Hi all,

 

I stupidly took out a QQ loan back in February this year. I believed I had paid it and since then my bank account had been closed as it was a joint account with an ex partner. I moved in with my grandparents for a while as I was paying off a lot of debt, anyway long story short my Grandad called and said ARC have rang me. I had no idea who they were so I stupidly rang them.

 

I have now been told if I dont pay up within the next so many days I will be issued with a CCJ, I simply dont have the money to pay at the moment and have not received any letters from the ACR to say I have so many days to pay or whatever. I am stuck and dont know what to do, I already have a satisfied CCJ but I cant get another! What can I do?

 

Any advice would be helpful the debt is for £249, I offered instalments but they refused.

They cant issue a CCJ like that. Theres an entire legal process that has to be gone through first. They are trying to scare you into paying at an amount you cant afford. Treat that phonecall as if you never recieved it. They are also not allowed to refuse repayment offers, especially if you can back it up with an I&E summary.

 

Again, they are doing the usual trick of trying to scare you into paying.

 

 

Could you post as much info as you can about this debt? Dates, amounts, breakdown of amounts, DCA's involved etc.

 

Also, when "ARC" (whoever they are) called your grandparents, what exactly did ARC say? This is important, because there could be a breach of DPA going on.

So what should I do from here? They have my old address (grandparents) Do I need to write them a letter? Or can I do something to get them off my case until I can pay? I'm not refusing payment I just cant do it all in one go!

You need to write to them and tell them NOT to call or write to your grandparents address. If they continue to do so after reciept of the letter, they will be pursued for harassment.

 

As for repayments, you need to write to them and explain your circumstances and outline what you can repay and when. be warned though, with Quick Quid, they love to ignore the law and pile on a ton of threats. They will add on a lot of charges to the debt as well, however, 99% of these are unlawful and unenforceable.

 

You also need to make a FULL complaint with the OFT who are the regulators for the Payday loan companies. Include as much info as you can as they are currently investigating the Payday Loan Companies.

 

One thing to note, you should never ignore your debts. What will happen is that your creditors will get judgement by default on whatever amount they are claiming. Most, when they realise you are ignoring them, will add on hundreds of pounds to the debt and push it through court. Because the amount was ignored, the Judge grants a judgement to the creditor and you now are liable for that entire amount.

 

If you are in regular communication and are trying to get a repayment, but they are refusing, should the debt go to court, you can easily turn up at court with all evidence and show the judge the truth. However, with Quick Quid, i wouldnt worry. Since they are based and operate from the US, they cannot take a UK debtor to court. They would have to sell the debt on to a DCA. If you are in constant communication and the debt gets sold, you can simply put the debt into dispute, and it locks it up until the dispute is settled.

 

They key though is to keep in constant communication ( all in writing, NEVER phone them). This covers your back 100% and shows your willingness to pay. Also, think about opening a parachute account, as Quick Quid will raid your bank account if they have the details for it.

Thanks for the advice its really helpful.

 

Can ARC take me to court though? I have tried to contact QQ but they have told me they will no longer deal with me at its been passed to them. The bank account I have registered with QQ is closed down, so I had no idea if Im honest That the money hadnt been taken. Is there a template anywhere I can use for a letter? I have no idea what to write!

It is impossible for ARC to take you to court since they dont own the debt. All they can do is forward it to a solicitor who will recommend taking it to court. But as i said earlier, QQ cant take you to court. They would have to sell the debt to a DCA, who would then have to go through a whole bunch of procedures first.

 

Like i said originally, it is an empty threat, designed to scare you into paying them.

 

If there were ANY realistic intentions of taking you to court, its months away yet, if it even ever happens.

It could be ARC EUROPE DCA,there have been numerous posts over several years in this forum,regarding this company.They are based at Walton On Thames.

Trevor Munn solicitor seems to be associated with ARC.
