    • Update! I have now opened the mail from Barclaycard. I am assuming that their letters were prompted by my confirmation to them of my change of address, which I had advised them of twice. They are treating my change of address notification as a "General Data Protection Regulation Right of Access Request"  and state that I have made a "Right of Access Request. They are asking me to provide valid indentity documents! I have made no such request and am minded to ignore their request for extra information? I should add that their letters were sent to my correct current address!
    • Are you allowed to appeal if you plead guilty?   I know you appeal the sentence, but the criminal record formed from your guilt would surely remain?   I'm not sure if your able to appeal a crimianl record if you plead guilty are you?
    • DX: I did not pursue Link after I got the CCJ amended to monthly payments. Pretty sure the CCJ does not mention reviews, I do have the CCJ somewhere, I will have to look it up in storage. It is as mentioned on the thread you referenced  in your post #28. The Barclays loan was taken out in September 2004 for 60 months! Current Balance remaining approx £2K. On checking back my past correspondence with Barclaycard about this loan, there was a history of them ignoring my letters and offers to pay, and I even had problems in obtaining their bank account details for them to accept my payments! I have received strange correspondence from them too, one referring to insurance which I did not have. They seem very disorganised! Barclaycard told me to pay "Masterloan" a while back and I now receive regular statements and arrears notices from "Personal Loans from Barclaycard" clearly marked Masterloan, they changed the account reference number! I have never requested a CCA on this account. I advised them of my change of address last September, but they are still sending, until today, statements etc. to my old address! I have received 2 letters from Barclaycard Loan today though, not opened them yet!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Many many people fall into the same trap, and despite you hearing "calls may be recorded ....." it seems odd that when you state a conversation, it strangely wasn't recorded. It's all about intimidation and control. There are some genuine people out there who want to help, but they are outnumbered by the power mad egomaniacs.

Don't let it get you down, difficult as it may seem, but you have come to the right place with the right people and they will help you every step of the way.

Remember we may be living on the planet despair, but not too far away is the planet Hope.

thank you again, I come here every time I have a problem, which has been a lot of times, and always found support and kindness from experts. The DCA, Banks, alll make you feel like a criminal, whenever you are just trying to do your best.

Santander has been bailed out have they not????

You are correct, a quick google of 'santander bail out' revealed a mass of pages regarding that.

Again yes they do make everyone feel like a criminal, but saying that I have learned to give as good as i get. My favourites are.

"We will take you to court" - "Ok I'll get my suit cleaned and pressed, just make sure you turn up"

"We will add a default to your credit reference file" - "Thank you that will mean no more credit which means no more debt"

"We will send someone for a door step visit" - "Feel free, but they will be treated as a con artist, demanding money with menace, photographed and conversation recorded, and it may be forwarded to the police"

Yes I have used these in the past, and for some reason they were always followed by a long silence - lol

The weekend is here now so put things aside and enjoy the time, dwelling on it will change nothing, Start the new week with renewed confidence. :)

Read that, and it is very helpful, and you do feel less worried when you read that they seem to think that you take out debt, especially not to pay it back. Most people are honest, and pay the loans back, but obviously its the tax dodgers they need to go after, not the underdogs.....

I have a complaint in with FOS about Santander, and I have written to them, with our budget, and our offer of paying off the debt. Told them I would not be talking on the phone to them, but they keep sending letters, like today. Thanks for your letter, but will you phone us to discuss further..... Can they not read?

 

I am at a loss as what to do with them.

HELP PLEASE with Santander, they have not contacted us by letter, to say they accept our payment of £30 and then upwards towards the arrears. I am a nervous wreck as the phone keeps ringing, and they hang up when I answer. They also leave messages saying to ring them. I am about to start repaying the mortgage and the money towards the arrears, but without a written acceptance from them, I feel they will repossess the house. Very very frightening.

It would be best in this situation to phone and demand a response to the offer, the OFT Guidance says they should give regard to reasonable offers.

I really don't want to ring them, as you get a different person each time, and they read from some kind of script, which is income and expenditure....

Update, more letter Santander threatening legal action, and they say we haven't contacted them. We have sent them written letters, and I just sent an email yesterday. How can I get any of them to listen, and we can't even pay the mortgage, because we have changed banks, and the direct debit was cancelled by them.

Does anyone have the banking details for mortgage repayment.......

Unfortunately Satans bank is without doubt the most incompetent organisation in the banking arena, daily the press financial columns have tales of their mega blunders and gross incompetence.

 

All I can say is complain,complain then complain again and escalate to the highest level within their heirachy, then report to the banking regulators.

FOS have my formal complaint, but I don't have a name until now of who is sending these letters. Its a B Dougall.

 

But I would like to start making the payments as soon as possible, as I have the money, and money to start paying the arrears.

 

Can you pay them by internet banking? Who else can I complain to?

Very nasty call this morning with Santander. I rang up to make the payment, and I ended in tears, they threatened me with court and repossesion, which I said any court in the land would not grant a repossession, as we hve been paying all along, and now want to start paying the arrears.

Very very nasty person, I ended up in tears. They have added my sister's cigarettes bill to our food bill, and then say it is too big. I said I had made a complaint to the FOS, they said they had never had a complaint from them. I argued with them for over 30 mins, and still they threatened me. Who else can I turn to?

We got behind on our mortgage last year, but we only got back on our feet,

and Santander harassed us, had me in tears, and phoning at all times of the night and day.

 

We got them to accept an offer of £30 a month, on top of our mortgage payments.

 

They won't consolidate our mortgage arrears over the life of the mortgage, they also wouldn't give us a 3 month interest only period.

 

I was off with stress, and had only benefits coming in.

 

We have written to them, as it is now seemingly the end of that arrangement.

 

We have had phone calls on Sunday morning, Monday evening, and now another one at 8.00 this morning.

 

They will not correspond by letter, and they are driving us mad, with stress and worry.

 

Our house is worth about 200,000 and the amount we owe on our loan/remortgage is about 84000.00.

 

Please give me some advice on what to write to them, to stop these phone calls, as we got behind with a lot of payments, owing to only one wage coming in.

 

We are willing to keep on paying the £30, and have not missed a payment.

 

They are very very nasty people when you do phone them.

 

Need advice urgently, as I am totally stressed out with this lot.

 

I think I will go down to the G8, and ask them what to do?

Hi there, if you can hang on for a little while I'll draft a letter for you to send to them and affix it here. Try not to get too stressed - you have been making payments towards the arrears consistently and they should take that into consideration.

 

How much are the arrears?

How long is left to run on your mortgage?

Is the mortgage in joint names?

Hi there, letter affixed. You need to put your name where there are XXX's in the second paragraph. When you print out the letter make sure your printer is set for A4 paper (not the default Letter size) so it all stays on one page.

 

Send the letter by recorded delivery - keep a copy for yourself and staple the recorded del receipt to the letter. Check on the royalmail website a few days after posting and print off the signed for receipt - keep safe with your copy of the letter.

Just in from work, thank you so much. Letter from Santander on the mat, saying the arrangement has expired. The mortgage is joint, it is over another 15 years, and the arrears are £2376.

We have tried our best, but I was very ill with stress, and two burglaries, with two cars stolen, insurance premiums and obviously the price of living costs.

 

Thank you will do that letter tonight and post it tomorrow....
