    • Hi welcome to the Forum.  If a PCN is sent out late ie after the 12th day of the alleged offence, the charge cannot then be transferred from the driver to the keeper.T he PCN is deemed to have arrived two days after dispatch so in your case, unless you can prove that Nexus sent the PCN several days after they claim you have very little chance of winning that argument. All is not lost since the majority of PCNs sent out are very poorly worded so that yet again the keeper is not liable to pay the charge, only the driver is now liable. If you post up the PCN, front and back we will be able to confirm whether it is compliant or not. Even if it is ok, there are lots of other reasons why it is not necessary to pay those rogues.

My understanding is that this is outside the window for notifying. The issue date was 08/04/2024 which should have been in good time for it to have arrived within the notice period but in fact it actually arrived at lunchtime on the 15th. Do I have to prove when it arrived  (and if so how can I do that?) or is the onus on them to prove it was delivered in time? All I can find is that delivery is assumed to be on the second working day after issue which would have been Weds 10//04/24 but it was actually delivered 5 days later than that (thank you Royal Mail!). My husband was present when it arrived - is a family member witness considered sufficient proof?
    • lookinforinfo - many thanks for your reply. It would be very interesting to get the letter of discontinuance. The court receptionist said that the county court was in Gloucester 'today' so that makes me think that some days it is in Gloucester and some days its in Cheltenham, it was maybe changed by the courts and i was never informed, who knows if DCBL were or not. My costs were a gallon of petrol and £3.40 for parking. I certainly don't want to end up in court again that's for sure but never say never lol. Its utterly disgusting the way these crooks can legally treat motorists but that's the uk for you. I'm originally from Scotland so it's good that they are not enforceable there but they certainly still try to get money out of you. I have to admit i have lost count of the pcn's i have received in the last 2 yr and 4 months since coming to England for work, most of them stop bothering you on their own eventually, it was just this one that they took it all the way. This is nothing about paying just for what I use - I currently prefer the averaged monthly payment - else i wouldn't be in credit month after month - which I am comfortable with - else I wold simply request a part refund - which I  would have done if they hadn't reduced my monthly dd after the complaint I raised (handled slowly and rather badly) highlighted the errors in their systems (one of which they do seem to have fixed) Are you not aware DD is always potentially variable? ah well, look it up - but my deal is a supposed to average the payments over a year, and i dont expect them to change payments (up or down) without my informed agreement ESPECIALLY when I'm in credit over winter.   You are happy with your smart meter - jolly for you I dont want one, dont have to have one  - so wont   I have a box that tells me my electricity usage - was free donkeys years ago and shows me everything I need to know just like a smart meter but doesnt need a smart meter,  and i can manually set my charges - so as a side effect - would show me if the charges from the supplier were mismatched. Doesn't tell me if the meters actually calibrated correctly - but neither does your smart meter. That all relies on a label and the competence of the testers - and the competence of any remote fiddling with the settings. You seem happy with that - thats fine. I'm not.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I am having problems with Payday Loans i owe, however the biggest problem before I tackle the others is Toothfairy.

 

I borrowed £400, they now want £934 and ARE THREATENING all sorts of people coming to the house, but from northern debt recovery which are the same company?

 

I have listed below details, can anyone help me here, I'm not paying £934 back! Total payments I have made against the £400 (which was £544 with interest) is £294 so I owe £260?

 

how do I tackle this, they are awful people.

 

Tooth Fairy

I took out a loan on 16.04.12 for £400 and I was going to pay back £544 on 15.05.12.

Couldn’t make the payment, however I did make the following payments and had the following additional charges added on;

16.05.12 £72.00 Payment Made to TF

Then on 20.05.12 I got a email and letter from Northern Debt Recovery saying that they had added £150 to the loan as I was in default.

23.05.12 £50.00 Payment Made to TF

25.05.12 – they then added on the following charges

Loan and Interest £688

Recovery Fees £200

Repayments to date £126

Total £572

30.05.12 I send them an email to say I cannot pay anything until I get paid on 15.06.12.

01.06.12 I get these from TF

You currently owe:

Loan and Interest GBP 688

Missed Payment Fee 1 (day 29) GBP 10

NDR Accept Case File GBP 200

Missed Payment Fee 2 (day 43) GBP 10

Solicitors - Case Preparation GBP 150

 

Repayments todate GBP 126

Please note

1. Door Agents have been dispatched

2. Solicitors have been briefed

3. Bailiffs have been informed

Judgement will be sought and a Warrant of Execution to seize goods/obtain an attachment of earnings.

