Enough is enough - lets fight back against ndr/marshall hoares/toothfairy/paycheck credit intimidation

I would like to call on everyone that is currently being harassed and intimidated by Marshall Hoares/Northern Debt Recover/Toothfairy/Paycheck Credit.

As you will may be aware these companies are all one and the same:

This address is also at the bottom of Toothfairy’s website.

 

Also anyone with an account/balance with Toothfairy Finance can also log into their account detail on the Paycheck Credit website. Both are mirrors of each other.

This is as serious breach of the data protection act as Toothfairy and Paycheck Credit both claim to be independent of each other.

 

I suggest anyone with an outstanding balance with either to go and try for themselves.

 

Furthermore all of the letters they send out breach many OFT guidelines:

 

·Levy charges that are disproportionate to the main debt and which do not reflect the actual, necessary cost of recovering a debt"

·"Pressure debtors who have defaulted on an agreement to pay unreasonably large instalments when they are unable to do so"

·"Make misleading representations as to the action it might take or might be taking to recover a debt" *MARSHALL HOARES IMPLY THEY ARE COURT APPOINTED ect..

Yes they are Loan Sharks and yes loan sharks are not known for playing nicely, but lets face it, if we are not prepared for losses then we are never going to clean the system of those leeches who prey on the vulnerable.

With respect I have no idea why you think this may backfire. Already MEM Capital who also own Paycheck Credit are about to have their license revoked:

 

  • A daily newspaper is investigating them
  • An MP's office is investigation them
  • The BBC has exposed them
  • The OFT is about to revoke the license of their parent company (MEM Capital Ltd)

Remember many people not strong enough or aware of the law are going through a living hell because of these associated companies.

 

We have laws and legislation in this country for a good reason and the day people stop respecting this fact is the day action should be taken.

As I believe that your news paper is currently running an investigation into the company Speed Credit and their associated companies, I thought I would take it upon myself to share my current experiences with you.

 

Unfortunately I recently ran into some cash flow problems after my wife became unemployed and my overtime which accounted for more than a third of my salary was cut. In desperation I took out a number of payday loans from a number of providers. Long story short I have been unable to repay these lenders within the time scales that I had originally agreed to. I formulated a plan to settle the debts with these providers with a repayment proposal over a few months and asked them to freeze all interest. This was a relatively painless task after sending them all a copy of my income and expenditure statements, payslips etc and all of the lenders bar one have accepted my proposal.

 

My experience with Speed credit began after I had sent them the said letter explaining that my financial situation had changed considerably and that I was unable to repay the debt in the time scales that I had agreed to. I went on to add that I was not disputing the fact that I owed them £301 and all that I was asking for was for this amount to be repaid at a rate of £50.16 over a period of 6 months bearing in mind that I had previously rolled over the loan a number of times and had in fact repaid the capital amount of £200 odd borrowed in the form of interest only payments. After a week I had still not heard back from Speed Credit but continued to get emails stating that I needed to pay up or suffer the consequences of court orders, bailiffs etc. On Saturday 25th I received an email from a company called Northern Debt Recovery stating that I had failed to honor my agreement with Speed Credit and that my debt had now been handed over to them and that recovery agents would be sent to my address. I then telephoned NDR to ask why they had not responded to my letter and instead had decided to hand me over to Northern Debt Recovery. I was told by a gentleman who called himself John that my debt had not been handed over to NDR and that it was still with Speed Credit. This is where it starts to get interesting !!! I then called Speed Credit and surprise surprise the telephone was answered by a gentleman who called himself John and surprisingly sounded exactly the same as the person I had just spoken to at NDR. I was told that I would have to wait for all of my file notes to be uploaded to NDR from Speed Credit before they could comment on my proposal and was told to Fax my original letter together with my statement of income and expenditure over to Speed Credit as they had no way of receiving email. The said documents were faxed over on the morning of Monday 27th August.

