      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, we've been browsing this site for a while now and the info and support on here is amazing

so we decided to sign up as we are going through some changes with our debts and could really use some advice....

 

We have had a DMP through CCCS for 2 years now and having seen the levels of advice and info on here decided we would prefer to go it alone

(They are paid by the banks so there's some part of me saying they must act in their best interests not ours)

 

We have cancelled our DMP with CCCS and are now in the process of contacting all the creditors (11) to advise we will be managing ourselves.

This is a scary moment as I like the comfort of CCCS but as we are in a much better place than when we started it makes sense to go it alone!

 

We have successfully claimed back PPi from LLoyds earlier in the year and have a couple of other claims on going.

 

However my 2 biggest questions at the moment are :

 

When a creditor doesn't accept your original claim that the ppi was mis-sold what is the best way to proceed

- my claim is that I didn't think I would be approved for the card if I didn't have the cover

- does anyone have a good template letter to respond with??

 

Also following what others have done on the forum we have offered full and finals against at 10% (cheeky but we thought we'd chance it - all rejected)

and requested 4 CCA's from DCA's that have debts transferred from original creditors

-- This is where panic begins to set in - where do we go from here

 

Any advice very gratefully received..

never ever pay a DCA!!

 

Have you checked ALL your debts SHOW on your cra file?

No, no templates as each situation is different.

 

How did you apply for your PPI refund. Did you complete a spreadsheet and the FOS form from their website.

 

 

Which company is refusing to refund you and what reason have they given for the rejection? Some companies reject claims as their first line of defence. So you might be able to challenge the decision.

 

If it was implied that you had to take out the insurance, then that is a good enough reason. If you could answer the questions above, then we can move forward.

Can you let us know a little more about the debts.

 

Original Creditor - DCA - Date account opened and Defaulted - is the DCA now the new owner of the account having been assigned the debt or are they merely acting on behalf of the Original creditor.

 

When you were with CCCS, had they managed to get the creditors to freeze interest for you ?

Hi thanks for the quick reply just off the log in to experian and cross check the debts I'm paying - the DCA's are Wescott, Cabot, Idem and Apex acting on behalf of LLoyds TSB and MBNA are you suggesting I stop the payments or try and return the debt to the original lenders for payment - I believed that they have bought the debt ?

Tesco Credit card are rejecting on the grounds it was a postal application and I had to tick the box requesting cover, also the literature sent out detailed the cover etc

LLOYDS TSB BANK £2,352.28 loan defaulted 12/10

TESCO BANK £194.43 CC default 2010

TESCO BANK £999.06 CC default 12/2009

WESCOT CREDIT £5,449.05 formerly Lloyds CC acting on behalf of Lloyds rejected CCA requested and advised to contact LLoyds defaulted 11/2011

 

All but Barclaycard have frozen interest - having spoken to majority all are happy to keep frozen if we continue payments directly

 

unfortunately I have limited information on opening dates etc which probably explains the mess we got ourselves into!!

unfortunately not, I was under the impression I applied for it online - I am going to write asking for a copy of the original agreement - if it was postal and they have checked it before replying they 'must' have a copy to prove their defence

IMHO, and in view of the information you have provided - I would continue to maintain the payments that have been negotiated with your creditors.

 

Barclaycard.. are there any late or default charges that have been added to the account ?

 

If so, then you will able to reclaim those.

Yes, I would send a CCA request to Tesco and ask them to provide a copy of the agreement. In my experience, they are usually pretty good at retaining these.

 

It will cost you £1.00 and there is a draft letter in the CAG library.

any F&F you make, needs to hve a condition that your CRA file is marked settled [NOT partial settlement]

 

and all neg markers removed, else it will be there to bite you for 6yrs.

Update on the Cabot debt this was originally a citi card sold(?) to clarity then opus and now with Cabot so we are requesting a CCA just to see what happens

It shows as Credit Card from Idem Capital Securities - doesn't show any history of previous credits in the chain and is 'up to date' with no defaults since 01/2008 although some 1/2 late payments which were caused by the transfer I presume or CCCS were late paying?

citi stff is extremely rare to have a cca.

 

i think you need to cca them...might save a few pounds in the long run.

It shows as a default in October 2011 but no mention of previous accounts

Have sent a full and final settlement letter to LLoyds with a 3rd party cheque as seen on Andie_303's post it's only a small amount so it's worth a punt ??

Have you got Lloyds written acceptance of your offer, if not I suspect they'll just credit it to the account

and just keep on chasing.

Have you got Lloyds written acceptance of your offer, if not I suspect they'll just credit it to the account

and just keep on chasing.

 

It's a bit of a sneaky trick

 

following advice from someone on this forum,

 

send a cheque for a lesser amount than the debt with a letter stating it is sent in full and final settlement if they cannot agree to accept the amount return the cheque.

 

Theory being they will seperate the cheque and letter in the post room bank the cheque then deal with the letter afterwards when it's too late.

 

The cheque has on the reverse ' only to be banked as full and final settlement of account number xxxx'

 

It's sneaky I know and may be returned but we thought we would try it with one of the smallest debts

£47 with a cheque for £15 to be honest they have had hundreds and hundreds of pounds from unfair charges from us over the 18 years I banked with them so it's fair enough

- wouldn't dream of doing it with a substantial debt.
