PPC ask for proof of sig to accused prior to Court attendance

Have been recently made aware of this.

It concerns a driver accused by one of the regular name Parking Cos on here.

 

Case is in Court and accused has been sent a letter asking for them to provide proof of sig by way of copy of passport/driving licence etc.

They are saying that there is a possibility that another party could have registered the vehicle using their name etc and its their policy to report these suspicions to Police vehicle crime unit so they can check if the registered keeper insured the vehicle or if its been used in a crime.

 

They go on to say that they have observed variations in the sigs used in the court forms...and say they want to compare these with the one shown on the V5.

 

Anyone heard of this one before ?

Why would the Police want to get in involved in what is essentially a civil case where the alleged driver who has been summoned for failing to pay a PPN has denied having any knowledge of the incident,has nothing to do with the vehicle cited or has ever had any vehicle with the registration named.

 

Surely it is for a Court to be making any orders or requests for documents to be submitted and NOT a PPCo ?

This sounds like a shameless attempt at ramping up the pressure.

 

Firstly, they do not have access to original V5's and are in no position to compare signatures. The same applies to the insurance angle and whether there was insurance in place on the vehicle is nothing to do with them. Secondly, if they believe offences have been committed then they should report their suspicions not comport themselves as if they were the police.

 

Thirdly, if they suspect that there are discrepancies with court documents they should report that to the court and allow them to deal with them.

 

Lastly, I suspect that what they are actually trying to tackle is their suspicions that the person representing themselves as the defendant and/or registered keeper is not who he/she claims to be. As the claimant it is their job to check who they are suing.

 

Presumably, the defendant has required them to provide documentary evidence of the existence of a contract between them and their principal such that conveys sufficient legal interest in the land on which they purport to have been enforcing terms and conditions to have initiated proceedings on their own account?

I've just checked two of my Reg Docs, and my signature isn't on either of them.

 

The change of ownership slip that I signed for most the recent vehicle that I acquired, [May 2012], was balanced on a narrow strip on the edge of a desktop that was piled high with books and papers, and my signature didn't bear any resemblance to my "normal" scribble.

 

Does that mean that I shouldn't be driving it, or does it mean that I cannot be taken to Court for any offence, including really serious crimes - not death by dangerous driving, or that sort of rubbish, but parking over the white line at Morrisons?

Exactly! I'd be inclined to tell them that if they wish to bring this issue up in court you'll be happy to let a judge look at your signature, until then you are under no obligation to agree to their request.

Can't think of any reason other than using the legimitimacy associated with court as a cover to get a signature for dodgy purposes.

 

I see no harm scanning the background from a passport etc to recreate a signature box, then sign the Latin for 'Your wig is so obvious' or something similar, & await its appearance as a production.

I see no harm in complying, scanning the background from a passport etc to recreate a signature box, then sign the Latin for 'Your wig is so obvious' or something similar, & await its appearance as a production.

It is all a bit cloudy.

Since the PCo has issued the claim albeit,without doing their homework properly,and now sees a challenge,then surely it is for them to prove their case,and not for the defendant to prove their innocence ?

Nothing too do with court but I had a case a few years ago were it was claimed I signed a document. I asked to see it, and was asked for a copy of my signature for confirmation I was the same person. I had a friend sign my name, a few days later this supposed document turned up with my (friends) signature on it!

Besides those suggestions I made in an earlier post it may be that what the PPC are after is sight of the defendant's passport so that they can review CCTV footage and see if he/she was the driver or not at the time. This isn't a straightforward request and is patently a ruse of some sort or other.
