Hi, can anyone point me to the correct forum to ge advice on what security guards at venues have the right to do as my daughter was held for 2 hours at the bar she works in and her bag searched in front of customers, nothing found as she had nothing to hide, was asked to leave,escorted to her car,went to drive off humiliated,they closed the gates on her,took her car keys off her,said they had called police, she had no problems with this, after 2 hours gave her back her keys asked her to go and not come back. She had done nothing wrong but was falsly accussed with no evidence other that suspicion that was totally unfounded and not true. She had been just used a toilet block with 2 toilets in it and apparently after she had left the block security went in and found suspicious stuff on the cistern. My daughter does not take drugs and was working, she does not even know if it was the toilet she went into that they found something on. It is a public toilet used by everyone, security only knew her face as she was working there, and put 2 and 2 together and made 5. She is so humiliated at the accusation, never in her life would she ever think this could happen to her. Her 6 year old daughter had been at the venue only half hour before with her boyfriend. She is so thankful that she was not there at the time. We need to know if there is anything she can do to clear her name and to help prove she is not associated with whatever they say was found, she obviously went to the toilet at the wrong time. Her daughter was still at the venue when she went to the toilet. It was half an hour later that security came to the bar and searched her.

From the brief search I've done it appears they have overstepped the mark.

Have a read of the link I've provided and any other legal information you can find regarding their rights. If you think for a minute they have acted outside of the law then I suggest you report this matter to the police immediately.

thank you for your swift reply, my daughter was waiting for the police to attend to make the complaint against them. she was alone and scared and held without her car keys for 2 hours. It apparently was not that urgent for the police to attend as after 2 hours it came back no officer was available and at 23.15 all she wanted to do was to get back home to be with her boyfriend and daughter. It is the humiliation that she cant get over, the people passing her car to get home making comments that were lies and the person that was ultimately responsible must have walked by her as well knowing it was them is eating away at her. Luckely her boss who employs her in the week as well as asking her to help out at this venue as a favour to him knows that the accusations are totally unfounded and is backing her all the way. They would not let him speak to her on the night or tell him anything about what they had allegelly found.

this was the 2nd time she had worked there. The bar is contracted out to her boss and is not run by the speedway. He had no say it what happened and was told he could not speak to her and he was not told what was happening. In his defence he had to abide by what he was told as it could off affected his contract with the speedway. It was the security staff that have told he she is not allowed back and not her boss, he knows it is not her that this is connected to and he still employs her in his business in the week. He is still trying to seek answers from the security guards but it has now left him without the appropriate staff to work next week as my daughter has no intension to show her face back there and to have people wisper about her.

How long has she worked for the employer? What do her T&C's of employment state regards dismissal?

 

Just to clarify, she was told that she was not allowed to come back to the speedway venue, because of this she will not be able to work there for her boss. Her boss has not dismissed her, security will not allow her to work there.

I think you need to write to the security company concerned. Send it Recorded, send it to the CEO of the company.

 

Ask a lot of questions, e.g. Why was I searched? Why was I held? What evidence did you have to hold me? Why was I searched in front of customers?

 

Why was I escorted off the venue? etc. You want to know what facts they had to carry out the search and leave them with no doubt that you will pursue the matter further.

We are in the process of finding out the security firm that runs the venue and contacting the police about what happened, but it does not detract from the fact that whatever if anything they had or did not have it had nothing to do with my daughter and whatever the situation was she should never had been treated in the way she was. I have no problem although it may be slightly embarrassing to be asked to look into my bag but as a matter of human respect i would be appaulled at it being done in the way they did it, then after finding nothing proberly feeling stupid themselves for doing it publicaly and picking on the wrong person had to take it a step further and ask her to leave making it look like it was her to save face is unaceptable and now she cant work there as well, not that she would want to after what happened.

You MUST pursue this - and make it clear that you are likely to be exploring a case for false arrest and will be seeking damages.

Hi

 

I would actually make a Formal Complaint to the Speedway Racing Event management as it would have been them that employed the security at the venue.

 

The actions of the security guards was one of illegally detaining you by then removing your cars keys stupid idiots they aint the Police.

 

Does the Speedway venue have any signage on display at all giving security the power to do bag searches.

 

When you write to speedway (please always get proof of posting) and request the following:

 

1. Complaints Policy and Procedure.

2. Security Companies full address and Complaints Policy and Procedure.

3. Clarification on Security Guards remit to do Bags Searchs and illegally detain and individual be removing there cars keys from the vehicle they were in and under which legislations/Act covers.

4. Clarification on any Signage at the venue giving Security the right to do Bag Searches.

This is all wrong wrong wrong and this is why "security" staff that are decent get a bad name . . .

 

The guards that have done this are using their powers for wrong, I assume they would be SIA licensed which means they would have had the most basic of training

 

Firstly to detain someone you have to place them under citizens arrest and inform the person you are detaining them for whatever reason, I'm pretty sure it is only possible to do so for things that are covered by criminal law too. Locking your daughter in and removing her car keys is certainly not the legal way to do it

 

Searching should only be done with permission of the owner, usually its best practice to be searched by member of the same sex too although not law

 

If possible I would direct your daughter to report the guards actions to the SIA too, you can do this via their website

 

As said by Sidewinder, you must pursue this complaint both with security company, venue and the police to stop power crazy individuals with blue badges on their arms who believe they have the power to do things like this, Im ashamed to admit I have a license and used to do similar work when I hear things like this
