      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I had taken out a loan with wonga and had repaid it in full on 29.8.2012.

This was an early repayment and my account with them was cleared.

 

They have requested a further sum of £305.99 on 31.8.2012 which has made me overdrawn.

 

They deny that they have requested it although my bank confirms that it has been requested but not authorised.

 

I have spoken to wonga several times and they keep saying that my account is clear and there is no request pending on there screen.

It is like talking to robots.

 

They have a set of rules and answers that they can give.

 

My question is.

Can Wonga.com request money from my bank (basically freezing my account so I cannot access my money) without me owing them anything. Is this stealing or fraud. If so what is my recourse. Can i charge them for trying to remove money from my account without my permission.

Please help me if you can and what actions to take.

 

My bank has told me that the money will be back in my account on monday if no authorisation has been received.

Ask them for a final reponse in writing. Then go to your bank and get confirmation in writing that the transaction was requested. Go back to wonga and see what they say, then make a formal complaint with the oft.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

[email protected]. I have found them ok to deal with on the phone and they have always confirmed repayment plan by email straight after the phone call. I have repayment plan with them which is nearly finished now thank goodness. Have had to change dates a few times now but never been a problem. Good luck

I recently took out a loan with wonga which i can pay back no prpblems, i read that they send you a welcome letter, can anyone tell me if it says wonga anywhere on the envelope as i dont want my partner to find out i took a loan out with wonga.

 

Any help would be great

hi hope you dont mind me asking a question about wonga on this thread but not sure where to put question! we have had a wonga loan for a few months now, and have either paid in full and then reloaned again! or had an extension, but due to circumstance change, wife seriously ill, i am going to be unable to pay even the extension due on 19th, if i move my wages into another account so they cant take anything, would they still keep trying to take some money from the card details they have? even though my bank should decline as i have no overdraft facility, i dont think they will enter into a repayment plan until after due date has passed can they? also if i cancel my card, lost card!! can they still take from new card? will it automatically roll over to any card attached to the bank account? any help most welcome, also how can i stop them ringing my workplace??

I would phone them on day payment is due and explain your circumstances. Ask for repayment plan at amount you can afford and ask that they freeze further interst and charges as you are having financial difficulties. I found them okay to deal with on the phone and they confirm everything by email immediately. They will not phone your work as long as they have personal contact number foryou and you don't ignore them. they have never tried to contact me at work and I have been dealing with them for a while now. Don't know about payment from your card but if cancelled card shouldn't come off new card as different details. good luck

Sorry to interupt your thread, did you ever receivea welcome letter from wonga?

Hi what i did when i had a wonga loan was close my bank accounts that they held as a payment source, and re-opened new ones, they will keep trying to take money from that account so there is no way of stopping them, that is what i was advised when i went to a debt management company.

They should not phone your work, if they do tell them to stop as you will lose your job, they are normally very good., any cards that are linked to that bank account they will take money from, that is why i said close your account and open a new one, they cant touch your new account.

You say they are normally very good. If they were good, they wouldnt even consider contacting your employer for any reason.
