Hi there, I took out a loan in 2001 with Barclays bank

 

And due to ill health was not able to continue to pay it on early 2002.

 

Since then the debt has been sold on to many debt collection agents and all went quiet after 3 years of ignoring them,

 

then last year I moved and they traced me and my mobile number somehow!

 

I did not acknowledge them or answer the calls,

they left messages, but they continued with the harassment.

 

I have since moved again and they are now sending letters and leaving messages on my mobile again.

 

I have always ignored them, but I don't want this to continue everytime I move, especially 11 years down the line.

 

Is there anything I can do to tell them to get lost?

Hi Islandgirl,

 

First of when did you make the last payment or acknowledge this debt?

If it is over 6 years or 5 years if you live in Scotland with none of the above, then the debt is Statute Barred.

 

Have a quick check on your credit file, just in-case some DCA has slipped a sneaky CCJ through using a previous address, don't worry if they have, this can easily be set aside.

 

The template statute barred letter template will be in the Library section on the top tool bar.

 

As usual, even though you have ignored them, do not ring them, if you do answer, refuse to go through the security questions and say "in writing only".

 

Send the statute barred letter to who-ever is chasing you now.

Before firing off any letters about this take time to

find out the status of the debt.

 

1. Check your credit reference file if the debt does

not show the more than 6 years have elapsed since

it was defaulted.

2. To be statute barred there must have been no

payments or acknowledgment in writting in 6 clear

years.

 

Having established the above send the following

to the DCAs Compliance Manager.

 

Ref: xxxxxxxxx

 

Dear Sir or Madam,

 

I refer to your many attempts to contact me regarding a debt for £xxxx which you

allege is owed by me, please take note I do not acknowledge any debt to you or

any company you may claim to represent.

 

Having now reviewed my credit history and taken advice on this matter I have

concluded that any such alleged debt is now Statute Barred therefore I will not

now or in the future make any payment or offer of payment.

 

You will now cease to process and store any data relating to me with immediate

effect, all telphone contact must cease.

 

I am sure I do not have to remind you of the relevant sections of the OFT Guidance

on Debt Collection 2003/2011 regarding the pursuit of statute barred debt, also I remind

you of the ICOs Technical Guidance regarding the sale of statute barred debt without

informing the purchaser of the status of the debt.

 

Send recorded delivery.
