dg soli have agreed a settlement of 25%,,,

 

im on token payment,

,no assects so still best 4 them at 25% from 3dr party,

,,but grt 4 me to be rid,,

they say there letter will say

,,,they accept £,,,, in settlement of above a/c.....,,

 

does not say full nor partial

,,,they say once settled credit file will show partal settlement with balance at 0,,

 

im thinking the word settlement will be ok,,as that implys the a/c is settled,,

 

your views please,,,

 

has any1 else done f/f with dg,

,,,,,was there wording same????

i take it we are talking about DG solicitors from a hsbc account??

 

what is the debt made up of?? loan? lots of charges you can reclaim??

 

full and final settlement sometimes they sell on the other half to another debt collector

 

i don't do code/text speak :confused:

Theres a few threads about F&F which should help you decide.

You do need to be making sure that there is an undertaking that the account will not be sold /assigned or passed to any third parties for collection.

hi i hate balifs..

yes dg solicitors re hsbc,,,,,,,loan/closed overdraft/credit card,,in

 

as you rightly say there might well be charges to reclaim not ppi though,,,,

 

i happy however to wave the charges just to be totally rid and at 25% i feel good offer,,

 

,,,was just the wording i was interested in,,for my own piece of mind and to help others,,

 

i obviously wouldnt accept partial settlement wording but when they put ,,in settlement.. is that enough,,

 

on dg solicitors part i must say i found very helpfull and easy to deal with throughout,,

 

whenever i needed to reduce my payments i just rang and they aggreed,

 

,,finally i dictated in/ex over phone and they acepted my token £1.00 offer,,,,

thks martin for your valid point,,

when they write ;;accept in settlement of a/c....would you not think then they would be unable to sell anything legally as they "accepted in settlement"" plus going to show as partial settlement on file with balance to 0,,

your views as ever greatly appriciated,,,,youve all helped me getting through what has been 3 trying yrs,,,,getting there though

i had a account with another bank and had around £1200 in fees refunded so worth trying

 

i`m thinking you should do a subject access request to HSBC not DG and get the statements fees ect that way you may get settlement reduced down further

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

i just want my life back,

,and dont want to lose my chance,when funds are there and an ofer aggreed,,

 

im a reasonable man,

,ive had the funds and if they prepared to write off 75% then i feel noway is there 75% of charges to reclaim of balance,

,i guess its bit of give n take...

i just want to be fair,

,yes im indebt ,

,ive had the cash,,

,,so mayb not a bad deal,,,,,

my post was more of the wording of the letter,,

,,,,ie,,,,,accept in settlement ,,,

,,,,,my point is that enough,,,

,,does that in law mean its settled est..

 

if banks started to be fairer im sure everybody would win

,,,,lets face it more over weve all had the funds 1 way or another,

,but when fall in2 hardship then dont want hounding like **** from hardfaced dcas,

,,but again must add dg solicitors have been fine with me,,

,,,obviously other people no doubt have had differeing accounts..

 

its the wording of aggrement i just wanted oppinions from,for my own piece of mind and hopefully help others..

Hi Scott,

 

Yes anything agreed should be waertight.

Some of these dealings can be complicated.

I have seen F&F accepted and an account left with 1p balance,because the account itself still has a value.

Also worth seeking in any agreement is that furher/continued processing of your data ceases.

If you were to draw up an agreement yourself,they should have no problem accepting it,if there is no hidden agendas.

you MUST insist the debt is marked SETTLED and NOT patrial settlement.

 

you must also insist that ALL negative data is removed from the file.

 

i'e the debt shows SETTLED, with no defaulkts or markers showing in tyhe history

else you might as well burn the money.

 

as for you comment about there not being charges/PPI to 75%

 

i bet there is!!

 

thatsa why they are offering the discount.

 

only using the ompound in spreadsheet will you know the true figure of the charges/PPI

indeed martin,,

what is your interpritation of the wording on mine,,,,when they write accept in settlement of a/c.........

would you say that is enough ,,

i take your point of coving myself with own aggrement sent to them,,,,,its just the views,,,,,,,partial settlement open to return 4 more

full and final wording prity safe ,,,,,,,but ,,,settlement of a/c,,,,,,personally i interprit that as ok as there accepting the money in settlement ie settled

can you explain this,,im little confused,,,,if they mark partial settled on credit file and show balance as zero,,,why would i have just wasted my money?surly the fact is i have only paid part of the outstanding(ie partial) so there showing it correctly,,but when they show balance now 0 that relects there part of writing other off,,

if balance shows as 0,,even though says partial ,,how can anybody as me for more,,when shows i own nothing??

I have a good one bookmarked in my PC whicj I used myself in a setlement prev with a DCA.

Mine was a little complex as I had a live claim in Court for a refund of CC charges against the OC,but the account had been assigned .

I had to do 2 agreements,one for each.(DCA and OC)

 

We recently became aware of a tactic being used by Barclays.

They had sold the account after it was defaulted.

The guy then informed Barclays that he was pursuing PPI.

Barclays threatened the guy saying they would simply have the account re assigned to them,offset the PPI and then sell it back again.

A particularly nasty tactic.

Obviously this does not impact on your case,but is an example of scenarios that can unexpectedly come up.

 

I am away from home currently so not using home PC to dig out my agreement.

 

You would think that Full and Final settlement as written itself is self explan but you should be adding the core terms of this.

For example;

 

IN THE AGREEMENT MADE BETWEEN XXXX AND XXXX,Full and Final settlement includes the following ;

 

1.That the amount of £xxx be paid by me no later than xxxxx to xxxxxxx.

 

2.That this amount is accepted and leaves a zero balance.

 

3.That the account is not assigned/sold/or passed to any third parties for collection or any other interests.

 

4.That there be no further title to any further monies from xxxxxx

 

5 That credit files are marked as settled,and no further updating later marks adverse entries.

 

6 That my data is not shared/reported/exchanged or processed with any third parties save as for the purpose of the credit reporting as detailed above.
