Hi, I need some advice for my friend.

 

She has been repaying a bailiff £50 pm but de-faulted and hasn't paid since April.

 

She recieved a letter stating they would be visiting her on 31/08/12 if she does not pay £300 now.

 

She rang them to try to arrange something but they told her if she doesn't pay the £300

and then £50 pm there after they will be visiting her property with the intention of gaining access to remove goods

with the aid of the police.

 

She stupidly let them in the first time and she signed WPO.

 

Any advice would be greatly appreciate as she is in a little bit of a state.

What sort of debt is she paying the bailiffs for ?

Television, suround sound system, 3 piece suite I think that's it...

 

But she's unsure about the amount as well, shes positive it was £600 with the charges etc now they are saying it's £800

Were the items all listed correctly,

and does the three piece suite still have it's fire retardant tags attached,

without the originals still on it is illegal for the bailiff to sell it.

 

If removed would there still be sufficient seating for the whole family?

 

TV top of range or basic flat screen? 32" is entry level these days, and would get pennies at auction.

 

Is she working or on benefits,

single parent?

 

I am looking to see if vulnerability may apply.

 

as it stands the levy may not be enough to satisfy all fees and part of debt,

perhaps should have been returned nulla bono.

 

insufficient goods as bailiff needs to seize £6000 worth of goods for a £600 debt,

£8,000 worth with the extra couple of ton added.

 

What council and bailiff is this?

the bailiffs wont be gaining access unless you let them in so do not

 

even with a WPO for them to gain entry using force they would need to go back to court for that to happen

is your friend working, receipt of any benefits

charges sound wrong

has the suite got the fire safety tags still attached?if not they cannot sell it on,sounds like levy would not cover debt and fees

they should be paying council direct

do it via her internet banking site DIRECT TO THE COUNCIL.

 

never ever pay a bailiff

 

they'll just use you as a cash cow, heep on more 'unknown' fees

and the council get very little

 

if you pay the council direct as above, they cannot refuse it.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

As for the list I'm not sure if they were listed correctly.

 

No there would be no seating, only 2 bar stools which are in the kitchen.

 

She is single and works part time.

 

Its Newport council and Swift someone or another.

Agreed DX, but if she tenders it and is refused first and has the grunt on the desk sign a note to the effect they cannot accept the payment and she MUST pay the bailiff, she has evidence to ground a Formal Complaint, that the council are unlawfully refusing a tendered payment. She can then pay a regular amount using the online system, tell the council thais is what she is doing, and that she will be contacting the relevant authority and MP that council are refusing payment.

rule 1 bailiffs lie they trying to intimidate to gain fees they are nothing more than a powerLESS bully

 

the goods will not satisfy the debt ignore there door if need be

They wont be returning with the police, guess what as been said Bailiffs tell lies. Ignore them at the door. they will threaten with locksmiths, a van in the area, in fact the nice bailiff will get on the phone to 'talk' to the van (he is calling head office to scare you again) thats in the area. ohhhh other lie is we will return with police and arrest you to get you comitted to prison. They dont want your goods they want CASH and use every threat in the book to get it.

I know my rights Mr DCA I'm with the CAG......hello hello where you gone Mr DCA8)