06.06.12 I pay £172

29.07.12 I get an email saying I owe £934 to them

You seem to have it hand when you say that you won't be paying all those stupid charges.

 

As you say NDR ar the same company, just another monkey pressing the red letter/email button.

 

Arrange to repay what you owe at what you can afford.

So I am going to drop them am email stating that I will only pay £260.

 

Could you help me out with the wording about the additional ridiculous charges they have added on please?

 

I am getting non stop calls and text messages saying ballifs will enter my home...

 

I have an additional problem with other payday loans but going through and sorting this one out has blown my mind enough for today.

Simply say that you consider the charges as unfair under OFT guidance and previous case law or words to that effect. Therefore you will not be paying them as they exist on the loan soley as a means for the PDL to unjustly enrich themselves. Should they take the debt to court, you will contest the charges in full.

 

 

Thats what i would say, but you can put it in your own words.

rene, finally we agree on something! basically that is your right to dispute the charges, I think the company would probably just want to get as much money through the door as quickly as possible so if you can offer for example £50.00 per month that would probably help your case.

I've always said to dispute the charges. They add them on because the vast majority of debtors don't know any different and pay it regardless. Others ignore it and the PDL gets judgement by default in court.

 

However, with toothfairy/speedcredit/whatever other names they are using, they want as much money as possible. It's why we call them "legal loan sharks".

Hi,

 

I am now getting constant emails from Marshall Hoares, and NDR on text and email about a door stop visit, you've all seen the standard letters I am sure.

 

I sent a complaint to OFT as i have been reading lots of threads on here, I sent them all the information including all emails from them and I jsut got this back from OFt.

What does this mean that I can't complain to them and I have to go to CAB?

 

 

One other questions, as I can't seem to find the thread with the address, I wanted an address to write to Toothfairy and the other 2, so I have proof of what I am sending as the emails just bounce back.

Send them the complaint by email and in the subject line use something like credit fitness. Also tell them that the group of companies is currentpy under investigation and want your cokplaint to be added to the others.

It is a criminal offence for any company to threaten a debtor with a warrent of execution to seize items from your home without going through a court.

They have to pass their file to a solicitor who is not attached to the company unlike their solicitors Atkinson Firth Solicitors or Phillips solicitors whom are in fact not solicitors but bogus solicitors set up by this company/ check all letters when you get them/ same print same size tiny letters and all the letters you get are from the same people.

Check out all PO Box addresses on all envelopes on google as they will have an address belonging to another company eg PO BOX 1934.

 

In all honesty it is the court whom sends bailiffs which are registered but you will find that if MARSHALL HOARES BAILIFFS write to you claiming they are registered then google hmcs and go on to their bailiffs site in which you will find that they are not upon the site or private bailiffs site.

15 Lyndhurst terrace is an empty house owned by an old lady until her death in 2011 in which I visited in 2011

 

OFT will not do anything about this company as the OFT are looking for breaches by them but not intrested in their victims.

 

Look up on google Oliver Larholt sent to prison.

He is the so called owner of Toothfairy Finance, Marshall Hoares Bailiffs, Northern Debt Recovery, Atkinson and Firth Solicitors, Phillips Solicitors and claims to be part of the London Treasury lol but left under a big black cloud after he had tried to conn London Treasury before going to prison for threatening a taxi driver with a gun

Its not a criminal offense. It is however a breach of oft guidance. It only becomes a criminal offence if they pose as bailiffs or court officers.

 

As cor those addresses, if you have solid proof, get in touch with trading standards, oft and fos immediately. this entire groupf companies is currently under investigation.

I am in the middle of dealing with these loan sharks at the moment ill try and help you out the best i can.

 

So i got desperate needing cash to go out so stupidly went to Toothfairy Finance for a payday loan of £200 (This Later became £400)

 

Ended up spending just on £295 of it i think so repaid the rest to Toothfairy through their website bringing the balance down. The repayment date came around and the balance was around £492 repayment i opted to roll it over for £72 (without knowing this was only for 2 weeks)

 

A month passed and i received a phone call from a Blocked number, it was NDR or Northern Debt Recovery saying that i had missed my repayment date and my balance was now £700! When i asked how the balance could have gone from £492 to £600 in 2 weeks he got really aggressive saying it was a serious matter that i had not repaid in the time frame given. I had the money to pay the £492 back now so offered to pay him the £492 and he said (My Name) This has gone too far now you are in breach of your contract and we need this debt settling today. I did apologise saying i did not realise it was only 2 weeks i logged in on my phone and rolled the balance over its an easy mistake to make.

