    • Did you send the note giving them the extension of time? When does the extension expire/date for issue of claim? I see that this thread started on 25 October. I have to say that when it started I thought it was going to be a quick fix and hadn't bargained for virgin's ineptitude which has certainly made it a lot more interesting but I'm hoping that March is going to be the month that it will finally all get sorted out. Surely someone responsible within Virgin has got to start taking a look and understanding the extraordinary mess that they have built for themselves and want to sort it out.
    • Dispute with Vodafone and get copy invoices last invoice 2016 no balance on old number I have invoices upto nov16 showing no balance brought forward just before upgraded.   you say above you have all the bills that state a zero balance up until nov2016 are they in the SAR return too,? and all the ones after nov 2016?   the account number in the poc is this the same number as on those bills you have? and the number on the pages of the comms log you uploaded? as the comms log appears to show payments were being made right through the period you say the bills you have all show £0? then being transferred to other invoice numbers  , do these invoice numbers the payments were transferred too match the invoice numbers show £0 balance you have?
    • no go back and read my guide earlier CAREFULLY...
    • Oh ok.   I thought I would need to write some sort of defence when I acknowledge the claim on the mcol website.
    • woe SLOWDOWN>   your defence is weeks away. (day 33) no there are no templates as each claim is unique. however, if you use our search top right. for say claimform card you'll see numerous versions people have adapted based upon our std holding/no paperwork defence , one of which, might well be suitable.   get CCA/CPR requests running monday and get AOS done now on mcol, you've already lost 10 of your 19days to do AOS   then get reading up as i detailed above the more you read here the stronger we become   dx

    • Hi @BankFodder
Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
So I issued the claim on day 15 and they requested more time to respond.
They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.

I opted for mediation, and it played out very similarly to other people's experiences.

In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them.

In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.

In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.

To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.

So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

Many thanks, stay safe and have a good Christmas!

Right!

In December of last year I SAR'ed Barclaycard and after many months of waiting for a reply, I finally got all of my statements in May! I used the advise here and in particular absorbed a lot of information from the legendary IMS and Slick and sent off my prelim letter, Spreadsheet and FOS Questionnaire.

I calculated my PPI claim at around about £800 including statutory interest and compound interest.

This morning, Almost 8 weeks later I received a letter from Barclaycard telling me that they weren't confident that PPI was a suitable option for me and that they'd like to put me in a position that I would have been in if I hadn't have had PPI.

The offer..

Just pence short of £700

Maybe my calculations were slightly out. I'm not even going to argue with them over this amount. I'm more than happy with it and it'll come in very handy.

I've filled in my acceptance form and snatched their hand off lol.

Now,

Credit Card charges. They've ignored my timescale and told me it'll be sorted by 13th August. We'll see, I think there will be a LBA heading for them on tuesday if nothing is heard. (See my other Barclaycard thread to keep updated on my progress)

Thanks to everybody here for inspiring me to fight back. I'm using the extensive knowledge and advise learnt here in helping colleagues and friends also go after their money!

Of course, a donation will be on its way to the site as soon as the funds clear.

Regards

Hmmmm.

Today is day 28 of their (21-28 days payment timescale) and I've checked my bank today and the payment is still not there.

I rang them and they told me the payment has been authorised to pay out and is sat at the final payout department ready to be paid and the delay is being blamed on a massive backlog of ppi payouts. She said she will send an email to the department but can't give me an estimated payment date.

Barclaycard and their timescales absolutely suck!! And they have the cheek to charge customers when not sticking to their timescales lol!

I suppose it's a case of sitting and waiting for another few days and hoping that this email (if it gets sent) works.

Hi BBM,

It's so ironic !!

Barclays Bank plc unable to make a timely payment due to a "massive backlog" of similar payments.

I guess it's really not surprising. Personally, I'd wait another week or two and would then chase and insist on an updating of the payment sum as regards interest.

Was thinking the same RE: interest. I think if I'm still waiting this time next week, I'll fill out a new spready and present that to them.... They are not in my good books, they didn't respond to my LBA RE: Charges :( lol

  • 1 month later...

Ok. So... I finally received my ppi refund of just under £700. They offset £60 of this against arrears. So £640 (give or take) was cleared funds in my bank account - a day before I got paid from work!

First time in many years that I've had money in my account the day before payday!!

Thanks for all help and advice!

I'll be making a donation to the site and continuing to offer help and advice myself in what has unfortunately become my speciality subject - dealing with payday loan vultures *_*

If site team could please change the title to reflect the pay out, I'd be grateful.

Thanks once again all

Regards
