I have a friend whose business was liquidated and they are wondering if it is still possible to claim for all the bank charges which had been accrued over the last 5/6 years. Obviously the business account is now closed (was with RBS) and the business no longer exists but is keen to reclaim the charges as they amount to approx £6000!

 

Any advice would be appreciated

If your friend was a sole trader (J.Bloggs t/a Acme Bank Robbers) and cleared his/her bank debts on liquidation, or since, then no problem, claim away!

If, however, it was a limited liability company, it could (probably would) be argued that any monies deriving should be distributed to creditors (if any).:)

Thanks for that. It was a limited company and dont know if debts were cleared or not. If not, what would be chances of creditors finding out and pursuing for their money? Also, if they had to go down the route of going to court to get their money what would be the name of the pursuer - do you think it would be in one of the directors names seeing as the company no longer exists?

Weeeeeell, if the company's debts were cleared, then one might be able to claim as Acme Bank Robbers Ltd (in liquidation) with one of the (ex)directors signing, but I imagine that such a claim would properly have to be brought by the liquidator appointed to wind up the company. So it depends whether a) there were any debts remaining and b) when the liquidation took place. Sounds difficult!

I'm only thinking aloud, so to speak, so I might well be wrong.:|
