    • receiving a default NOTICE (forget simple default cal markers) does not mean it will get sold on... OC's very very rarely do court themselves.  if it does you would receive a Notice of Assignment from the debt buyer/DCA.  as for reduced payment if it remains with the OC and they issue a DN, no harm in trying but lets get all your ducks inline first. dx  
    • okay thanks do you know how long it will take for it to get to the DCA or could the OC try and issue a CCJ? even though it's unlikely also for example would the OC agree to a reduction and a small payment over a super lengthy period of time if agreed? Rather than go through chasing apologies again for all the questions, just trying to understand all the possible scenarios.

    • depends what the fees are, typically nothing can be added once judgement is passed bar litigation costs. on document retention time limits etc at least 6yrs previous must be held though many hold complete info. as for acronyms and abbreviations ideally yes they should

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Its been a while since I posted and PDE are still being a nightmare. First they jut ignored my emails never emailed back, then they actually blocked my email

Address from emailing them as I kept getting postmaster. Replys, then this morning to my horror my bank account is empty! I have been trying to contact these people to arrange a payment plan for a long time, they know of my finincial situation and they still took the money.

 

They took my last £200 which I desperately need as I've just had an operation and need to buy prescriptions at least 3 or 4 times a week and need to travel to the hospital and doctors everyday for the next four weeks! Also, some of the money was for my phone bill, credit card and QuickQuid payment.

 

I had already requested my bank to remove the CPA months ago when they tried to [EDIT] my money and they didn't and now the bank are telling me to wait unroll

The money is gone out of my account before they can do anything about it.

 

I called PDE and asked to speak to a manager and they told

Me he would call back. They hey never did so 45 mins later I called them back and they guy hung up on me! So I then called back and they told me there is no one in the office and it's now closed and hung up on me again.

 

Does anyone have any experience in getting their money back?

 

What do I do? I'm so upset it's just gone payday and I have nothing for 4 weeks

Go to your bank and tell them to chargeback the money. Under uk law they must comply.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Yes I've been on the phone to my stupid bank (which I'm going to leave after all this) and they told me I have to wait untill the money had actually left my account. I'm planning to go into the branch tommorow to demand my money and if I don't get it I'm just going to kick off. I've just read online that your bank MUST remove the CPA once requested, I did so back I about 2 months ago when I had a call from the fraud dept. regarding PDE trying to [EDIT] money from my account. I told HSBC that the payments were fraudulent as I hadn't given my permission and that HSBC must remove the CPA, I even had a new card.

 

If HSBC would have done what I requested in the first place this money wouldnt have been taken.

 

What makes it worse I tried calling PDE and they told me I'll get a call back and when that didn't happen I called back an this chav was giving me **** about the office being closed at 12:45 and hung up on me.

 

 

Has ANYONE had ANY luck on getting money back from the bank that had been taken by PDL companies?

 

The forum doesn't come up with much as most thread titles just say help
