    • Are you allowed to appeal if you plead guilty?   I know you appeal the sentence, but the criminal record formed from your guilt would surely remain?   I'm not sure if your able to appeal a crimianl record if you plead guilty are you?
    • DX: I did not pursue Link after I got the CCJ amended to monthly payments. Pretty sure the CCJ does not mention reviews, I do have the CCJ somewhere, I will have to look it up in storage. It is as mentioned on the thread you referenced  in your post #28. The Barclays loan was taken out in September 2004 for 60 months! Current Balance remaining approx £2K. On checking back my past correspondence with Barclaycard about this loan, there was a history of them ignoring my letters and offers to pay, and I even had problems in obtaining their bank account details for them to accept my payments! I have received strange correspondence from them too, one referring to insurance which I did not have. They seem very disorganised! Barclaycard told me to pay "Masterloan" a while back and I now receive regular statements and arrears notices from "Personal Loans from Barclaycard" clearly marked Masterloan, they changed the account reference number! I have never requested a CCA on this account. I advised them of my change of address last September, but they are still sending, until today, statements etc. to my old address! I have received 2 letters from Barclaycard Loan today though, not opened them yet!!
    • Yes, a few months ago. They wrote back saying there was no CCA and the debt was unenforcable. I then started gtting bombarded with threatening emails from their 'litigations team' which have been sent to spam. I've now recieved the letter before claim with the PAP form enclosed, but still no CCA or even a letter from them to say the debt is deemed enforcable. Thank you.
    • That's a shame but not unexpected.  I'm not sure about your assumed  questions because I haven't been to court but I'm not sure about not accepting a criminal record. It could be a language thing but it isn't your choice unfortunately.  HB

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I sent my DPASAR to Natwest on 8th August. After hearing diddly squat, I sent a non compliance email to them on 3rd October which has not been replied to. I gave them a further 7 days to provide my statements which gives them another 2 days.

 

What do I do next if I still receive nothing? Do I have to get an N1 form?

Hmm, isn't it funny how I suddenly get letters from Natwest's DCA asking for what I owe them now. I owe them 3k I think mainly from a loan years ago. How do I juggle this whilst claiming back charges?

How about I send a letter saying I believe the balance to be incorrect as it includes unlawful bank charges for which I am in the process of claiming back. In the meantime, I can pay one pound a month to pay off the rest and send them a means form showing that I can't actually afford to live...which I can't. That sound alright?

Finally got my statements through dating back to 2000. I'm not sure what I can claim back though. Natwest's way of charging you was always in "interest". First of all I had 2 charges called an "unaaranged borrowing fee" as I went overdrawn, so I think I can claim those. But then it changed to "interest rate for borrowing uo to 1000 pounds on this account is 14.99% PA, this is the short term rate." Should the overdraft exceed this level it will go upto 29.5%. Then at the time of them taking the "interest" it just comes up on the statement as "interest due"

 

Is this the equivalent to charging me, do I tot all these up to reclaim, anyone?

unarranged borrowing yes

If the account is made up of charges then yes on the interest i believe, can someone confrim this.

 

On the above post, i would write to them and tell them that as the account is now in dispute you will not be paying the amount in full and also this is something that you cannot afford in your personal budget however after the dispute with NatWest has been solved you will look to settle the account with reasonable monthly payments.

Forget the arrears, only happened once. The problem I've got is the statement says charges or fees, then describe it as service fee which is the interest on an overdraft. Then I've got unarranged borrowing fee which is still interest but just higher, also called a charge or fee. Then later on in the statements the standard 6 pound service fee is only listed as "charge", not service fee so I feel I can claim this as it just says "charge". Beside those little things there's plenty of proper charges I can claim, all unpaid direct debits basically.

 

How do you guys send a schedule of your charges? Photocopying 100 pages would take ages, but obviously we need to keep our own copies yet send courts and banks copies too?

I have now received a letter from geoffrey parker bourne solicitors saying I have to pay up or it's court time. I have yet to send the preliminary approach letter to Natwest about charges, but should I just wait for the court date and turn up saying I'm relcaiming charges so the amount is false?

I believe thaou need to write to the solicitors stating that the amount is in dispute. If the loan was taken to clear unlawful penalty charges then that may also be claimable as others have done so on this site

Right, cracking on with this, I sent LBA ages ago so time for moneyclaim. In the excel APR sheet I've included charges on my statement that were just titled "charges", which I think are the 6 pound statutory interest charge for overdraft, which I probably couldn't claim back, plus the 14 pound unarranged borrowing fee, but as they are together on the statement as "charges...20 pound" then I will include them.

 

The problem I have at the moment is I think the account is still running but only as a means for me to pay my loan repayments into which then get transferred to the loan account or something like that, I really don't think I have access to take money out or anything. So can I get them to repay me these charges by cheque or into my current account with another bank?? If they stick it in their natwest account then it will go straight to paying my loan off which surely they have no right to do..?

Received a cheque within a month of doing moneyclaim, though it's from Royal Bank of Scotland. On the payee line it also has my account number, does this mean it can only be paid into this account and no other bank? The account is only used to pay off money owed, it's is otherwise out of order.

Thanks. I'm very suspicious about the seemingly lack of fight.... The letter has conditions about future charges being unclaimable against, musn't tell anyone blah blah but there's nothing to sign so what's the point in that....

As I understand it the account number is added on to the payee line merely to help prevent fraud, you shouldn't have a problem paying it into another bank, others have managed to do so.
