Hi All

 

I won't bore you with all the ins and outs of my situation at the moment, but I was suspended on full pay from my job with a Major International Parcel Carrier on the 9th July of this year. I am suspended for alleged falsifying records and lack of duty. I strongly deny these charges and have responses for all of it. I had my first investigatory meeting on the 11th July and was told I would hear from HR in due course. I then received an email requesting another meeting to be held tomorrow. I have spoken to my Union Rep and taken advice and asked for any questions to be sent to me so that I may consider them and my reply. I have been told by the Manager taking this investigation that she cannot supply the questions as they will be decided on the day. As far as I am concerned I have answered their questions fully and frankly and really do not have anymore to add.

 

Can they do this? I loved my job and the worry is making me ill. I also filed a grievance and this has not been mentioned.

Yes, they can do this, and it is reasonable at the investigation stage not to end you questions in advance so you can "prep" answers. They want your honest reaction.

Never assume anyone on the internet is who they say they are. Only rely on advice from insured professionals you have paid for!

Hi Debvfm,

 

I am in the same boat as you, I have been suspended for 3 weeks now! I have had my disciplinary hearing, this was 2 weeks ago and I am still none the wiser. I understand the pain and worry you are going through. It really is a horrible process to go through, and unless you have been through it yourself you can not understand just how badly this can affect you and your family.

 

The best advice i have got from this website though, is try not to worry (easier said than done i know) because what will be, will be. If the worst comes to worst, there are procedures in place to take it further, and take it as far as you can!

Hi all thanks so much for your feedback. I had my second investigation meeting yesterday and have been told that it will now be passed to another manager for a decision regards disciplinary. I have the backing of the GMB Union which makes me feel a little better. However they had around 8 further allegations and have even go as far as to track my mobile and laptop. Is this allowed? The worst I can be accused of it putting the wrong times on my activities I have not lied or intended to deceive. I hope it all works out for me, and for everyone else who is going through this hell.

I have been with employer for 16 months now, in a different part of the business than where I started originally but I was happy in my job, overexceeded targets (salesperson of the month many times) until very recently. I have had 4 line managers since I started but this had not been a problem until my most recent one.

 

I knew when working with the person before that for some reason she didn't like me and made it quite clear but at the beginning of June I had upsetting news. The person in question was to become my line manager on a secondment (my company don't call it that but I have to be careful not to give too much away) along with two others.

 

I was upset but determined that I wouldn't let this ruin my working life and decided to make the best of it. However, from the very beginning it became hard. I had suffered an injury (in my personal life) unrelated to work, for which I took 4 days off (due to heavy targets and expectations) two weeks before this person became my Manager which resulted in me having to have surgery and take very strong medication. A back to work interview did not take place (by my previous manager) and I was not asked if I needed any help or assistance from the company. I did and still do, I am still taking strong medication, have had to have an MRI scan due to underlying trauma of which I still await the results.

 

My new manager arranged for an OT to see me (without explaining why or what it meant) and then started the issues they had with me in earnest. I was asked how it felt to be a single parent and the oldest member of the team. She insinuated (in front of other members of staff) that I was sleeping with another member of staff, and generally made me feel miserable. We had monthly 121's and when I got mine I was ripped to shreds and the sales director copied into the email. Nobody else got theirs. Due to my injury I could not carry my laptop with me to work, she let another member of the team leave at 3.30 as they had forgotten theirs but made me stay with none until 5.30.

 

I had days out with the manager when all these seemed to be to do was to complain about the way I did things. I felt belittled and miserable and called up a previous manager for advice and a sympathetic ear.

 

Then things took a dramatic turn for the worst: Our company called in an independent company to call customers to verify that we had been into see them. One colleague was caught out (same manager as me) and got a telling off via a telephone call.

 

I got called into the office and suspended on full pay. I filed a grievance about my manager and requested that they didn't take the investigatory meeting nor my overseeing manager as they would not be impartial. I then had my first meeting and three allegations were put to me, all of which I strenuously denied. I had visited the customers and my only crime was that I had not put in the correct name on the system (due to my injury typing is very painful, I can only use one hand). I was then told I would hear in due course (I then went on holiday already booked, paid for and approved).

 

I have since had another investigatory meeting where my employer has tracked my phone and laptop. If I am guilty of any offence it would be putting differing times but I was clear to say that I had not said I had seen customers when I had not.

 

I am now waiting to hear what will happen next, but wondered if my employer was allowed to track the phone and laptop in order to try to catch me out. I asked about the grievance and the non completion of back to work interview and was told they could not comment on this. I hasten to add the OT backed me up on my injury and asked my employer to make allowances.