 

He said he would accept £600 today and that would be it account closed. As you can imagine i couldnt afford that i was happy that i had the amount to pay what i thought.

 

After numerous times of me saying i could not afford £600 i offered him £530 for the fact i obviously misread the dates. His answer then was right we need to escalate this matter your obviously refusing to pay and he hung up on me!. Very unprofessional.

 

That was the last i heard of him for a week, in the meantime i had been to my local citizens advice and they had already heard of Toothfairy and NDR and said they are difficult to deal with.

 

 

ANYWAYYYYY you have been through all the letters and that so i will cut to the chase

 

 

TODAY 14/09/2012 i am on a debt management plan with PayPlan. I have a few debts mainly payday loans on here every single one of them accepting monthly payments and i havent had a single letter off any apart from Toothfairy.

 

In the past week i have had 12 calls from NDR and a company called MHB (Marshal Hoares Bailffs) LIERS! they are all part of the same company.

 

They have contacted my mobile and my works number and sent emails to me about Door step Collections in 7 days. PayPlan have been sending them monthly payments which they have been cashing and i hadnt heard anything from them for a good few months so thought they had finally given in. I finally spoke to the man called John who said my balance was now £1680 and is going to increase by £72 tomorrow if i dont enter onto a payment plan as they are not accepting Debt Management offers.

 

He said he would accept £40.00 a month and offer me a deal of £1000 if i agreed to pay on my next payday (28th) of this month.

 

 

I informed him i would have to speak to my debt management company and asked for his number to call him back which he obliged. PayPlan told me that Toothfairy/NDR/MHB are all part of the same company MHB are NOT bailiffs and they are already under investigation by the OFT. However they said they have numerous clients with accounts with Toothfairy all in the same boat. They said i can pay them £40.00 otherwise the balance will just keep gettng bigger and bigger they never take you to court but the balance eventually could reach £10,000! one of their clients has a balance of £4390 with these people!

 

I phoned them back and offered to pay the £40.00 via direct transfer from myself so i was in control. I spoke to a man called Wayne who said he could lower my balance to £1400! I informed him that his colleague had offered me £1000. THIS IS WERE YOU CAN HAVE THEM.

 

They say calls are recorded so i said check your recordings from John he offered me £1000. Wayne then started to stutter going he shouldnt have offered that its not company practice.

 

So i am now on a payment plan of £40.00 a month until September 2014. I get a bonus of £600 each year so ill just pay it off and have done with these sharks.

 

 

If you are worried about them coming round to your house DONT BE!

 

They will never turn up they will never take you to court. I dont know how they get away with the charges but i just want them out my life so i have started to bring my balance down. STAY AWAY in future these people are criminals! They need to be shut down.

Wait. You seriously admitted liability for their unfair and fraudulant charges? And you intend to pay them it?

You really should reconsider paying them that. In my opinion all you owe them is the loan plus the orginal interest you agreed. I will not be paying anything additional to that at all.

 

I refuse to speak to them. I wrote them a letter last week sent it to all terr addressed and I had one back today "this is an empty garage"

 

After some fab advice on here I will pay them my remaining balance because it is what I agreed and they can "do one" for anything in addition.

 

I'm sure I read an article on the owner being in prison?

 

I get emails texts and calls daily.

 

I do think u should SERIOUSLY think about what your paying them!

I have repaid £232 so far through my debt management plan and through the payment of the rest of the loan leaving me with about £240 left to pay maybe?

 

 

Should i just pay this and then refuse to pay the rest?

Pay the original Loan plus original interest. Nothing more. Then let them stamp their feet and try and justify the extortionate amount. They would NEVER take it near a court, because they wont want a judge to see whats going on. If they did issue court papers, then its 99.99% likely that they would discontinue, or simply not turn up at the hearing.

So basically pay them this £40 a month for a few months clear what i actually owe and then leave it? Shall i change my number so they cant contact me anymore?

 

 

I know they will never send anyone round to the house. Their letters are printed on cheap paper i even have a letter from them that has coffee ring stain on the back! This was sent like that!

 

 

Do i need to know anything else to combat these loan sharks? I am paying the rest of my debts through PayPlan and they are all fine with it, Its just Toothfairy and Friends.

If they are calling you, send the telephone harassment letter. If they breach it, get reporting to the OFT and OFCOM. If they still keep calling you, then consider taking them to court for harassment. Especially if it becomes excessive.