 

Needless to say I heard nothing back from either Speed Credit or NDR except for a number of emails demanding immediate payment and the threats as above of court action bailiffs etc. I tried to reply to each and every email the moment that I received them but alas the emails were always undeliverable however I did reply with the same text that I had sent in the emails to NDR's online "Contact Us" section of their website http://www.northerndebtrecovery.com/contact.php again never received a reply that was relevant to my enquiries.

 

Yesterday I was absolutely shocked to received a letter in the post from Speed Credit Stating that I had now made absolutely no attempt to contact them regarding my outstanding debt with them and that I would now suffer the consequences !!! My wife then called Speed Credit to ask why we had received the letter after our countless attempts to come to some kind of amicable arrangement with Speed Credit to repay the debt. The person that answered the telephone simply told my wife that my salary was more than most people received and that I should pay up immediately, due to this persons extreme rude and threatening behaviour on the telephone, my wife terminated the call visibly shaken by the conversation that had just taken place . The statement made about the amount that I got paid only substantiated my suspicion that my income and expenditure statement and letters that I had previously sent had not even been read.

 

 

So here are my assumptions and findings.

 

1. Speed Credit and Northern Debt Recovery are one in the same (Against 1974 credit act)

2. The threat of collectors visiting my property without a court order (Against 1974 credit act, threatening and if they did visit without a court order this would be trespassing)

3. Both Speed Credit and NDR are chasing this debt (Against 1974 credit act as only one company can own the debt and chase it)

4. There is another serious breach of the data protection act I will explain below

 

If I were to visit the following seemingly independent companies websites http://www.paycheckcredit.co.uk/ or https://www.toothfairyfinance.com/ or http://www.speedcredit.co.uk/ I would be able to loggin to my account officially held ONLY with Speed Credit, using the same login details on any one of these websites.

 

Please do not hesitate to contact me should you need any additional information in this regard, nothing would make me more happy than to see this **** of the earth company go down in flames, I realise that their holding company MCO Capital has had their credit licence revoked but this does not seem to have curbed the way that these companies are conducting their business one iota.

I think that Rene may be referring to Forum Rules 3.5.i) and 3.12 and also the fact that many PDL companies frequent this site and may potentially utilise a thread like this one to their advantage.

 

Similarly, with the greatest respect for your desire to take action, investigations by newspapers, media and government departments are a very different thing to a 'call to arms' on a public forum.

 

As usual, this is just my spin on things and I may be speaking out of turn so please feel free to disregard anything that I say if you so wish :oops:!

I really cannot see how any of the PDL companies can use utilise this thread to their advantage.

 

NDR/Marshall Hoares/Tooth Fairy/Speed Credit/Pay Check Credit are all blatantly breaking just about every piece of legislation geared to protect the consumer.

 

I will stress though that anyone owing money to these companies should act responsibly and offer to pay at least the original loan plus interest.

What I do object to is the intimidation and untold misery these companies are causing many people and their absolute disregard for legislation geared to protect the consumer.

Regarding rules 3.5.i) and 3.12, I take your point, however there is overwhelming evidence to substantiate any statement I have made in my posts.

Personally I welcome the likes of the Daily Mirror getting involved, here is their previous article, which I am sure will have a follow up:

Everyone posting on this thread that has tried to reason with this company will have countless examples:

· Marshall Hoare implying they are court appointed bailiffs

· Multiply companies pursuing one debt

· Applying charges disproportionate to true costs of recovery

· Not respecting harassment letters

I respect your opinion but I feel if this thread helps just one person being bullied, then of course it will be worth it........

Courts look unfavourably on those who have vendettas against othwrs. Regardles of it is justified or not.

I do not wish to be rude, but you do not speak on behalf of courts, so that is a pointless statement, there is no vendetta, merely people standing up to intimidation. Courts probable view intimidation as far more serious. (Hopefuly so)

 

I will further ask anyone posting on this thread not to use hearsay and to please be sure that any allegation or statement made can be backed up with actual evidence:

 

  • Record conversations
  • Keep all correspondence
  • Stick to facts

Of course, if your information gives assistance to any of the forum members then it is a valuable addition, I respect your stance and can understand your anger and frustration at these companies.

