      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Okay, so I got a text out of the blue from M&H Bailiffs a few weeks ago saying I had refused to pay etc etc. various phone calls, threatening voicemails. I hadn't heard anything from Speedcredit at all, I had a load of payday loans and thought I had paid them all off, obv I made a mistake. But did not hear from them until these fools got from me. Anyway, haven't herd anything for weeks then I get this text

 

Home visit within 7 days.Speed Credit £841 file is now owned by MH Bailiffs.Check email & call 0843381111 to settle your debt & avoid extra charges

 

Does this have any merit at all? They won't tell me what the original amount was, just get a standard email reply when I contact them via their website

Anymore info? did you agree a loan with speedcredit or was it another company like Toothfairy/paycheck credit?, this would likely be one of these text loan companies? Check any emails from NDR, but top priority: Don't Stress:) Unless they provide a county court judgement (CCJ) Bailiffs cannot be sent to your door, and if they are don't allow them to enter, call the police if need be. And as far as I'm aware they can only obtain CCJ if all other means of collection have been exhausted. Scare tactics pure and simple:)

 

I also see you posted about this a few weeks ago? Did you send off a complaint to the OFT?

Get a complaint into the oft. They are threatening you and misprepresenting themselves as bailiffs.

Yep. Unfortunately a LOT of people think that and run away and hide or give in to the PDL's demands. However, you cant go to prison for a debt like this. Bailiffs can come, but only if its been to court, youve defaulted on a court ordered payment, gone back to court and a judge has granted an order for a bailiff. This rarely happens unless judgement by default is granted or its obvious a debtor is trying to evade responsibility for the debt.

To start with I can't believe the charges!! It's disgusting! Plus the spelling is horrendous :/

I have sent another complaint to OFT about the text and email. As I did about the other ones I had a few weeks ago. I don't mind paying the original debt, I borrows the money and should pay it back. But there is no way I'm paying that much in extra charges. I don't even know what the original amount was, can't be more than £200 as I never borrowed more than that with the payday loans. The OFt did come back to me regarding the 1st complaint, said that it had been taken onboard, but they cannot comment on individual complaints and they Marshall & Hoare do have a credit licence :/ Also I would like to contact them via letter to negotiate a smaller amount, as speedcredit will not get bak to me at all. But from what I've read on this company, the address they supply on the website is not valid or is a vacant property.

Marshall hoares doing their normal thing. Misrepresentation and hiking up charges that they k now are unenforceable. give it a few weeka and youll see discounts being given. Meanwhile, make sure you keep up offers of a repayment plan and twll MH clearly that the account is in dispute. Keep everything in writing .

Send it to the OFT. They are in breach of Official guidelines on debt collection. If you like, i can write up a good letter for you, but it will probably go ignored by those idiots.

Thanks that would be great. Yes i have sent 3 complaints to them now. I do so every time i get a new email, tet or voicemail lol. Also ser a message to speedcredit stating i will pay the loan back, but only the original amaount + 1 months interest. No reply thoigh.

I don't know where I would send a letter to Marshall hoare?

marshall hoare are the same company. They just use different trading names and then try to tell the authorities they are separate companies.

Okay. Are NDR the same people? I have sent them an email saying that I am willing to pay off the debt, but not the illegal extra charges they have added, and as I am now unemployed asked for a payment plan. No reply as of yet.

If you could give me a letter template that would be great thanks :)

They are all ran by the same people. They simply try and work around the law, which is why they were investigated a while back and almost lost their license, and are also under investigation now.

The absolute first thing you need to do before i can write a letter for you, is to find out who exactly owns the debt. Only one company should be contacting you. Not multiple.

Check your credit record files for a start and see if anything is listed there at all.

 

Then you need to write a short letter/email addressed to the COMPLIANCE MANAGER or DATA Controller of the Original creditor . These should give you the info you need.

 

If they have sold it to someone else, then you want it in writing. If the OC still owns the debt, then you can tell anyone else who comes after the debt to take a running jump. Nobody but the company that owns the debt can do anything in regards to the debt.

Well I know the original loan was with speedcredit but they are not getting back to me at all :/

But I can log in to Speedcredit &NDR and Marshall Hoare in order to "roll over" my loan. Which will not be happening as I don't want them having my card details lol

Plus I've Changed address so don't want them coming after my mum and dad

Yea... no. There are no "shared call centres" during "peak periods". Even if there was, it doesnt account for multiple debtors being advised they have a SC loan when they took one out with TF or vice versa.

 

We will also now contact your employer to confirm your redundancy in the event that these documents are not recieved and/or the loan is not settled in full.

 

You need to get complaining. This is NOT allowed.

They are accusing you of a criminal act. Fraud.

 

The rest is just total crap designed to intimidate you and breaks OFT regulations.

I will send a letter by recorder delivery tomorrow to speedcredit, seen as their address seems the only valid one out of the three

Regarding sharing the same call centre,do they mean the same telephone on the same desk.Or maybe if the banks are busy,is that why MCO and CIM use the same bank account.

Hi All

 

i am being chased by marshall hoare, ndr and toothfairy all claiming different amounts and all claiming they own the debt.

 

the original loan was for £300 but now ranges from 3100 to 3300 depending on which one is sending me the e-mail, i get at least one e-mail daily of one or the other and have even had two visits to my home both times a=unaswered on the first occassion a card was left to call first call or something.

 

I have e-mailed all the companies refusing to pay the charges ect and offering payments but never get a reply , usually the e-mails just get bounced back.

 

they are just a total joke even the dodgy solicitor they were using who i rung up and sent e-mails id recieved off them ,left them lol im just waiting for them to take me to court but they wont this has been

 

going on since april 2011 and they defaulted amount was 2400 so why they still adding charges

Theyre the same company and are trying to scare you into paying.

 

You MUST issue formal complaints, and possibly seek legal advice. There is NO way a debt can escalate from £300 to over £3000 unless there are illegal charges and interest amounts added.

 

Also, NEVER phone them. EVER. They are possibly the worst PDL to deal with at this time. Mainly because they know they are about to lose their license.

Dont worry i will not be ringing any of them , i have saved all the e-mails from them , last count was 115 , all waiting to be printed off and taken to court as wqell as the 20 odd e-mails i have sent to them without reply