 

I am sure they will want to dismiss me, but they usually come up with a compromise agreement as they are voted in the top 100 employers and do not want to lose that kudos. I wondered what I can do if anything or are they within their rights? It feels unfair that one member of staff has done worse than me and only gets a telling off and I get suspended. I thought they were meant to treat all employees fairly and equally?

Yes, they can track company data on a company system to gather evidence.

 

Sounds a bit of a mess to me, faults on both sides?

 

Compomise agreement in effect suspends all "rights" as both sides agree to take no further action against the other.

 

What do YOU want to happen? What is your ideal outcome?

Well, I feel that I cannot go back and work for this manager with everything that has happened and from previous (old colleague) they will just continue to dig until they do find something with more credence then just dismiss. I would prefer a CA as long as the money was right and an OK reference. I would love to continue working there but it has definately lost its shine for me. :(

Ok. So that says there is no point allocating blame or picking over all the details. It'll just drive you mad.

 

If you are pretty sure most people get a CA... start drafting the reference you want agreed in it. Work out what your non-salary benefits are worth. And have a guess how long it will take to get a new job. Those are the negotiation points.

 

Time to dust off the cv.

It may also be worth mentioning that the whole thing has made me feel low to the point of visiting my GP and getting anti-depressants a course of action I didn't want to take at all. This is having such an effect on my stress levels and my poor children who are bearing the brunt of my bad temper.

Thanks Emmzzi but I am still waiting for a letter regarding the disciplinary action and what will happen there. Even people who under performed and were dismissed got at least 3 months money. And they had only been with the company 4 months. The company I work for is one of the largest in the world and also the one of the richest. (some good news at least).

Have you lodges a grievance about the stress inducing behaviour? If you really want to go, it won't hurt.

That is what I really want to do but have read other advice saying that the employer should come to you with an offer, and it is not looked upon too kindly if you make the first move?!?! I haven't made a grievance about the stress inducing behaviour, nor the fact that my injury is worse due to work related issues (having to carry laptop and type every day).

I was suspended from work on the 9th July with my first investigatory meeting taking place on the 11th July. As this appeared to get my employer nowhere I was told I would hear in due course and didn't until later on in the month informing me another meeting was to take place on the 9th August.

 

I have been told another manager would decide on disciplinary and my grievance and so far I have heard nothing. I am really in a terrible state about this and wondered how long they can keep me worrying myself sick about this? I am on full pay.

Hi Becky no the private sector. I think I'm going to have to see my doctor then, I can't cope with the lack of sleep and worry and being a single parent its a real strain on my poor kids too. I don't think they have any signs of resolving this anytime soon. Very upsetting.

They should have some sort of policy that governs this. Even if the investigation period has not gone too smoothly, then there definitely should be a Grievance Policy and time limits therein that they have to abide to. Ensure that you keep them abreast that their inaction has made you ill.

 

If they have made you ill because of inaction and that illness can be covered under the Equality Act, there may be a case for victimisation... although it is far from clear from what you have said in this post.

Taking everything into account, and whilst I agree that unfortunately there is not much that you can do but sit tight and wait, I feel that it might be an idea to put the employer on notice that the whole affair is taking it's toll on your health and wellbeing and see if that moves things along.

 

I daresay that due to the size of the organisation they may argue that the delay is due to confirming details with various parties (and making sure that they have everything straight before they act), but the delay in resolving the issue one way or the other is getting to the point of being unreasonable.

Any advice given is done so on the assumption that recipients will also take professional advice where appropriate.

Hi thanks for the replies. Well another day and no news. My grievance is over a month old now and I have had no mention of it. The initial investigation dealt with what my issues were (bullying, ageism and victimisation with over ten examples of behaviour) and said they would be escalated and another investigation launched. I went to see an occupational therapist (on the insistence of my employer) and have since been back to the hospital whereon my consultant informs me my injury has been made worse by having to carry my laptop and high volumes of typing (daily input into our system at my employers insistence. What is the best way to lodge another grievance? Is email sufficient? I really cannot stand being in limbo and what makes it worse is I have been offered another job and need to know where I stand. Hi All,

 

I have finally got a date for my disciplinary 30th August and I will have a union rep with me who seems to know what he is talking about.

 

I received all the paperwork (written statements and notes from investigation meetings) but have no update on the outcome of my grievance.

 

I feel sick to my stomach and am so anxious about it all although I have done nothing wrong it is just a case of a new manager disliking me and wanting to make a name for themselves.

 

Other members of my team have done worse than I am being accused of and just got a friendly 'word' from my manager as they are friends, I get suspended the following day.

 

I know that they will dismiss me as my face doesn't fit and I wondered what grounds I would have for an ET.

Glad to hear you have finally heard something, I know its not great news but at least you know something. I'm still suspended and have been to two investigations and still none the wiser as to what is going on

 

Hope you get sorted out soon, I'll update my post as and when I hear something but thank you for you comment before on my post