 

In terms of how a PDL company could use this thread to their advantage, several forum members have quoted CAG as a source of information and advice during correspondence with PDL companies, governing bodies and even in court. With knowledge of threads like this, particularly in a court situation, a PDL company could potentially state that the site is biased against them and therefore any evidence or advice offered would also be biased and should not be taken into consideration.

 

Dealing with individual cases, as is the norm on this forum, is fine as it considers only the particular circumstances of the OP. Conversely a blanket campaign, as this appears to be on the face of it, can be considered differently as it is encouraging people to take action against these companies without considering individual circumstances. Of course, this is not to say that these companies are all acting responsibly, the evidence elsewhere on this site stands as testament to that; however, the other cases here all relate to an individual's position in their dealings with these companies rather than just as a 'cure-all' thread.

 

Again, as per my original post, this is merely my rather humble and not necessarily well-informed view on this, however, I can see exactly where Renegade is coming from with his comments thus far. Nevertheless, I respect your feelings and wish you luck with your campaign.

Again thanks for your considered response.

 

My opinion would be that any perceived bias would be diluted by actual hard evidence of intimidation.

 

The only motive of this thread is for people feeling intimidated to individually make complaints to the regulation bodies and to third parties such as the Daily Mirror and the office of MP Stella Creasy.

 

It is not so much a blanket campaign as there is no collective action.

 

I would again stress to anyone approaching the OFT, Trading Standards, FOS, The Daily Mirror & the office of MP Stella Creasy, to outline their own circumstances, backed up with hard evidence, which I am sure most would do anyway.

 

I just want other people to stand up against the way these particular companies are doing business.

Looks like i yes.

If you plan to pay by bank transfer or standing order just make sure you let them know as otherwise they will then complain and claim you would not have met your commitment and start the whole cycle again.

Ensure any payment plan is clearly agreed in writing.

 

If you are struggling with mail bouncing use: info@paycheckcredit.co.uk put for attention of NDR as first line of text DO NOT USE THE FORM OF THEIR WEBSITE.

 

Always cut and paste previous sequence of mail prior to replying so a sequence of corro can be established.

charles34c thanks for the reply. I have done exactly as you have sugested and sent an email to info@paycheckcredit.co.uk asking them to confirm in writing that the email that I received was indeed acceptance of my repayment proposal.

This is the email that I sent with the email that they sent me insterted below.

 

Hi I have received the below email from you and therefore assume that this is your response and your acceptance of my repayment plan that I have proposed to you (Sent by post and fax and submited on the NDR website). Should I not receive a reply to the country I will continue on this assumption. Regards

Personally I would not make the assumption that 'no reply' means they have accepted your proposal.

 

I would get it clearly in writing that the repayment plan is for full and final settlement and that all interest is frozen.

 

Here is an interesting article, although I am not sure if Speed Credit/Toothfairy/Paycheck Credit are members of any of the features trade bodies. (Maybe someone could kindly advise)

My personal opinion is that if we don't take any Action to bring this company's unscrupulous business practices to light in a public and meaningful way then they will continue to hide behind their relative anonymity and maze of websites and continue to entrap unknowing people.

 

I am all for making a stand !!!

Be honest these payday loans etc are criminal as the % rates are ridiculous, bring back the legislation of the 60s/70s when limit was 48% as I remember rightly, the government will let them go on as far as they can because of the tax element which we are paying or the people who borrow at this rate, as bad as back street lenders.

My personal opinion is that if we don't take any Action to bring this company's unscrupulous business practices to light in a public and meaningful way then they will continue to hide behind their relative anonymity and maze of websites and continue to entrap unknowing people.

There are indeed lots of action being taken. It is also very necessary for each "victim" to do their bit. We want people to make an official complaint to their local Trading standards office and to the OFT.

 

Sadly we find that people wont/dont do this..

 

Wonga have been censured for their unacceptable practices and one or two others have been closed down. This would not have happened with out public outrage, which CAG has contributed to.
