Hi my wife had a little woods catalogue up until 2011 when she lost her job.They have been chasing her for the debt but ignored every offer we made them for £30 a month.Recently they sold the debt to capquest .I sent them a CCA request and they sent it within a week.Looking at the statement they also sent i can see that the total debt is £1,814.83 but £348 of that is charges for all the time they was ignoring our offers of payments and sending out statements .We want to pay what we owe but before i make an offer to capquest is there something i could do to get the balance down and get the charges taken off? can they or will they do that? Any advice would be much appreciated :|

You could send a letter requesting the refund of charges, they either will or wont.

 

If they don't then simply ignore the charges and pay what you physically owe, when you pay the amount you physically owe, leaving the charges remaining then you can stop.

 

Also, you need to make them an offer of payment that is realistic and comfortable for YOU, they do not dictate to you the amount to repay.

So if you decide it to be £1 a month, then that is all you repay.

 

Do [email protected] own this account, or are they just collecting it on behalf of their client?

 

If you have the catalogues bank details, then pay them direct via standing order, ignore [email protected] and pay the OC direct.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

As BB says, you should be looking to formally get those charges back plus any interest they have charged you on them.

 

Your claim will be with Shop Direct.

 

Fill in this spreadsheet and for the APR use the rate that they were charging you on the account.

 

When you have a total, let us know what the resultant figure is.
