slow progress is being made all the same.

Thank you for the update. I hope they shut down Marshall Hoares and Northern Debt Recovery, and even Tooth Fairy.

 

I myself was a victim of these 3 companies an was in the process of filing a complaint with the with FSO. I have also liaised with OFT regarding them, and yes, they are collating evidence. I received emails, phone messages from all 3 of them. Lately I've been receiving 2 different amounts.

 

I just do hope they all close them so they can stop preying on happless people.

The situation is that the OFT are finally preparing a case against Marshall Hoares/NDR and hopefully parent company Webloansprocessing.

 

I myself have provided witness statement of the following examples of breaches listed below.

 

Others affected should try and provide similar examples and address to:

1. Marshall Hoares Bailiff s– Anti-Fraud example

 

I believe using the word ‘Fraud’ when no such act has been committed constitutes an act of intimidation. Using the word ‘Bailiff’ falsely gives impression of powers beyond a mere DCM.

 

2. Email Sequence 1 – Examples of:

 

· Casual explanation why telephone harassment letters was ignored.

· Marshall Hoares Bailiffs writing to me stating Northern Debt assigned as recovery agents. Contradicts statement from Web Processing limited.

· Misleading Quotes to likely actions to follow.

· Pressure to Pay more than can afford

· Intimidation.

· Charges levied that a disproportionate to main debt.

 

3. Breach of Data

 

Screenshots illustrating that I can log into Toothfairyfiance.com and find details of my loan. Note my loan was Pay Check Credit. (MCO Capital) This proves that loans held by disgraced company MCO Capital (Struck off by the OFT) are being administered by Toothfairy Finance. (Also heavily fined in the past) They have even been stupid enough to add the Pay Check Credit logo to their website once logged in.(See screen shot 3)

 

4. Email Sequence 2

 

Further examples of various misdemeanours most notably 3 different companies pursuing the same date in close proximately

 

5. Marshall Hoares Email

 

Isolated example of unreasonable and threatening tone.

 

6. Northern Debt Recovery

 

Example of correspondence suggesting and or implying they have court powers designed to intimidate

 

7. Telephone Calls

 

Proof that I am frequently being contacted by telephone despite insisting all corresponding should be in writing and having sent a telephone harassment letter to MHB on various occasions as per email sequences. (Note they somehow use a local Aberdeen number to me to make the calls '01224 931013' However if you ring this number it does go through to Marshall Hoares.

 

8. Text Messages

 

Scans of text messages confirming both Northern Debt Recovery & MHB are harassing me about the same debt. (Note recent dates of text very close to each other.)

Until they find and stop Mr Larholt from running a business, you'll never get rid of toothfairy or his bunch of other sub companies.

 

They really need to give him 2 punishments.

 

Shut down his companies and ban him from directly or indirectly running a company.

Take away his millions that he gained through illegal activities and give them to needy causes.

hi everyone,i today paid my monthly payment in to barclays ,only to be told it was a company called cim tech ltd and not webloanprocessing,as cimtech is an original ,am i to take it oft have closed them down and as such where do i stand with my binding agreement with the ombudsman,i signed over 50 court exhibits over a year ago for the oft in camden and still nothing done,any more usefull info to hand
