Received a letter from AKTIV KAPITAL relating to a debt

 

they said i owed of over £2200 the original company being GE Capital (First National Tricity Finance ltd). I have no idea what this was for.

 

I looked on here and took your advice and sent them a letter following your template with a £1 postal order requesting details of the debt.

 

Another letter arrived saying if i pay up over £1400 they would pay nearly £800 for me under their 'New Deal' scheme. I ignored this one.

 

Today i received a letter from them to say;

 

'Although we purchased the right to recover the outstanding balance due under the agreement,

as we are not the original creditor we do not hold the original documentation in this matter.

 

We did contact the original creditor but they have been unable to provide us with the information you requested,

 

and as such we now inform yo that we will cease all further collections activity in regards to this matter, whilst not in possession of such documents.'

 

What a relief, whatever they thought this debt was for i don't have to worry about them chasing me anymore.

 

I would recommend anyone getting letters like this from debt collectors to send them a simple letter and for £1 postal order and the cost of a second class stamp you can get peace of mind.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I will keep the letters from them and when i get another one from someone else i will reply back with a copy. If they can't get the info to inforce a said debt then i'm not worried about the next guys trying no. I feel a sense of achievement as i usually would have thrown it in the bin and waited for the next one but it feels good to fight back. It will be quite amusing to see who takes it on and how much they add for their 'charges & fees'.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

You'll know its reached rock bottom when ruthbridge try their luck

 

They must qualify as the easiest DCA to be rid of one letter and gone for ever!!!

First National Tricity Finance/GE Capital went bust a few years ago. One of their major businesses was financing home computers for the now defunct company "Time Computing".

Virtually no paperwork still exists - I had a similar letter from Aktiv over a year ago, with no recovery action since.

 

As advised, keep your letter saying that no original documents exist. There's very little likelihood of anyone being able to suddenly produce even a reconstructed agreement. So, basically, sit tight and it'll be Statute Barred in 6 years.

 

Other fleecers may well try it on, but they don't stand much chance...

I have had a letter from them asking for 800 pounds i thought mistake and binned it. I have just had an email from my identity protection service saying there has been changes to my credit file i have logged on and i now have a red line on my credit report for the last god knows how long. Should i contact them?

Ok what is the default date shown on the entry?

Does the entry show ''date of last delinquent'' ie

when was the last payment made?

They have only done it sporadically every few months saying default 802£ credit/store card taken out 23/03/2005

Exactly If you are sure that there has been no payment

or acknowledgment in writting send the following letter

to AK.

 

To the Compliance Manager

Aktiv Kapital.

 

Ref:xxxxxxxxx

 

Dear Sir or Madam'

 

I refer to your letter dated xx xx xxx in which you allege there is a debt

for £xxxx owed by me, please take note I dso not acknowlege any debt

to Aktiv Kapital or any company you may claim to represent.

 

Haveing taken advice and researched the alleged debt I have concluded

that any such alleged debt is STATUTE BARRED and I will not therefore

make any payment or offer of payment npw or in the future.

 

I am sure I do not have to remind you of the OFT Guidance 2003/2011

and the section regarding the pursuit of statute barred debt, please

also note the ICOs technical guidance of the sale of statute barred debt

without informing the purchaser of the status of the debt.

 

I now require you to cease proccessing and storing any data relating to me.

I require you to remove the entries on all credit reference agency files with i

immediate effect as they are manifestly incorrect and damaging to my credit

status, failure to comply will result in a complaint to the ICO.

 

Send recorded delivery.

can i have this removed from my credit file as i have never had a store card and the 2 credit cards i do have are both ok so i dont want this on my file

 

If the default date is 27 06 2006 then it should drop off your credit file shortly, if its not dropped off by the 27/7 I would write a letter to the CRA reminding them off the default date and the six year limit on reporting defaults :)

 

Take a screenshot of the entry too, just in case they try and alter the dates.

OK, start by placeing a notice of dispute on the credit

files you need to check all 3 main agencies Experian (credit expert)

Equifax, and Call Credit (Noddle).

I 'll add more to the draft letter.
